ARCADIA CITY PLANNING COMMISSION
REGULAR MEETING
Tuesday, January 8, 1991
The Planning Commission of the City of Arcadia met in regular session on Tuesday, January 8, 1990 at 7:30 p.m. in
the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Pro Tem Tom Clark
presiding.
PLEDGE OF ALLEGIANCE
ROLL CALL:
PRESENT: Commissioners Amato, Clark, Hedlund, Szany
ABSENT: Commissioner Papay
MOTION
It was moved by Commissioner Szany, seconded by Commissioner Amato to excuse Commissioner Papay
from tonight's meeting. The motion passed by voice vote with none dissenting.
MOTION
It was moved by Commissioner Amato, seconded by Commissioner Szany to read all resolutions by title only
and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting.
MINUTES
Commissioner Hedlund commented that on page 2, the first paragraph the words "so it can be utilized" should be
deleted. Paragraph 5 on the same page should be amended to read that "lot 2 should be tied in such a way to some
other valuable property ".
MOTION
It was moved by Commissioner Amato, seconded by Commissioner Hedlund to approve the Minutes of
December 11, 1990 as amended. The motion passed by voice vote with none dissenting.

The City Attorney announced that the City Charter requires that for any action to be adopted or approved a
majority of the entire membership must vote in favor of the particular motion. If the required three votes are not
obtained the motion would fail. If the required three votes are not obtained (1) an applicant may request
continuance and it is up to the Commission to decide whether or not they want to grant it; (2) the matter could be
heard and then deferred for final decision pending participation of the absent members as long as they review the
records of these proceedings which would be made available to them or (3) the matter could simply go forward to
the City Council.

The staff report was presented and the public hearing was opened.
Michael Chen, 2225 W. Commonwealth, Alhambra, representing the applicant stated that they are in agreement
with all of the conditions in the staff report.
Consideration of a tentative map for an 11 -unit residential
No one else spoke in favor of or in opposition to this item.
MOTION
It was moved by Commissioner Szany, seconded by Commissioner Hedlund to close the public hearing.
The motion passed by voice vote with none dissenting.
MOTION
It was moved by Commissioner Szany, seconded by Commissioner Hedlund to approve TM 49687 subject to
the conditions in the staff report.

PUBLIC HEARING CUP 90-019
16 E. Live Oak Ave.
Lang Lampert Arch. for Ralphs Grocery Co.
The staff report was presented.
Consideration of conditional use permit and modifications for
a new 39,800 sq. ft., 24 hour supermarket with liquor sales for
off -site consumption.
Staff said that there is space between the building and Live Oak which will accommodate the relief work on the
walls. The alley does not continue through the property and Ralphs has the option of closing it off but they intend
to leave it open and it is required that they either dose the alley or redesign the loading dock so not to interfere
with through traffic as if the alley remains open.
William Woolard, the Planning Director, said that there should be a 20' clear driveway between the alley and
the site.
Commissioner Hedlund did not think that the alley should be closed.
Staff stated that the market can presently sell alcohol 24 hours a day, however, alcohol can not be served at the
site. Both the Ralphs on Foothill and the subject store are open 24 hours.
The public hearing was opened.

