HomeMy WebLinkAbout1965 ORDINANCE NO. 1965 AN ORDINANCE OF THE CITY OF ARCADIA, CALIFORNIA AMENDING SECTIONS 4131.1.1, 4135, 4135,1, 4135,2, 9251.1.4 AND 9252.1.4.1 OF THE ARCADIA MUNICIPAL CODE TO INCLUDE LLAMAS AND ALPACAS UNDER THE SAME PROVISIONS AS HORSES WHEREAS, text amendment T.A. 92-002 was initiated by Sean Cheng for the consideration of amending Sections 4131.1.1, 4135, 4135.1, 4135.2, 9251.1.4 and 9252.1.4.1 to include llamas and alpacas under the same provisions as horses in the R-O and R-1 zones, WHEREAS, a public hearing was held on January 28, 1992, before the Planning Commission at which time all interested persons were given full oppor- tunity to be heard and to present evidence, and WHEREAS, the Planning Commission of the City of Arcadia recommended approval of said text amendment as set forth in the Planning Department report to the City Council, and WHEREAS, the City Council conducted a public hearing concerning the text amendment on January 7, 1992 and approved the amendment, WHEREAS, the City Council determines that llamas and alpacas are domesticated animals; based upon the information submitted by the applicant and set forth in the staff report, the Council further determined that both these animals should be permitted in the R-1 and R-O subject to the same regulations as horses, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That Sections 4131.1.1, 4135 4135.1 and 4135,2. be amended to read: 4131.1.1. ANIMALS. Animals shall include horses, ponies, mules, burros, jacks and jennies, cows, bulls, calves, heifers, sheep, goats, llamas, alpacas, swine, hogs, pigs, and all other domestic or domesticated animals other than household pets," 4135. STAKING RESTRICTED, No person shall stake out or cause or permit to be staked out any horse,mule, colt, llama, alpaca, bull, cow or calf, within that portion of the City bounded by Foothill Boulevard on the north, Duarte Road on the south, Second Avenue on the East and Santa Anita Avenue on the west." -1- 1965 4135.1. SAME. RESIDENTIAL LOTS. No person shall stake out or cause or permit to be staked out, any horse, mule, colt, llama, alpaca, bull, cow or calf upon that portion of any lot used for residential purposes which lies between the residence on said lot and the street or highway upon which said lot fronts," 4135,2, SAME. PUBLIC PLACES, No person shall herd, stake or tie any ox, steer, bull, cow, horse, colt, jack, mule, llama, alpaca, calf, sheep, goat or hog in any street, lane, alley, park or other public place belonging to or under the control of the City. Section 2. That Sections 9251.1.4 and 9252,1.4,1 be changed to read: EQUINE ANIMALS. The keeping of not more than two (2) equine animals for the use of the family occupying the lot on sites having an area of not less than sixteen thousand (16,000) square feet entirely within the boundary lines of a single lot as such lot is shown on the subdivision map recorded in the office of the County Recorder, One (a) additional equine animal may be kept for each additional five thousand (5,000) square feet over the minimum sixteen thousand (16,000) square feet. Not more than a total of five (5) equine animals of any age shall be kept on any one lot. The keeping of such equine animals provided for herein shall conform to other provisions of governing same. For the purpose of this Section "Equine Animals" shall also include llamas and alpacas, Section 3. The City Council finds and determines that the text amendment is consistent with the general plan and will not be detrimental to public health, safety, general welfare and good zoning practice. Section 4, The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of said City within fifteen (15) days after its adoption, Passed, approved and adopted this l7th day of March 1992, ATTEST: J Arcadia Ci -2- 1965 STATE OF CALIFORNIA ) COUNTY OF LOS ANGELES ) SS: CITY OF ARCADIA ) I, JUNE D.
