HomeMy WebLinkAbout1981 ORDINANCE NO. 1981 AN ORDINANCE OF THE CITY OF ARCADIA APPROVING ZONE CHANGE Z-92-002, REZONING AN 8.2 ACRE PORTION OF SANTA ANITA RACE TRACK PARCEL NO. 949 AT 385 WEST HUNTINGTON DRIVE FROM R-1 (SINGLE-FAMILY) AND 5-1 (SPECIAL USE) TO C-2D (GENERAL COMMERCIAL WITH A DESIGN OVERLAY). WHEREAS, zone change Z-92-002 was filed by The Hahn Company and Santa Anita Reality Enterprises, Inc., to rezone an 8.2 acre portion of Santa Anita Race Track Parcel No. 949 at 385 West Huntington Drive from R-1 (Single-Family) and S- 1 (Special Use) to C-2D (General Commercial with a Design Overlay). WHEREAS, a public hearing was held on October 27, 1992, before the Planning Commission, at which time all interested persons were given full opportunity to be heard, and to present evidence, and WHEREAS, the Planning Commission of the City of Arcadia recommended approval of the subject zone change to the City Council, and WHEREAS, the City Council conducted a public hearing concerning the zone change on November 17, 1992 and approved said zone change. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the subject property, as described in the attached "Legal Description Race Track Parcel", is hereby reclassified into zone C-2D (General Commercial with a Design Overlay) and from and after the effective date of this ordinance, said real property shall be so zoned subject to the restrictions imposed by the provisions of the zoning regulations of said City. The Map contained in Section 9233.9 of the Arcadia Municipal Code is hereby amended to reclassify and designate the described property as a district in Zone C-2D. Section 2. The City Council finds and determines that: (1) The applicants are proposing to expand and renovate the existing Santa Anita Fashion Park Mall at 400 South Baldwin Avenue; (2) the requested rezoning of the subject property would allow the use of a portion of the existing race track parking lot for expanded mall parking; (3) based on the "Initial Study for the Santa Anita Fashion Park Mall Expansion, September 1992", approximately 1,629 parking spaces will be deleted 1 1981 from the race track parking lot due to the mall's acquisition of the 8.2 acre parcel; however, this reduction in parking will not reduce parking supplies at Santa Anita Race Track to levels below demand; (4) the requested zone change is consistent with the existing and proposed development of the site, and conforms to the General Plan Designation for the mall, which is "Commercial"; and (5) the public health, safety, general welfare and good zoning practice requires that the above amendment be subject to the following conditions of approval: 1. Conditions as outlined in the attached report from the Department of Public Works (Exhibit "A") shall be complied with to the satisfaction of the Director of Public Works. 2. Conditions as outlined in the attached report from the Water Department (Exhibit "B") shall be complied with to the satisfaction of the Water Manager. 3. Conditions as outlined in the attached report from the Arcadia Fire Department (Exhibit "C") shall be complied with to their satisfaction. 4. That the applicant has agreed to carryout the mitigation measures identified in Exhibit "0" as conditions of approval, and subject to the review and approval of the Planning Department. 5. That the applicant shall pay all costs for the required mitigation monitoring. Such costs shall not exceed the actual costs incurred by the City for its monitoring responsibilities. Section 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of said City within fifteen (15) days after its adoption. Developer shall pay the cost of all necessary off-site improvements in the Public right-of-way including but not limited to roadway improvements, sidewalk ramps for the handicapped, traffic signal modifications, street lighting, and landscaping. 2. The developer shall pay all costs associated with off- site improvements plan check review , inspection of public improvements, and related administrative costs. 3. The potential reconstruction of the Gate 8 entrance drive at Baldwin Avenue will require right of way dedication at the southeast corner to facilitate roadway widening. 4. The proposed expansion of the mall will impact the present traffic circulation. A traffic impact analysis has been prepared by Barton-Aschman Associates (March 1992) which identifies the traffic impact generated by the proposed expansion and mitigations therefor. 5. Sewage/wastewater originating from the mall discharges into a private sewer for conveyance into a County Sanitation District (CSD) trunk sewer located in Campus Drive. The existing sewer lines have the capacity to transport sewage flows generated in accordance with land use reflected in the city's current general plan to CSD's system. Correspondence from the Sanitation District to city of Arcadia Redevelopment Agency (March 24, 1992) states that a connection fee 'oIill be charged to the development for increasing the quantity of wastewater generated by an existing facility. Payment of connection fees by the developer must be coordinated with the County Sanitation District. 6. Any changes in the existing grading and drainage as a result of the proposed expansion will require a grading and drainage plan prepared by a Registered civil Engineer for the City's approval. We have made our desires known to them. The following are a few highlights of those meetings. 1. Provide adequate fire hydrants around all structures. 2. Locate fire department connection in a central point. 3. Provide egress during all construction modes. 4. Provide access for emergency operations during all phases of construction. 