No. :2 1-/.2.- 0.<</~.4. 21 ORDINANCE NO. 229~ 1 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA PROVIDING A PROCEDURE FOR FIXING AND ESTABLISHING SETBACK LINES ON PRIVATE PROPERTY BORDERING ON THE WHOLE OR PART OF ANY STREET, AVENUE OR HIGHWAY; PROHIBITING THE ERECTION OF BUILDINGS, FENCES OR OTHER STRUCTURES BETWEEN SUCH SETBACK LINES AND THE LINES OF ANY SUCH STREET, AVENUE OR OTHER HIGHWAY AND PROVIDING A PENALTY FOR THE VIOLATION OF ANY OF THE PROVISIONS OF THIS ORDINANCE. 3 4 5 6 FOLLOWS: 7 THE CITY COUNCIL OF THE CITY OF ARCADIA DO ORDAIN AS SECTION 1: That setback',lines ma~ be established on 8 private property bordering on the whole or part of any street, 9 .' avenue or other highway in said City of' Arcadia as follows: Said setback lines may be established in said City of .. Arcadia upon the initiative of the City Council of said City by an Ordinance setting forth the distance from the line of any street, I be established as setback avenue or other highway to the lines to lines. SECT ION 2: Before fixing and establishing any such 22 setback lines as authorized by this Ordinance, said City Council shall pass a Resolution of Intention to do so, referring to the 'I Street, Avenue or other highway by its lawful or off~al name, or, I the name by which it 1s commonly known. Said Re~olution of In- tention shall briefly describe such proposed set9fck lines and shall contain also a notice of the day, hour and place'when and '--, where any and all persons having any objectio~ to fixing and estatf lishing such setback lines may appear before said City Council and' show cause why said proposed setback lines should not be fixed and established in accordance with said Resolution; said time shall be not less than ten nor more than twenty-five days from the date of 23 24 25 26 27 the passage of said Resolution. The City Clerk shall cause said , 28 Resolution to be published once in any Newspaper published and 29 circulated in said City of Arcadia. In every case all posting must be fully completed at least five days before the day set for hearing protests or objec- tions, as hereinabove provided. Said notices shall be headed "Notice of Setback Lines" in letters of not less than one inch in length, and shall, in legible characters, state the fact of the passage of the Resolution of Intention, its date, and a brief des-i , cription of said setback lines so proposed to be fixed and estab- ! lished and refer to the Resolution of Intention for further parti~: cular s . I I I I I I I I At any time not later than the hour set fori i hearing objections to said proposed setback lines, as hereinabove Said notice shall contain also a statement of the day, hour and place when and where any and all persons hav~ng any ob- jections to said proposed setback lines may appear before said Oity Oouncil and show cause why such setback lines should not be fixed and established in accordance with said Resolution. SEOTION 4: provided, any owner of property affected by such proposed setback lines may make written protest against same. Such protest must be in writing, and be delivered to the said Olerk of the Oity Oouncil and no other protests or objections shall be considered. At the time set for hearing protests, the Oity Oouncil shall proceed to hear and pass upon all protests so made, and its decision shall be final and conclusive. The Building Inspector and Police Department or any other Department of the City shall refuse any permit for the con- struction of any of the above men~ioned obstructions or structures and shall have the power to forthwith remove the same in case they have been constructed without such a permit. SECTION 7: That any person, firm or corporation vio- lating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be pun- ishable by a fine not exceeding $300.00 or by imprisonment in the City Jail of said City of Arcadia or in the County Jail of the County of Los Angeles, State of California, at the discretion of the Committing Magistrate, for a period not exceeding three months or by both such fine and imprisonment.
