HomeMy WebLinkAbout1933 ORDINANCE NO, 1933 , AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING TEXT AMENDMENT 91-001 REVISING THE REAR SETBACK REQUIREMENTS FOR COMMERCIAL AND INDUSTRIAL BUILDINGS IN THE C-O, C-1, C-2 AND C-M ZONES. WHEREAS, a text amendment was initiated by the City of Arcadia for the consideration of revising the setback and window regulations for commercial properties that are adjacent to residentially zoned properties, Specifically, the City Council wished to consider a text amendment that would effectuate a return to the former regulations i.~., a 550 angle in lieu of 450, and no prohibition upon window openings, WHEREAS, a public hearing was held on February 12, 1991, before the Planning Commission of the City of Arcadia, at which time all interested persons were given full opportunity to be heard and to present evidence, and WHEREAS, the Planning Commission recommended to the City Council a partial approval of the text amendment, and WHEREAS, the City Council held a public hearing concerning the text amendment on March 5, 1991 and approved the amendment in accordance with the recommendation of the Planning Commission. WHEREAS, the City Council determined that the existing setback and window regulations for commercial properties that are adjacent to residentially zoned properties are appropriate, and, that the 20 foot rear setback required for commercially zoned properties that abut other commercially or industrially zoned properties is unnecessary, and WHEREAS, the City Council found that this text amendment will not have a significant effect on the environment, and, that there is no evidence that it will have any potential for adverse effect on wildlife resources, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That Sections 9261.2.4,,9262.2.4, and 9263.2.4. of the Arcadia Municipal Code be amended to read as follows: 9261.2.4,,9262,2.4, and 9263,2.4. REAR YARD. 1933 There shall be on every lot or parcel of land a rear yard in accordance with the following: a. Where the rear property line abuts commercial or industrial zoned property, or where the rear property line abuts a dedicated alley which separates such rear property line from abutting commercial or industrial zoned property, no rear yard shall be required. b. Where the rear property line abuts residential zoned property a minimum rear yard. setback of twenty (20) feet shall be maintained, except that no portion of any structure shall encroach through a plane projected from an angle of forty-five (45) degrees as measured at the ground level along the rear property line. c. Where the rear property line abuts a dedicated alley which separates such rear property line from abutting residential zoned property, the rear yard shall have a minimum depth of twenty (20) feet which shall be measured from the center line of said alley and the forty-five (45) degree angle of the aforedescribed plane may be measured at the ground level along the center line of said alley.
