MINUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Tuesday, March 24, 1992 The Planning Commission of the City of Arcadia met in regular session on Tuesday, March 24, 1992 at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Tom Clark presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Amato, Daggett, Hedlund, Szany, Clark ABSENT: None MINUTES It was moved by Commissioner Amato, seconded by Commissioner Daggett to approve the Minutes of February 25, 1992. The motion passed by voice vote with none dissenting. Live Oak Ave. Ben Cazares, Contractor on behalf of Ray Harrell, Owner Consideration of a conditional use permit to add a storage room to the existing Steerburger Restaurant. The staff report was presented. Staff explained that all the conditions will have to be complied with prior to final inspection. In response to a question from the Commission, staff said that the reason some of the conditions were not met in the old CUP were because, they were given five years to comply with the conditions and there was not a follow up. Staff said that is one of the reasons they no longer recommend five years for compliance because 5 years is much too long for compliance. However, upon informing the applicant of things that had to be brought into compliance, they were quick to respond. Staff indicated that Code requires that the satellite dish be placed within the middle 1/3 of the building, however, they will not be required to move the existing dishes, but they will need to obtain the necessary building permits. Staff circulated photos of the site including the trash enclosure area. The public hearing was opened. Arcadia City Planning Commission 3/24/92 Page 1 Ben Cazares, 1681 Soleno, Ontario, the contractor of the project stated that they are in agreement with all of the conditions in the staff report, with the exception of condition 6, pertaining to a new grease enclosure adjacent to the trash receptacle area. He indicated that if the trash bin would be placed sideways, the existing area would be large enough to accommodate both the trash and the grease receptacles. Staff was agreeable with that as long as the gate could be closed. Commissioner Hedlund remarked that he drove by the site, and noticed that the trash bin was protruding approximately 1' from the trash enclosure area. In response to the Commission's concerns, Mr. Cazares assured the Commission that they would be able to close the gates if the bin would be placed sideways. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Amato was in favor of the request as long as all the conditions would be complied with. Chairman Clark noted that they have complied with staffs requests. Commissioner Hedlund remarked that they have gone a long way by improving the parking and providing planters. It was the consensus of the Commission that condition 6 should be changed to read as follows: "That the trash enclosure shall accommodate both the grease receptacle and the trash bin and be enclosed by a metal gate." MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to approve CUP 92 -004 subject to the conditions in the staff report with the above mentioned condition. ROLL CALL AYES: Commissioners Amato, Daggett, Hedlund, Szany, Clark NOES: None Chairman Clark remarked that there is a five working day appeal period after the adoption of the resolution. PUBLIC HEARING MC 92 -008 1123 S. Golden West Ave. Mr. Kin Wan Ng, applicant S & M Associates (Mitrovich, Samarzich & Miller), appellant Consideration of an appeal of a conditional approval of modifications for an addition to a legal nonconforming residence in an R -3 zone. Arcadia City Planning Commission 3/24/92 Page 2 The staff report was presented. Staff said that a letter was received by Mr. Greer, adjacent property owner, who indicated that he was against the appeal and was in favor of the requested modifications for the proposed addition. The public hearing was opened. Paul Miller, 321 Leda Lane, felt that they should comply with the side yard setback requirements. He said that the existing house has wood windows and siding and he said that they were told that the addition would have aluminum windows and it would be stucco. He stated that if they build, then the addition should be consistent with the existing house and it should contribute to the character of the area. He was concerned that the proposed materials do not match the existing material. He could not understand why they are requesting a 397 sq. ft. of additional square footage from what they are permitted on a 50 year old house. He said that he anticipated that he will be developing his property with approximately 14 units and felt that this property will reduce property values in the neighborhood. He remarked that the proposed addition will allow for multiple families to live on this property. He said that the proposal is appropriate in the R -1 zone not in the R -3. He realizes that it is difficult to develop this property unless it is combined with another lot, but they have a right to see that the addition is done properly and in good taste. In response to a question from the Commission, Mr. Miller stated that the appellants would feel better if this was approved with the condition that the material for the new structure matches the existing house and not the other way around. Olga Mitrovich, 233 Longley Way, spoke in favor of the appeal and reiterated that this is a single - family development in a multiple - family zone and it will not fit and it would be out of the character for the area. She said that if this is approved, it should be limited to a 500 sq. ft. addition. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Chairman Clark did not think that the 397 sq. ft. addition over the allowed 500 sq. ft. is major. Commissioner Szany agreed and said that the material used in the addition should match the existing house and it should follow through with the same character. The submitted plans are very ambiguous and do not specify what type of materials are proposed. Commissioners Amato and Daggett agreed. Commissioner Hedlund thought that a single - family house was approved recently within the area. He also thought that the material should match the existing house. The Commission felt that the appeal should be denied and the modification approved subject to the following conditions: 1. That the exterior materials and finish of the addition be consistent throughout and match those of the existing house. 2. That the southwest corner of the proposed addition be redesigned with a 5' -6" x 5' -6" cutoff to better facilitate access to the garage. Arcadia City Planning Commission 3/24/92 Page 3 MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to deny the appeal of MC 92 -008 and modify the Modification Committee's approval subject to the conditions stated above. AUDIENCE PARTICIPATION None MATTERS FROM COUNCIL None MATTERS FROM COMMISSION The Commission wished Commissioner Szany good luck and Commissioner Szany thanked the Commission and staff and said that he probably would see the Commission on occasions. MATTERS FROM STAFF Mr. Woolard summarized a memorandum by staff and said that the City Council would like to reiterate to the Planning Commission that the Council wants to encourage single lot developments in the R -3 zone with three units, because it is a more desirable development than the paired lot projects with eight units.
