HomeMy WebLinkAbout1932 ORDINANCE NO. 1932 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTIONS 4112.l, 4ll3.9, 4113.10, 4113.1l, 4l13.12, 4113.l3, 4ll3.l5, 4113.16, 4113.17, 4113.18 4113.19, 4124.1.3, 4l24.2, 4131.5, 4131.6, 4131.7, 4133, 4133.1, 4133.2, 4133.3, 4133.4, 4133.6,. 4l33.8, AND 4133.8.1 OF THE ARCADIA MUNICIPAL CODE TO INCREASE THE COST OF IMPOUND FEES AND VACCINATION REQUIREMENTS, AMENDING DIVISION 3, OF PART 3 OF ARTICLE IV REGARDING IMPOUND FEES AND SECTION 4113.9 TO DELETE AUTHORIZING SALE OF ANIMALS TO RESEARCH INSTITUTIONS WHEREAS, the City of Arcadia has entered into an Animal Control Services Agreement with the Los Angeles County Department of Animal Care and Control for licensing, housing and field services of all animals in the City; and WHEREAS, the Supervisors of the County of Los Angeles, California, did approve on September ll, 1990, Ordinance No. 90- 0137 which amended Title lO of the Los Angeles County Code relating to animal regulations by increasing various fees and charges and practices relating to impound fees and vaccination requirements; and WHEREAS, Section 7 of the Agreement entitled "Agreement Animal Control Services" between the County of Los Angeles and the city of Arcadia, dated July 1, 1987, requires that the said Agreement shall be terminated by the County at any time that the City fails to enact and maintain in full force an ordinance identical with the provisions of Division 1, Title 10 of the Los Angeles County Code; and 1 1932 WHEREAS, the County of Los Angeles Director of the Department of Animal Care and Control has requested the city to adopt various fee increases and amendments to the Arcadia Municipal Code relative to animal control. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That section 4112.1 of the Arcadia Municipal Code is hereby deleted. SECTION 2. That section 4113.9 of the Arcadia Municipal Code shall be amended to read as follows: 4113.9. DISPOSAL OF DOGS AND CATS. Not less than five (5) days after the taking up and impounding of any dog or cat herein provided, the poundmaster shall destroy such dog or cat or shall dispose of such dog or cat to any other person who will pay the reasonable value of such dog or cat, but in no case less than the below-listed fees. In the case of a dog the purchaser also shall procure and pay for the required license for such dog for the current year unless such a license is issued and in full force and effect. That Section 4113.10 of the Arcadia Municipal Code is hereby amended to read as follows: 4113.10. KENNEL, ETC. FEE. SECTION 4. That section 4113.11 of the Arcadia Municipal Code is hereby amended to read as follows: 4113.1l. PUBLIC SPAY AND NEUTER CLINIC (a) The Poundmaster may establish a clinic, at which members of the public may have dogs and cats spayed or neutered in a humane manner upon payment of the following fees: For neutering a male cat............................ $17.00 For spaying a female cat............................ $25.00 For spaying a pregnant female cat................... $35.00 For spaying a female dog up to 25 pounds. . . . . . . . . . . . $25.00 For spaying a female dog up to 50 pounds............ $35.00 For spaying a female dog up to 70 pounds............ $45.00 For spaying a female dog over 70 pounds............. $65.00 For neutering a male dog up to 50 pounds............ $25.00 For neutering a male dog up to 70 pounds............ $35.00 For neutering a male dog over 70 pounds. . . . . . . . . . . . . $45.00 A fee of one-half the amount above-stated shall be charged to persons presenting a valid Medi-cal card. In addition to the above fee, a feel of $7.00 shall be charged for giving of a distemper vaccination. 4 1932 (b) A person submitting a dog or cat for the above service shall sign a consent form certifying thereon under penalty of perjury that he is the owner of said animals or setting forth facts showing that he is otherwise authorized to present the animals for the above operation and such person may be required to furnish proof of such ownership or authority. Such consent shall contain a waiver of any and all liability of the city of Arcadia, its employees, Los Angeles County, the Department of Animal Care and Control, and any County employees for any injury or death to an animal arising out of the aforementioned operation or any services provided incidental thereto. (c) The Poundmaster shall establish a return date by which a person submitting an animal for the above operation shall pick up said animal or be subject to a reasonable board and care fee to commence the day after such return date. Failure to pick up an animal within 15 days of said return date shall be deemed abandonment of such animal and the Poundmaster may dispose of it by sale or destruction. SECTION 5. That section 4113.12 of the Arcadia Municipal Code is hereby amended to read as follows: 4113.12. DEAD ANIMALS. (a) The Poundmaster shall pick up and dispose of all dead animals on public highways and on public and private property within the City of Arcadia where the owner is unknown. The Poundmaster shall also pick up dead small animals at a fee of Five Dollars ($5.00) when requested by the animal's owner or other 5 1932 person having custody or control over the animal, except that he shall not pick up any dead animal in garbage districts where contractors are required to perform such service pursuant to contract and in beach areas which are maintained by the Los Angeles County Department of Parks and Recreation. (b) The poundmaster shall also dispose of dead livestock at a fee of Two Hundred Dollars ($200.00) when requested by the livestock's owner or other person having custody or control over the livestock. In addition, the owner of such livestock