HomeMy WebLinkAbout1860 ORDINANCE NO. 1860 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING SECTIONS 4113.11., 4113.12., 4124.2.2., 4124.2.5,4125, 4122, 4125.11.1 AND 4125.7 OF THE ARCADIA MUNICIPAL CODE TO INCREASE THE COST OF DOG LICENSES, IMPOUND FEES AND VACCINATION REQUIREMENTS AS REQUIRED BY THE COUNTY OF LOS ANGELES DIRECTOR OF ANIMAL CARE AND CONTROL THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY FINDS, DETERMINES AND ORDAINS AS FOLLOWS: HHEREAS, the City of Arcadia has entered into an Animal Control Services Agreement with the Los Angeles County Department of Animal Care and Control for licensing, housing and field services of all animals in the City; and \/HEREAS, the Supervisors of the County of Los Angeles, California, did approve on March 17, 1987, Ordinance No. 87-0036 , which amended Title 10 of the Los Angeles County Code relating to animal regulations by increasing various fees and charges and practices relating to dog license, vaccination fees, and impound fees; and WHEREAS, Section 7 of the Agreement entitled "Agreement Animal Control Services" between the County of Los Angeles and the City of Arcadia, dated July 1, 1981, requires that the said Agreement shall be terminated by the County at any time that the City fails to enact and maintain in full force an ordinance identical with the provisions of Division 1, Title 10 of the Los Angeles County Code; and -1- 1860 ,I ,," ~. WHEREAS, the County of Los Angeles Director of the Department of Animal Care and Control has requested the City to adopt various fee increases and amendments to the Arcadia Municipal Code relative to animal control. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That Subsection (c) of Section 4113.11 of the Arcadia Municipal Code is hereby repealed. SECTION 2. That Subsection (d) of Section 4113.11 of the Arcadia Municipal Code as it currently reads shall be deemed a new Subsection (c) of Section 4113.11. SECTION 3. That Section 4113.12 of the Arcadia Municipal Code is hereby amended to read as follows: "4113.12 Dead Animals. (a) The pound master shall pick up and dispose of all dead animals on public highways and on public and private property within the City of Arcadia where the owner is unknown. The pound master shall also pick up dead animals other than livestock at a fee of $5.00 when requested by the animals owner or other person having custody or control over the animal, except that he shall not pick up any dead animal in garbage districts where contractors are required to perform such service pursuant to contract and in beach areas which are maintained by the Los Angeles County Department of Parks and Recreation. (b). The pound master shall also dispose of dead livestock at a fee of $50.00 when requested by the livestock's owner or other person having custody or control over the livestock. In addition, the owner of such livestock shall be liable to the -2- 1860 .J. _" ~ pound master for salary, costs and other expenses incurred by the pound master in the removal of such livestock. Such additional costs shall be determined by the pound master with the concurrence of the Los Angeles County Auditor Controller. (c). For each pick up or receiving of dead animals from any pet hospital, humane society, kennel, stable or veterinary establishment, or any commercial, industrial, educational, research, medical or other facility that deals with animals in connection with its operation, the pound master shall collect a fee of $10.00." SECTION 4. That Section 4124.2.2 of the Arcadia Municipal Code is hereby amended to read as follows: "4124.2.2. Dog License. Fees. Every person owning or having custody or control of any dog over the age of 4 months in the City not covered by the provisions of Section 4124.2.3 shall first obtain an annual license from the pound master for each of such dogs and at the same time obtain a dog license tag, and for such license or licenses in addition to the one dollar ($1.00) fee for the dog license tag, shall pay for nineteen dollars ($19.00) a total of twenty dollars ($20.00) in all." SECTION 5. That Section 4124.2.5 of the Arcadia Municipal Code is hereby amended to read as follows: "4124.2.5. Spade or Neutered Dogs and Senior Citizens Reduction in License Tag Fee. (a). If a certificate from a licensed veterinarian is presented that the dog has been spaded neutered, pursuant to Section 30804.5 of the Food and Agricultural Code, a person owning such dog shall obtain a dog license tag and pay a fee of -3- 1860 .i_;~ one dollar ($1.00) therefore, and in addition thereto obtain an annual license and pay a fee of nine dollars ($9.00) therefore, a total of ten dollars ($10.00) in all. (b). A fee of one-half the amount stated in Section 4124.2.2 shall be charged to persons presenting proof and qualifying for senior citizen status. For purposes of this Section, persons over 60 years of age qualify for senior citizen status." SECTION 5. That Section 4122 of the Arcadia Municipal Code is hereby amended to read as follows: "4122 Requirements. (a) Every person keeping, harboring or having any dog over four months of age in the City shall cause such dog to be vaccinated with rabies vaccine by a person licensed by the City, State, or any State, to practice veterinary medicine, before the latest of the following dates: 1. Fifteen days after first acquiring such dog; 2~ Fifteen days after bring such dog into the City. (b). Every person keeping, harboring, or having a dog in the City which has been vaccinated with an approved rabies vaccine shall cause such dog to be re-vaccinated within a period of not more than: 1. Twelve months after the dog's initial vaccination if the dog was between four months and one year of age at the time of such vaccination; 2. Thirty six months after each prior vaccination." SECTION 6. That Section 4125.11.1 of the Arcadia Municipal Code is hereby amended to read as follows: -4- 1860 , -,. -., , "4125.11.1. Same Period Impounding. (a) For the redeeming of any impounded dog, the fee charged shall be: first time - ten dollars ($10.00), second time - twenty dollars ($20.00), third time and thereafter thirty dollars ($30.00). (b). An additional charge will be imposed for the feeding and caring of such dog in the amount to_recover the cost of service. Said charge shall be equal to that determined by the Los Angeles County Auditor Controller for each day or fraction thereof, except for the day on which it was impounded. (c). If a dog is picked up by the pound master pursuant to the provisions of this Section, but is returned to its owner prior to impounding the dog in a Los Angeles County operated animal shelter, such owner shall pay a fee of ten dollars .'1 ($10.00). A receipt therefore shall be issued in triplicate, the second copy of the receipt shall be given to the dog's owner." SECTION 7. That Section 4125.7 of the Arcadia Municipal Code is hereby amended to read as follows: "4125.7. Same. Release. The pound master or pound keeper shall not sell or release any dog unless such dog does not have rabies, and; 1. The purchaser exhibits a certificate signed by a veterinarian licensed either by the State or by any other State to practice veterinary medicine that a) such dog has been vaccinated with an approved rabies vaccine within a period of not more than twelve months after the dog's initital vaccination if the dog was between four months and one year in age at a time of such initital vaccination or, -5- 1860 .. f' .L...' . ~ 2. Such dog has been vaccinated with approved vaccine within the past thirty six months, or 3. Such dog has been vaccinated with rabies vaccine because such vaccination would jeopardize the health of such dog due to infermany or other disability, which infermany or disability and the estimated date of termination as shown on the face of the certificate; or 4. The Director of Health Services has so vaccinated such dog within the time specified one herein above, or such dog is less than four months in age. SECTION 8. The City Clerk shall certify to the adoption of this ordinance and shall cause a copy of the same to be published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption.
