MINUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Tuesday, September 8, 1992 The Planning Commission of the City of Arcadia met in regular session on Tuesday, September 8, 1992, at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Tom Clark presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Amato, Daggett, Hedlund, Huang, Clark ABSENT: None MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to read all resolutions by title only and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting. MINUTES MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to approve the Minutes of August 25, 1992 as published. The motion passed by voice vote with none dissenting. OTHERS ATTENDING: Councilman Bob Margett City Attorney Michael Miller Assistant Planning Director Donna Butler PUBLIC HEARING CUP 92-009 50 W. Las Tunas Dr. Jin Man Kim Consideration of a conditional use permit to provide seating and tables for 12 persons in a retail fish market. The staff report was presented. In response to Commission's questions, staff explained that in reviewing the minutes of the meeting which approved the expansion of Burger Palace, there was no mention of that request being the last one to be approved by the Commission for seating. Although the donut shop was approved with seating for 12, they do not have seating for the number which was indicated and their use is primarily in the morning. The pizza shop is predominantly take -out and has 2 small tables. The above uses are significantly different than the Burger Palace. The Burger Palace does generate the most traffic on the premises. The public hearing was opened. Jin Kim, 50 W. Las Tunas, the applicant was present and was in agreement with all of the conditions in the staff report. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Hedlund remarked that this will not impact the residential properties. Staff noted that she visited the site on three different occasions and the parking is insignificant. There is a lot of on- street parking both on Las Tunas and on Live Oak. She did not foresee any problems with this use in the center. Commissioner Amato thought this would be a good use and Commissioners Huang and Daggett agreed. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to approve CUP 92 -009 subject to the conditions in the staff report. ROLL CALL: AYES: Commissioners Amato, Daggett, Hedlund, Huang, Clark NOES: None Chairman Clark noted that there is a five working day appeal period after the adoption of the resolution. AUDIENCE PARTICIPATION None RESOLUTION 1487 A resolution approving a revision to CUP 90-019 to add 4,206 sq. ft. to the storage and equipment mezzanine of the new supermarket at 16 E. Live Oak Ave. RESOLUTION 1488 A resolution granting CUP 92-008 for a coffee bar with seating for 30 persons at 107 S. First Ave. Ms. Butler read the titles of the resolutions. MOTION It was moved by Commissioner Amato, seconded by Commissioner Huang to adopt Resolutions 1487 and 1488 and to formally affirm the decisions of August 25, 1992 and the votes thereon. Arcadia City Planning Commission 9/8/92 Page 2 MATTERS FROM COUNCIL Councilman Margett said that the new City Manager was officially installed at the last Council meeting. He does have creative ideas which the Commission should see implemented soon. For example, he has suggested meeting earlier for study sessions so that there is enough time to discuss matters, possibly having a study session with fewer items on the agenda or with only one item for discussion. He feels that by doing that, he would be able to better implement Council's requests in regard to the September 29th meeting. He asked that the Commission submit all items for discussion to Donna, so an agenda can be prepared and thought that it would be a productive meeting. MATTERS FROM COMMISSION Commissioner Amato welcomed the new City Manager and said that he and his wife would like to host a coffee party for him on September 24th and invited the Commissioners. Mr. Miller said that Commissioner Amato's invitation is a social occasion and as long as no formal business is discussed and action taken, it would be deemed a social occasion and those are exempted from the Brown Act. Discussion ensued regarding the Brown Act and under what circumstances the City would be liable. MATTERS FROM STAFF Mr. Miller said that there is a city wide election next week involving the school bond issue and the charter revisions. Most of the revisions are housekeeping items that the Council unanimously recommends. The only one that will affect the Commission is the requirement on voting. If the charter revisions are approved, then for all boards and commissions, a majority of the quorum will suffice to take action. You don't have to have the majority of the entire membership. When there are only three commissioners, then two votes would be enough to take action. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to adjourn to Wednesday, September 23, 1992. The motion passed by voice vote with no one dissenting.