5. Maintain all fire sprinkler systems at all times. EXHIBIT "c" 1981 EXHIBIT "0" This exhibit represents an amendment to the applications for the requested text amendment (T A 92-005), zone change (Z 92-002) and public parking lease agreement which have been filed with the City of Arcadia, for the proposed expansion of the Santa Anita Fashion Park shopping center. The mitigation measures in this exhibit have been derived from the Initial Study which has been prepared for the City of Arcadia by the City's environmental consultant, The Planning Center. The City has employed, directed and reviewed the work of the City's consultant in compliance with the California Environmental Quality Act (CEQA). The mitigation measures, which are in reference to the attached Environmental Check List, are as follows: Earth., (b and g) - Mitigation Measures: 1. A site specific geotechnical report shall be prepared by a certified geologist or geotechnical engineer which: 1) reviews recent geologic literature for the area, since the technical report for the Safety Element is dated 1975 and new information about the Raymond Hill and other faults with potential to impact. the site may now be available, 2) confirms whether sufficient site specific set- backs have been made for the portion of the site within the Alquist-Priolo Special Studies Zone and to confirm that no structures would be subject to significant surface fault rupture hazards, 3) identifies site-specific seismic parameters for the site, which the new and renovated structures should be capable of of withstanding (note: not the existing buildings). 2. A site specific probablistic dynamic analysis shall be prepared by a certified structural engineer to verify the building design. The design analysis shall be based on a site specific geotechnical report and is intended to identify additional remediation, if any are needed, that would be required beyond the UBC code requirements to reduce ground shaking hazards to the project to a level of insignificance. Air., (a) - Mitigation Measures: 1. The demolition and remodeling activity shall comply with South Coast Air Quality Management District (SCAQMD) Rule 1403 Asbestos Emissions from Renovation/Demolition Activities to reduce asbestos emissions and protect sensitive receptors in proximity to the site. 2. Graded surfaces shall be watered at least twice daily to form a wind-resistant temporary crust. The program should include control of wind-blown dust on site access roadways and in the existing paved parking areas of the mall. 3. The site and the construction equipment shall be sprayed with water in the morning and the evening. 1 1981 4. Ground cover shall be planted as soon as practical in the construction process. 5. Any earth being transported shall be covered and the wheels and lower portions of transport trucks will be sprayed with water before they leave the construction area. This includes trucks moving excavated earth from one portion of the site to the other if fugitive dust is visible from the transporting activity. 6. Construction equipment shall be selected considering emission factors and energy efficiency. All equipment shall be properly tuned and maintained. 7. Electric or diesel-powered equipment shall be utilized in lieu of gasoline- powered engines where feasible. 8. Construction activities shall minimize obstruction of through traffic lanes adjacent to the site and, if necessary, a flag-person shall be retained to maintain safety adjacent to existing roadways. Recommended Mitigation Measures: 9. Construction operations shall be phased to limit large equipment operations during the smog season from May through October. 10. Ride sharing for the construction crew shall be supported and encouraged. Long-term Mitigation Strategies: 11. Energy Use a. The parking lot design should allow for the future installation of dedicated parking spaces with electrical outlets for electrical vehicles. b.. Use light colored roof materials to reflect heat. c. Use building materials that do not require use of paints and solvents such as pre-primed and a wood molding and trim products and pre-primed wallboard. d. Require recycling bins in addition to trash bins and contract for recycling services. e. Increase walls and attic insulation beyond Title 24 requirements for new construction projects. f. Provide shade trees consistent with design review process to reduce building heat. 2 1981 g. Use energy efficient and automated controls for air conditioners. h. Use energy efficient parking lot lights (such as metal halide, clean lucalox, high pressure sodium, low pressure sodium, or other energy efficient parking lot lights) consistent with design review process. 1. Use lighting controls and energy efficient lighting. j. Low-polluting and high-efficiency appliances shall be installed wherever possible. 12. Congestion Relief a. Require on-site truck loading zones. b. Reschedule truck deliveries and pickups for off-peak hours. 