ORDINANCE NO. 1995
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, AMENDING VARIOUS SECTIONS OF
CHAPTER 2, ARTICLE IX REGARDING STORAGE AND AMENDING
CHAPTER 1 OF ARTICLE V TO INCLUDE REGULATIONS FOR THE
COLLECTION AND LOADING OF RECYCLABLES IN THE
COMMERCIAL, INDUSTRIAL, MULTIPLE FAMILY, SPECIAL USE
AND PUBLIC USE ZONES.
WHEREAS, a text amendment was initiated by the City of Arcadia for the
consideration of adding regulations for the collection and loading of recyclables in
accordance with the California Solid Waste Reuse and Recycling Access Act of 1991,
and
WHEREAS, said new regulations were proposed to be incorporated into the
storage regulations, it was also proposed that the storage regulations be reviewed and
updated, and
WHEREAS, a public hearing was held on July 27, 1993, before the Planning
Commission of the City of Arcadia, at which time all interested persons were given
full opporhmity to be heard and to present evidence, and
WHEREAS, the Planning Commission recommended to the City Council
approval of the text amendment, and
WHEREAS, the City Council held a public hearing concerning the text
amendment on August 3, 1993 and approved the text amendment, and
WHEREAS, the City Council found that this text amendment will not have a
significant effect on the environment, and that there is no evidence that the text
amendment will have any potential for adverse effect on wildlife resources.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. That Section 9260.2.8 of the Arcadia Municipal Code be repealed.
SECTION 2. That Sections 9260.2.7, 9261.6.6, 9262.6.8, 9263.6.5, 9265.6.5, 9266.2.7
and 9268.6.9 of the Arcadia Municipal Code be amended to read as follows:
9260.2.7,9261.6.6,9262.6.8,9263.6.5,9265.6.5, 9266.2.7, 9268.6.9 STORAGE.
All permanent and temporary storage of wares, merchandise, equipment,
storage containers and similar items shall be within a building. The use of

temporary storage bins, sheds, shipping containers, semitrailers and trailers and/or
temporary buildings is not permitted. In accordance with the California Solid Waste
Reuse and Recycling Access Act of 1991, an area shall be provided for the collection
and loading of recyclables. Trash, garbage, refuse and recyclables may be temporarily
stored outside a building provided such materials are stored in accordance with the
provisions of this Title.
SECTION 3. That Sections 9261.6.7,9262.6.9,9263.6.6,9265.6.6, and 9268.6.10 of
the Arcadia Municipal Code be amended to read as follows:
9261.6.7,9262.6.9,9263.6.6,9265.6.6,9268.6.10 STORAGE. OUTSIDE. TRASH,
GARBAGE AND REFUSE.
Trash, garbage and refuse that are to be temporarily stored outside a building
shall be in covered containers that enable convenient collection and loading. Said
containers shall be kept in a paved area that is completely screened from view by an
enclosure of which three (3) sides shall consist of six (6) foot high, fully grouted,
decorative masonry walls, and fully enclosed with solid metal gates painted a color
that is compatible with the enclosure walls. The interior dimensions of said
enclosure shall provide for convenient access to the containers. The interior of said
enclosure shall be equipped with minimum three (3) inch thick bumpers to prevent
the containers from damaging the enclosure. Said enclosures shall not be located in
any required front, side or rear yard.
SECTION 4. That Sections 9260.2.7.1, and 9266.2.7.1 be added to the Arcadia
Municipal Code to read as follows:
9260.2.7.1,9266.2.7.1 STORAGE. OUTSIDE. TRASH, GARBAGE AND REFUSE.

