MINUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Monday, April 13, 1992 The Planning Commission of the City of Arcadia met in regular session on Monday, April 13, 1992, at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman ProTem Harold Hedlund presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Amato, Daggett, Hedlund ABSENT: Commissioner Clark MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to excuse Commissioner Clark from tonight's meeting. The motion passed by voice vote with none dissenting. MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to read all resolutions by title only and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting. MINUTES MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to approve the Minutes of March 24, 1992 as published. The motion passed by voice vote with none dissenting. OTHERS ATTENDING: City Attorney Michael Miller Planning Director William Woolard Assistant Planner James Kasama Assistant Planner William Stokes Secretary Silva Vergel The City Attorney announced that the City Charter requires that for any action to be adopted or approved a majority of the entire membership must vote in favor of the particular motion. If the required three votes are not obtained the motion would fail. If the required three votes are not obtained (1) an applicant may request continuance and it is up to the Commission to decide whether or not they want to grant it; (2) the matter could be heard and then deferred for final decision pending participation of the absent members as long as they review the records of these proceedings which would be made available to them or (3) the matter could simply go forward to the City Council. PUBLIC HEARING MP 92 -002 315 -321 Diamond Mur -Sol, Inc. Consideration of modifications for a proposed 6 -unit condominium project. The staff report was presented. In response to a question from Commissioner Daggett, Mr. Richard Ruiz, a representative of Mur -Sol, Inc., stated that the encroachment in question is a pop out window. The public hearing was opened. Richard Ruiz, 132 La Porte, representing Mur -Sol, Inc. stated that the pop out window will be above the sink and is an architectural feature and is not considered as living space. He said that they are in agreement with all of the conditions in the staff report. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to close the public hearing. The motion passed by voice vote with none dissenting. Staff noted that a letter in opposition to the request was received by Mr. Kist. Commissioner Amato could not see any reasons to deny the request. MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to approve MP 92 -002 subject to the conditions in the staff report. PUBLIC HEARING TM 51245 1034 -1046 Arcadia Ave. Laural Erpenbeck Consideration of a tentative map for a proposed 17 -unit condominium project. The staff report was presented and the public hearing was opened. Laural Erpenbeck, 139 Orange Grove, stated that this will be a very attractive project and said that she is in agreement with all of the conditions in the staff report. Harold Caras, 1123 Sunset, spoke at length with regard to the high vacancy rate in the area, the graffiti. He asked how close would the buildings be to the street and feared accidents due to poor visibility. Increasing the density would make the problem worse. He was concerned with the drought and the increase in water usage. Arcadia City Planning Commission 4/13/92 Page 2 Chairman ProTem Hedlund noted that the project was approved in December. He explained that the tentative map procedure allows the property owner to subdivide and sell as condominiums vs. apartments. He indicated that the project complies with the zoning code. Mr. Miller, the City Attorney, said that the graffiti problem should be reported to the Code Enforcement Office. He stated that this is a land use issue and approving the tentative map will allow the property owner to subdivide and sell the units as condominiums. Mr. Woolard indicated that the project has already been approved and the property owner may build the units. By going through the tentative map procedure, however, the property owner has chosen to sell each unit as a condominium rather than apartments. Staff indicated that the building setback on Arcadia Avenue would be 30' to the property line or 40' the the face of the curb and on Sunset Blvd. a 25' setback to the property line or 30' to the face of the curb. The setbacks are the same as the existing homes on the property. The landscaping will be designed to comply with visibility requirements. Katherine Ho 1st, 1122 Sunset, wondered what would happen to all the mature and beautiful trees on the site? Where will all the residents and their guests park? She felt that there is already too much traffic on Sunset Blvd. and the extra cars will make the situation worse. Mr. Miller said that the project complies with the zoning standards and is consistent with what is permissible in this area. In rebuttal, Ms. Erpenbeck stated that felt that her architect did a beautiful job with the design of the project and indicated that the project offers lots of open space and plenty of parking space. They will try to preserve as many trees as possible. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to close the public hearing. The motion passed by voice vote with none dissenting. MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to approve TM 51245 subject to the conditions in the staff report. PUBLIC HEARING TA 92 -004 The staff report was presented. Consideration of a text amendment to the Arcadia Municipal Code requiring a conditional use permit and establishing criteria for Indoor Swap Meets. Arcadia City Planning Commission 4/13/92 Page 3 Chairman ProTem Hedlund opened the public hearing and asked if anybody in the audience would like to speak in favor or opposition to this item. MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to continue the public hearing to the Commission's May 12th meeting to allow for further study. ROLL CALL: AYES: Commissioners Amato, Daggett, Hedlund NOES: None ABSENT: Commissioner Clark AUDIENCE PARTICIPATION None RESOLUTION 1484 Mr. Woolard read the title of the resolution. MOTION A resolution granting CUP 92 -004, for the addition of a storage room to the existing restaurant at 116 E. Live Oak Avenue. It was moved by Commissioner Amato, seconded by Commissioner Daggett to adopt Resolution 1484 and to formally affirm the decision of March 24, 1992 and the votes thereon.