Judi Lai, Lang Lampert Architects, 199 Technology, Irvine, said that they are in agreement with all of the
conditions in the staff report. She noted that they will be improving the landscaping and the driveway will be
open to the alley. They will try to improve the loading dock area.
Neal Aydelott, Ralphs, 1100 W. Artesia Blvd., Compton, said that the loading configuration will be virtually
replicated but will be designed with the latest sound deadening material to reduce noise. They would prefer
delivery hours to be 6:00 a.m. to 10:00 p.m. rather than 7:00 a.m. to 9:00 p.m., which would allow them more time to
put produce out and items on shelves, they would be content with the existing hours of delivery. The trash area
will be redesigned to be more attractive. In regard to the 24 hour sale of liquor, Mr. Aydelott commented they will
comply with all of Alcohol Beverage Control's (ABC) regulations as far as sale of liquor.
Commissioner Amato commented that he did not think that liquor could be sold after 2:00 a.m. and thought that
some markets such as AM /PM close off their liquor area after 2:00 a.m. and do not sell liquor after that time.
Mr. F.W. Smith, 11103 E. Lynrose, Arcadia, spoke against the proposal. He commented that the odor and trash
around the trash bins are unbearable and very unsightly. He noted that they have an agreement with Ralphs so
that deliveries are made from 7:00 a.m. to 6:00 p.m. and would not like to have it extended since prior to that
arrangement deliveries were being made at all hours of the night.
Glen Johnson, 11110 E. Lynrose, Arcadia, said that he would like the alley to remain open and was concerned that if
it was closed it would be utilized as a trash area. He remarked there is trash inthe walkway area at the south
east corner of the site. Ralphs will not clean it because they say it is not their property and Mr. Plount, who was
the developer of the new homes to the south, will not clean it because it is not his property and meanwhile the
neighbors are stuck with the unsightly trashr. He recommended that the trash area be enclosed. He was also
concerned about the hours of operation and urged that Ralphs comply with all the requirements and that the
Planning Department follow up to ensure compliance.
In response to some comments by Mr. Johnson staff said that exterior storage will not be permitted and that the
trash area will be enclosed.
Mr. Woolard said that condition 3 in the staff report addresses the landscaping on the site and will be subject to the
review and approval of the Planning Department.
Chairman Pro Tem Clark said that Ralphs will have to comply with all of the conditions set forth in the subject
conditional use permit.
Mike Miller, the City Attorney, stated that if Ralphs does not comply with the conditions, they will be given the
opportunity to comply and if a problem continues their business license can be revoked. Generally large
establishments such as Ralphs, take care of the problems.
In rebuttal Ms. Lai said that the trash problem is due to a lack of a trash enclosure which will be c9orrected with
the constrution of the required enclosure. She assured the Commission that Ralph's will cooperate in maintaining
the site and the landscaping . She remarked that the lighting will also be designed so it does not shine on the
neighboring properties to the south.
Mr. Woolard stated that on occasions discarded and donation items such as couches, washers and dryers have been
left on the site and suggested a minimum distance from any residentially zoned property for any recycling
activities.
Mr. Aydelott remarked that the loading and unloading area will be designed so when the trucks back up it will be
sealed to reduce noise. He remarked that the agreement that Mr. Smith mentioned with the Ralphs store Manger
is one that seems to work but he would prefer that delivery hours be extended to 6:00 a.m. to 10:00 p.m., which
would be especially helpful during the holidays which is a busy time of the year.

Staff said that the agreement between Mr. Smith and Ralphs seems to work well but may be difficult to comply
with if the warehouse is unable to deliver.
No one else spoke in favor of or in opposition to this item.
MOTION
It was moved by Commissioner Szany, seconded by Commissioner Hedlund to close the public hearing. The
motion passed by voice vote with none dissenting.
Commissioner Amato said that it is a good layout and there is plenty of parking and was in favor of the project.
Commissioner Hedlund said that the hours of operation for this market has to be compatible with other stores in
the City and it would not be right to be more stringent on this store.
Commissioner Szany was pleased with the project and thought that it would be ideal for them to deliver up to 6:00
and wondered if this would pose a problem for them during the holidays and suggested the delivery hour be
extended during those times. He said that the new trash area which will be enclosed is far superior to the existing
condition and said that the landscaping along Live Oak breaks up the building nicely.
Commissioner Hedlund expressed concern over the maintenance of the parking lot and commented that the sweeper
may be noisy and wondered if a there should be a time limit on the hours of sweeping the parking lot. The
Commission felt that the mechanical parking lot sweeping should be conducted between the hours of 7:00 a.m. to
10:00 p.m.
Chairman Pro Tem Clark said that this is a definite improvement and the Ralphs on Foothill Blvd. which abuts
residential properties to the north has been very cooperative and been good neighbors.
The following conditions were added or amended to read as follows:
2. That delivery and pick -up activities be prohibited between the hours of 9:00 p.m. to 7:00 a.m., and, that
mechanical parking lot sweeping be conducted between the hours of 7:00 a.m. to 10:00 p.m.
4. That the loading area be redesigned to accommodate clear two -way (20' wide) through traffic from the
alley.
5. That pick -up of discarded /donation items, and any other recycling activities be conducted at a minimum
distance of 50 feet from any residentially zoned property.
MOTION
It was moved by Commissioner Szany, seconded by Commissioner Hedlund to approve CUP 90-019 subject to
the conditions in the staff report with the additional conditions mentioned above.

AUDIENCE PARTICIPATION None
RESOLUTION 1456 A resolution granting CUP 90-018 for a martial arts instruction
studio at 616 E. Live Oak Avenue.
Mr. Woolard read the title of the resolutions.
MOTION
It was moved by Commissioner Szany, seconded by Commissioner Amato to adopt Resolution 1456 and to
formally affirm the decisions of December 11, 1990, reflecting the findings of the Commission and the votes
thereon.
