HomeMy WebLinkAbout1998 ORDINANCE 1998 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA ADDING KARAOKE REGULATIONS TO THE ARCADIA MUNICIPAL CODE. WHEREAS, text amendment T.A. 93-003 was initiated by the City Council for the consideration of adding regulations for karaoke businesses to the Arcadia Municipal Code. WHEREAS, a public hearing was held on August 24, 1993, before the Planning Commission at which time all interested persons were given full oppor- tunity to be heard and to present evidence, and WHEREAS, the Planning Commission of the City of Arcadia recommended approval of the text amendment as set forth in the Planning Department report to the City Council, and WHEREAS, the City Council conducted a public hearing concerning the text amendment on September 21, 1993 and approved the amendment. WHEREAS, the City Council determined that there is no definition or provision to regulate karaoke businesses and because of the problems associated with said uses, the Council found that establishing regulations would provide the City and citizens with guidelines for said use and protect the health, safety, and welfare of the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That Section 9275.1.50.1.1. shall be added to read: 9275.1.50.1.1. KARAOKE AND/OR SING-ALONG. C-2 or any less restrictive commercial zone. Section 2. That the following criteria shall be added to Division 5 Conditional Uses Title 10 Special Regulations - Karaoke and/or Sing-along: 9275.10.1. DEFINITIONS. For the purpose of this Division, the term "karaoke" and/or "sing-along" shall mean any primary or accessory indoor / outdoor gathering, conducted in an open forum, where one or more persons participate in live singing accompanied by recorded music (possibly aided by video) from which the vocals have been removed. The above-described setting must consist of a common floor area and -1- 1998 may not be subdivided into individual spaces or rooms by walls, partitions or any of the like, 9275.10.2. PARKING REQUIREMENTS. Every karaoke or sing-along business shall have adequate and accessible on- site parking and provide ten (10) parking spaces per 1,000 (one-thousand) square feet of gross floor area. 9275.10.3. HOURS OF OPERATION. No karaoke business shall operate between the hours of 2:00 a.m. and 8:00 a.m. and no patrons shall be on the premises between said hours. 9275.10.4. KARAOKE REGULATIONS. 1. Karaoke and/ or sing-along businesses shall only be allowed in open areas. There shaH be no private rooms, booths or enclosures. 2. No person under the age of twenty-one (21) shall be permitted unless otherwise authorized by the specific Alcoholic Beverage Control (ABC) license issued by the Department of Alcohol and Beverage Control. 3. No minors (persons under eighteen [18] years of age) shall be allowed on the premises after 10:00 p.m., unless accompanied by a parent or legal guardian and specifically authorized by the Alcoholic Beverage Control (ABC) license issued by the Department of Alcohol and Beverage Control. 4. No alcoholic beverages may be consumed or sold in any business exclusively operated as a karaoke sing-along. Alcohol may only be consumed or sold in conjunction with a restaurant and cocktail lounge when karaoke is an incidental or non-primary use. 5. All businesses shall be located with street visibility to allow direct inspection and response by emergency personnel. 6. All entrance and exit doors shall remain unlocked and unobstructed during business hours and when any patrons are on the premises. 7. The business premises shall be open and available for inspection by any lawful agent of the City of Arcadia during regular business hours. 8. All conditions at" the Conditional Use Permit shall be posted at a conspicuous location at the premises and all employees shall be apprised of said conditions. Section 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption. -2- 1998 ....---_..---- ~.. .