13. Work/Non-Work Trips a. Enhance bus stops on-site with seating areas and covered shelters to further encourage transit use. Where reasonable, bus stops should allow passengers to wait inside air conditioned stores with a line of sight to see arriving buses. b. Provide preferential parking spaces for carpools and vanpools. c. Utilize a mix of services on-site to provide further amenities for employees and customers that would reduce off-site vehicle trips. Consideration shall be given to extend postal services beyond the Christmas season, medical office facilities, auto repair and additional ridesharing information at the existing transit information desk. Water., (b and e) - Mitigation Measures: National Pollutant Discharge Elimination System (NPDES) Permit to be obtained and adhered to in order to prevent significant short term construction impacts to water quality. Plant Life - Mitigation Measures: The developer shall submit a new landscape plan prepared by a registered landscaped architect and in accordance with the requirements identified in Resolution No. 4185. Animal Life - Mitigation Measures: 3 1981 No mitigation measures are required. Noise., (a) - Mitigation Measures: No mitigation measures are required. Light and Glare - Mitigation Measures: No mitigation measures are required. land Use - Mitigation Measures: Implementation of the proposed zone change is required to eliminate conflicts between the proposed land uses and existing zoning. Natural Resources., (a) -. Mitigation Measures: No additional review is necessary and no mitigation measures are necessary. Risk Off Upset., (a) - Mitigation Measures: No additional review is necessary and no mitigation measures are necessary. Population --Mitigation Measures: No additional analysis is necessary and no mitigation measures are necessary. Housing - Mitigation Measures: No additional analysis is necessary and no mitigation measUres are necessary. Transportation/Circulation., (a,b,c,d and f) - Mitigation Measures: Construction Mitigation: 1. Truck traffic to and from the project site shall use the Baldwin Avenue truck route traveling to the 210 Freeway. With prior City approval and at times selected to avoid traffic impacts exceptions may be made to this mitigation measure. 2. Pre- and post-construction surveys of the condition of Baldwin Avenue shall be made jointly by the developer and the City Engineer to determine the extent of construction related accelerated wear on Baldwin Avenue (or if other routes are later approved by the City, then also on those routes). If there is damage attributable to construction traffic, the damage shall be repaired by the developer to the satisfaction of the City Engineer. 4 1981 3. The intersection at Baldwin Avenue and Gate 8 warrants southbound dual left-turn lanes. A second left-turn lane can be provided on the southbound approach by striping the inside through lane and using the parking lane as a travel lane for the second southbound through lane (see Figure 17., of the Initial Study). Beyond Gate 8, for a distance of 350 feet, up the first residential street, a departure transition should be striped to retain parking in front of the residential developments. There are two alternatives to managing traffic operations at Gate 8 during the PM peak hour, given the provision of permanent dual left-turn lanes (see Figure 17., of the Initial Study). One of the two following alternative mitigation measures shall be adopted. 3A. Construction Alternative: The outbound lanes at Gate 8 can be restriped for three outbound lanes and then provide two (2) permanent inbound lanes. This requires widening of the south side of the driveway for the full width of one lane (11-12 feet) to provide the second entry lane. 3B. Traffic Management Alternative: This alternative does not require construction. The outbound lanes are increased from two (2) to three (3) during the track season PM hour with the use of barricades as is done today. Since the inbound lanes will be reduced to a single lane, the dual left-turn lane must be reduced as well. It will be necessary to barricade or cone (close off) the inside left-turn pocket at the same time as the exit lanes are increased at Gate 8. Figure 17., in the Initial Study, details the recommended improvements and alternatives. 4. Huntington Drive and Driveway "E" at La Cadena - A shared left, left-right turn lane configuration is warranted on this approach. This dual left-turn requires widening of the Huntington Drive cut which is designed for a single lane. In addition to the foregoing, signal phasing should be adjusted to protect northbound movements approaching from La Cadena to prevent conflicts. A schematic of these intersection improvements is provided on Figure 18., of the Initial Study. Public SelVices., (a,b,e and f) - Mitigation Measures: No additional analysis is necessary and no mitigation measures are necessary. Energy - Mitigation Measures: No additional analysis is necessary and no mitigation measures are necessary. Utilities - Mitigation Measures: No additional analysis is necessary and no mitigation measures are necessary. Human Health., (a and b) - Mitigation Measures: 5 1981 1. The demolition and remodeling activity shall comply with SCAQMD Rule 1403 Asbestos Emissions from Renovation/Demolition Activities. 2. All fluorescent light ballasts located in all of the areas that are to be demolished shall be inspected to determine whether the serial number contains a - W suffix. All ballasts that do not contain a - W suffix shall be assumed to contain PCBs and shall therefore be handled as hazardous waste for proper disposal in accordance with all applicable government regulations, unless appropriate testing demonstrates the absence of PCBs. 3. Unless appropriate testing demonstrates otherwise, paint flakes, fragments, or dust generated in demolishing areas shall be assumed to contain hazardous levels of lead and shall be handled as hazardous waste, so as to avoid human contact. Aesthetics - Mitigation Measures: Additional aesthetic impacts analysis would occur as part of the Architectural Design Review and no mitigation measures are necessary. Recreation - Mitigation Measures: No additional analysis is necessary and no mitigation measures are necessary. Cultural Resources .- Mitigation Measures: The initial stages of grading and excavation for the proposed projects should be monitored by a qualified archaeologist who is prepared to recover and document any significant historic material that appears. This may require some delay or redirection of grading and/or excavation.
