HomeMy WebLinkAbout1972 ORDINANCE NO, 1972 AN ORDINANCE OF THE CITY OF ARCADIA, CALIFORNIA APPROVING TEXT AMENDMENT 92-004 ADDING SECTIONS 9275.1.50.1.1,9275.8.1 AND 9275.8,2 TO THE ARCADIA MUNICIPAL CODE ESTABLISHING REGULATIONS FOR INDOOR SWAP MEETS WHEREAS, text amendment T.A. 92-004 was initiated by the City for the consideration of adding indoor swap meet regulations to the Arcadia Municipal Code, WHEREAS, a public hearing was held on May 12, 1992, before the Planning Commission at which time all interested persons were given full opportunity to be heard and to present evidence, and WHEREAS, the Planning Commission of the City of Arcadia recommended approval of the text amendment as set forth in the Planning Department report to the City Council, and WHEREAS, the City Council conducted a public hearing concerning the text amendment on June 2, 1992 and approved the amendment, WHEREAS, the City Council determines that because of the unique nature of indoor swap meets which results in an increase in the number of vendors per square foot of building area, there is the need to establish specific standards for this type of use, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That Section 9275.1.50,1.1, be added to the Condition Use Permit Division of the code to read: 9275,1.50,1,1. INDOOR SWAP MEETS. C-2 or any less restrictive commercial zone, Section 2. That the following title shall be added to Division 5 Conditional Uses: Title 8. Special Regulations - Indoor Swap Meets Section 3, That Sections 9275.8,1. and 9275.8,2. be added to Division 5 Conditional Uses Title 8 Special Regulations-Indoor Swap Meets: 9275,8.1. DEFINITIONS. -1- 1972 For the purpose of this Division, the term "indoor swap meets" shall mean separate vendors participating in collective retail sales or exchange of merchandise or food where a common floor area is subdivided into individual spaces with no dividing walls and each individual business, occupant or tenant requires a separate business license, EXCEPTION, Subidivions whereby the primary occupant or tenant occupies a minimimum of 75% of the gross floor area, 9275,8.2. PARKING REQUIREMENTS, Every indoor swap meet shall have accessible and adequate on-site parking for automobiles and trucks and must comply with the following: five (5) parking spaces per one-thousand (1,000) square feet of gross floor area, plus one (1) ~ additional parking space for each vendor, ~ Section 4, The City Council finds and determines that the text amendment is consistent with the general plan and will not be detrimental to public health, safety, general welfare and good zoning practice, Section 5. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of said City within fifteen (15) days after its adoption.
