' MUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Tuesday, November 10, 1992 The Planning Commission of the City of Arcadia met in regular session on Tuesday, November 10 , 1992, at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Tom Clark presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Amato, Daggett, Hedlund, Clark ABSENT: Commissioner Huang MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to excuse Commissioner Huang from tonight's meeting. The motion passed by voice vote with none dissenting. MINUTES MOTION It was moved by Commissioner Amato, seconded by Commissioner Hedlund to approve the Minutes of October 27, 1992 as published. The motion passed by voice vote with none dissenting. OTHERS ATTENDING: City Attorney Michael Miller Planning Director William Woolard Assistant Planning Director Donna Butler Assistant Planner James Kasama Assistant Planner William Stokes Secretary Silva Vergel CONTINUED PUBLIC HEARING CUP 90 -019 Consideration of a revision to the proposed new supermarket 16 E. Live Oak that was approved under CUP 90-019 to allow the alley Lang Lampert Architects for access to be closed by a chain -link fence whenever the Ralphs Grocery Co. loading dock is being used. The staff report was presented. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to re -open the public hearing. The motion passed by voice vote with none dissenting. The public hearing was opened. Allan Potterman, attorney representing Ralphs, stated that they had a meeting with City and they will be able to maintain access to the alley by redesigning the loading area. The minimum access will be 15' clear. George Meeker, 1025 Singingwood, representing his father, owner of the adjacent properties to the east, was in favor of the revised plan. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Amato, seconded by Commissioner Hedlund to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Amato was in favor of the revised plans. Chairman Clark thought that it is a nice compromise. It will definitely improve the existing situation and it will keep the alley open. Ms. Butler recommended that the Commissioner's motion for approval should include the amendment of condition 4 to read in part that the "loading area be design to accommodate an access of 15' for thru traffic." MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to approve the revision to CUP 90-019 subject to the conditions in the staff report with the above mentioned amendment. ROLL CALL: AYES: Commissioners Amato, Daggett, Hedlund, Clark NOES: None ABSENT: Commissioner Huang Chairman Clark noted that there is a five working day appeal period after the adoption of the resolution. PUBLIC HEARING MP 92 -006 2410 S. Baldwin Ave. John Salter Consideration of modifications for setback requirements for a second -story addition. The staff report was presented and the public hearing was opened. John Salter, 2410 S. Baldwin, said that this expansion is needed due to an expanding family. Since Baldwin Ave. is very busy, the front of their house is not utilized very much. They are not requesting an increase of the setbacks, they are just asking to build to the existing setbacks. The addition is designed such that the view affected would be minimal. The patio will help screen the view of the neighbors to the north and east and will give them additional privacy. The addition will be an improvement to the existing situation. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Amato, seconded by Commissioner Hedlund to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Daggett said that he was not in favor of granting modifications that infringe on setbacks. Arcadia City Planning Commission 11/10/92 Page 2 Both Commissioners Amato and Hedlund agreed. Chairman Clark said that a great deal of time and effort was spent in establishing the present Codes. He did not think that the request should be granted. MOTION It was moved by Commissioner Daggett, seconded by Commissioner Hedlund to deny MP 92 -006. ROLL CALL: AYES: Commissioners Amato, Daggett, Hedlund, Clark NOES: None ABSENT: Commissioner Huang Chairman Clark noted that there is a five working day appeal period after the adoption of the resolution. There was a 5 minute recess. Mike Miller, stated that the Commission should open the public hearing for the next two items. Staff is recommending that the public hearings be continued to the Commission's March 9th meeting. The reason for the continuance is to allow the City to meet with Mr. Lawson Martin, who is the only property owner in the subject zone change area whose property will be impacted. The City has had moratoriums in place for hillside development and now it is reaching the end of the allowable time for moratoriums. He explained that by meeting with staff and continuing the hearing, the City and Mr. Martin will be able to come up with a development that will possibly satisfy both parties. The City and Mr. Martin will have to enter into an agreement which will have to be approved by the City Council. This agreement will be presented to the Council at their next meeting. PUBLIC HEARING TA 92 -006 AND PUBLIC HEARING Z 92 -003 The staff report was presented. Consideration of a text amendment to the Arcadia Municipal Code to establish a R -H (Residential Hillside Single Family) zone designation and regulations. Consideration of a zone change to rezone the following areas to the R -H (Residential Hillside Single Family) zone: A. The R -M Sr D (Residential Mountainous Single Family and Architectural Design) zoned hillside area north and west of Canyon Rd. (not including Wilderness Park) and B . The R -1 & D 10,000 (Second One - Family 10,000 sq. ft.) zoned hillside area west of Santa Anita Canyon Rd. Arcadia City Planning Commission 11/10/92 Page 3 MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to open the public hearing. The motion passed by voice vote with none dissenting. The public hearing was opened. Mark Steres, 300 S. Grand Ave., #1500, Los Angeles, representing Mr. Martin said that they are in agreement with the continuance to allow his client and the City to enter into an agreement regarding the development of the subject property. They were never aware of the moratorium, since it was only published in the paper. They were made aware of the proposed changes when they received a notice. In his opinion, since there is only one property owner involved that will be affected by the new ordinance, a continuance of the public hearing is a reasonable request. However, if there were several property owners then the continuance would not be a good idea. They are willing to work with staff to come up with a plan that will be acceptable to both parties. Carl Sigalos, 2226 Canyon Rd., said that he is speaking on behalf of several of his neighbors who were unable to attend. They are owners of property across from the proposed zone change and they are concerned about what would be permitted and the affect on their properties. In response to a question, Mr. Woolard said that there are presently no applications pending, nor has anything been submitted to the City. The City was not trying to stop a project, rather just looking at the regulations, especially with the experience gained by the two phases of the Bluth project and with what has happened in the adjacent communities. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Daggett, seconded by Commissioner Amato to continue the public hearings for TA 92 -006 and Z- 92 -003, to the Commission's March 9, 1993 meeting subject to the City entering into an agreement with Lawson Martin.