shall be liable to the poundmaster for salary, costs and other expenses incurred by the Poundmaster in the removal of such livestock. Such additional costs shall be determined by the Poundmaster with the concurrence of the Los Angeles County Auditor Controller. (c) For each pick up or receiving of dead animals from any pet hospital, humane society, kennel, stable or veterinary establishment, or any commercial, industrial, educational, research, medical or other facility that deals with animals in connection with its operation, the Poundmaster shall collect a fee of Five Dollars ($5.00) each. SECTION 6. That Section 4113.13 of the Arcadia Municipal Code is hereby amended to read as follows: 4113.13. UNWANTED ANIMAL FEES. The Poundmaster shall charge the following fees for the taking up or relinquishing of an unwanted animal when requested to do so by the animal's owner or other person having custody or control over said animal. 6 1932 For the relinquishing of a small animal at a shelter of the Poundmaster......................... $ 5.00 For the relinquishing of a live small animal litter at a shelter of the Poundmaster........ $ 5.00 For the taking up per live animal.................... $10.00 SECTION 7. That sections 4113.15, 4113.16, 4113.17, 4113.18 and 4113.19 are hereby added to the Arcadia Municipal Code to read as follows: 4113.15. DAILY CARE AND IMPOUND FEES. Animals found at large and impounded by the Poundmaster shall be redeemed only upon the payment of all applicable impound fees, and fees for daily care and feeding and veterinary services performed during impoundment as follows: (A) Animal Impound Fees 1. Small animals (other than dogs and cats)........ $ 2.00 2. Dogs and Cats a. First impoundment...................... $10.00 b. Second impoundment within one year..... $20.00 c. Third impoundment within one year...... $30.00 3. Special handling fee for large animals or animal pickups requiring more than one animal control officer and/or special transportation equipment (per hour) .................... $33.00 (B) Care and Feeding (Daily) 1. Health maintenance services performed by department animal health technician (per hour)............................... $30.50 4113.16. ANIMAL TRAP RENTALS. The Poundmaster may permit members of the public to borrow animal traps to be used for the purpose of catching animals on their property. The Poundmaster shall collect the following fees: (A) Daily rental fees (all traps)................ $ 1.00 (B) Replacement fee for animal traps lost or damaged beyond repair 1. Dog Trap...................................... $132.00 2. Cat Trap...................................... $ 24.00 3. Racoon Trap................................... $ 31.00 4113.17. UNLAWFUL IMPOUNDS. No charge shall be collected for any animal which has been unlawfully taken up and impounded. Such animal shall be immediately delivered upon demand to the owner or person entitled to the cU$tody thereof. 8 1932 4113.18. PAYMENT. The owner or person entitled to the custody of any animal taken up and impounded under the provisions of this Part may, at any time before the sale or disposal thereof as herein provided, redeem such animal by paying to the poundmaster or poundkeeper the fees and charges prescribed by this Part accruing up to the time of such redemption. When a veterinarian's fee has been paid or incurred for the care or treatment of any animal, such animal shall not thereafter be redeemed without payment by the owner of such fee, in addition to any and all other fees. 4113.19. DISPOSAL. Except where it is otherwise provided by this Code or any statute, if the owner or person entitled to the possession of any animal impounded by the Poundmaster or a Poundkeeper does not redeem such animal within five (5) days of such impounding, the Poundmaster or Poundkeeper may destroy or sell such animal, or may give such animal to any governmental entity. SECTION 9. That Section 4124.1.3 of the Arcadia Municipal Code is hereby amended to read as follows: The Poundmaster shall not issue a license unless the applicant exhibits a certificate signed by a veterinarian licensed either by the State or by any other state to practice veterinary medicine that: (1) The period elapsing from the date of vaccination with approved rabies vaccine to the date of expiration of the license being issued does not exceed the time as established by the state, 9 1932 or (2) Such dog should not be vaccinated with rabies vaccine because such vaccination would jeopardize the health of such dog due to infirmity or other disability and the estimated date of termination thereof is shown on the fa~e of the certificate to the satisfaction of the Poundmaster. SECTION 10. That Section 4124.2 of the Arcadia Municipal Code is hereby amended to read as follows: 4l24.2. ANNUAL. The license fees provided for herein shall be paid annually in advance to the Poundmaster. A delinquency charge of $20.00 shall be assessed when the license fees provided for in this Chapter are not paid on or before the expiration date or the date the license is required to be obtained by the provisions of this Title. SECTION ll. That Sections 4l31. 5, 4131. 6 and 4131. 7 are hereby added to the Arcadia Municipal Code to read as follows: 4131.5. SMALL ANIMAL. Small Animal means any animal that weighs less than 300 pounds. 4131.6. LARGE ANIMAL. Large Animal means any animal that weights 300 pounds or more. 4131.7. STABLES. Stables mean any property, premises, building or structure maintained for the lodging and feeding of horses and cattle. lO 1932 SECTION 12. That Division 3 (Impound Fees) of Part 3 of Article IV is hereby deleted in its entirety. SECTION 13. That the City Clerk shall certify to the adoption of this Ordinance.