SECTION 5. That Sections 9260.2.7.2, 9261.6.7.1, 9262.6.9.1, 9263.6.6.1, 9265.6.6.1,
9266.2.7.2, and 9268.6.10.1 be added to the Arcadia Municipal Code to read as follows:
9260.2.7.2,9261.6.7.1,9262.6.9.1, 9263.6.6.1, 9265.6.6.1, 9266.2.7.2, 9268.6.10.1 STORAGE.
OUTSIDE. RECYCLABLES.
Recyclables that are collected and loaded outside a building shall be stored in
covered containers and in accordance with the California Solid Waste Reuse and
Recycling Access Act of 1991. Said collection and loading containers shall be kept in a
paved area that is completely screened from view by an enclosure of which three (3)
sides shall consist of six (6) foot high, fully grouted, decorative masonry walls, and
fully enclosed with solid metal gates painted a color that is compatible with the
enclosure walls. The interior dimensions of said enclosure shall provide for
convenient access to the containers. The interior of said enclosure shall be equipped
with minimum three (3) inch thick bumpers to prevent the containers from
damaging the enclosure. Said enclosures shall not be located in any required front,
side or rear yard.
SECTION 6. That Sections 9253.2.17 and 9255.2.17 of the Arcadia Municipal
Code be amended to read as follows:
9253.2.17,9255.2.17 TRASH AREAS.
Lots developed with more than one (1) dwelling unit shall be provided with a
trash, garbage and refuse collection and loading area which shall be paved and
completely screened from view by an enclosure of which three (3) sides shall consist
of five (5) foot high, fully grouted, decorative masonry walls, and fully enclosed with
solid metal gates painted a color that is compatible with the enclosure walls. The
interior dimensions of said enclosure shall provide for convenient access to the trash
containers. The interior of said enclosure shall be equipped with minimum three (3)
inch thick bumpers to prevent the containers from damaging the enclosure. Said
enclosures shall not be located in any required front, side or rear yard.
SECTION 7. That Sections 9253.2.17.1 and 9255.2.17.1 be added to the Arcadia
Municipal Code to read as follows:
9253.2.17.1,9255.2.17.1 RECYCLABLES COLLECTION AND LOADING AREAS.
Lots developed with more than one (1) dwelling unit shall be provided with
an area for the collection and loading of recyclables in accordance with the California
Solid Waste Reuse and Recycling Access Act of 1991. That area shall be paved and

completely screened from view by an enclosure of which three (3) sides shall consist
of five (5) foot high, fully grouted, decorative masonry walls, and fully enclosed with
solid metal gates painted a color that is compatible with the enclosure walls. The
interior dimensions of said enclosure shall provide for convenient access to the
collection containers. The interior of said enclosure shall be equipped, if necessary,
with minimum three (3) inch thick bumpers to prevent the containers from
damaging the enclosure. Said enclosures shall not be located in any required front,
side or rear yard.
SECTION 8. That Sections 9273.2.9 and 9274.2.7 be added to the Arcadia
Municipal Code to read as follows:
9273.2.9,9274.2.7 RECYCLABLE MATERIALS STORAGE.
In accordance with the California Solid Waste Reuse and Recycling Access Act
of 1991, an area shall be provided for the collection and loading of recyclable
materials.
SECTION 9. That the title of Chapter 1 of Article V of the Arcadia Municipal
Code be amended to read: GARBAGE, REFUSE AND RECYCLABLES.
SECTION 10. That Section 5110.5 of the Arcadia Municipal Code be amended
to read as follows:
5110.5. SAME. RECYCLABLES.
In the absence of a definition under applicable State law, recyclables shall mean,
but not be limited to, the following materials for which a collections and reuse
market has been established: newspapers, white paper, cardboard, aluminum and
other metal cans, and glass and plastic beverage containers.
SECTION 11. That Part 2 of Chapter 1 of Article V of the Arcadia Municipal
Code be divided into two Divisions with the following titles: DIVISION O.
GARBAGE AND REFUSE (which will be comprised of the existing Sections 5210
through 5120.10) and DIVISION 1. RECYCLABLES (which will be comprised of the
new Section 5121 below).
SECTION 12. That a Section 5121 be added to the Arcadia Municipal Code to
read as follows:
5121. RECYCLABLES COLLECTION.
The collection, loading and hauling of recyclables shall be provided for, and
conducted in accordance with the California Solid Waste Reuse and Recycling Access

Act of 1991, and the applicable regulations contained in Division 0 of this Part.
SECTION 13. The City Clerk of the City of Arcadia shall certify to the adoption
of this Ordinance and shall cause a copy of the same to be published in the official
newspaper of said City within fifteen (15) days after its adoption.

that said Ordinance was adopted by the following vote, to wit:
