ORDINANCE NO, 1881
AN ORDINANCE OF THE CITY OF ARCADIA AMENDING THE SETBACK
REGULATIONS AND BUILDING HEIGHT REGULATIONS AND REWORDING
THE PARKING AND DRIVEWAY REGULATIONS IN THE R-O, R-l AND R-M
ZONES
WHEREAS, a text amendment was initiated by the City for the consideration of
amending the front yard and side yard setback regulations and the building height
regulations in the R-O, R-l and R-M zones and rewording the parking, driveway and rear
yard setback regulations in the R -0, R -1 and R -M zones to eliminate the metric
measurements.
WHEREAS, public hearings were held on November 10, November 24 and January
26 before the Planning Commission at which time all interested persons were given full
opportunity to be heard and to present evidence, and
WHEREAS, the Planning Commission of the City of Arcadia recommended approval
of subject text amendment to the City Council, and
WHEREAS, the City Council conducted a public hearing concerning the text
amendment on March 1, 1988 and approved the amendment,
WHEREAS, the City Council determines that the provisions of this ordinance as set
forth herein are an effective method to lessen the visual impact of dwellings and provide
for the construction and remodeling of homes which are more in proportion to the lot size,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. That Sections 9250.3.1, 9251.2.1 and 9252,2.1 be amended to read as
follows:
"BUILDING HEIGHT, The maximum height of any dwelling shall not
exceed the limit as set forth in the following table, except as may be
approved pursuant to the modification regulations:

Section 2, That Sections 9250,3,2 and 9252.2,2 be amended to read as
follows:
"FRONT YARD, There shall be a front yard of not less Ulan twenty -five feet
(25'); provided Ulat where lots comprising sixty percent (60~) or more of Ule
frontage in a block are developed WiUllarger front yards, the front yard for a lot
proposed for development shall be the average of the two (2) nearest developed
lots at the time a building permit is issued. No portion of any structure shall
encroach through a plane projected from an angle of forty (40) degrees as
measured at the ground level along Ule front property line, Said point shall be
located at the intersection of a horizontal projection of the adjacent grade elevation
and its intersection With said property line."
Section 3" That Section 9251.2,2 be amended to read as follows:
"9251.2.2. FRONT YARD, There shall be a front yard of not less than thirty
feet (30'); provided that where lots comprising sixty percent (60%) or more of the
frontage in a block are developed With larger front yards, the front yard for a lot
proposed for development shall be the average of the two (2) nearest developed
lots at the time a building permit is issued. No portion of any structure shall
encroach through a plane projected from an angle of forty (40) degrees as
measured at the ground level along the front property line, Said point shall be
located at the intersection of a horizontal projection of the adjacent grade elevation
and its intersection With said property line."
Section 4, That Sections 9250,3.3, and 9251,2.4 be amended to read as
follows:
"SIDE YARD, There shall be a side yard on each side of a building of not less
than ten (10) feet. Any portion of a single-story in excess of twelve (12) feet

and/or any portion of a 5e(ond story including second story architectural features,
"Walls and roof, shall be a minimum of ten (10) feet or five (5) feet plus 10% of tlle
width of tlle lot as measured at tlle front property line, whichever is greater, The
maximum setback requirement for a second story shall be fifteen (15) feet. The lot
widtll on lots with more than 50% frontage on a cul-de-sac terminus shall be
measured at tlle building setback line,
Exceptions:
1) A portion of a gable roof and walls tllereunder which do not exceed
a maximum height of 20 feet and which enclose a portion of tlle first floor
living area of tlle structure, may encroach into the above required setback
but in no event shall such encroachment be less tllan ten (10) feet except as
may be approved pursuant to tlle modification regulations.
2) A portion of a gable roof and walls tllereunder which do not exceed
tlle maximum height allowed as set forth in this Section and which enclose a
portion of the 5e(ond floor living area of a dwelling or otller floor area above
tlle first floor living area of tlle dwelling may encroach into the above
required setback but in no event shall such encroachment be less than ten
(10) feet except as may be approved pursuant to tlle modification regulations.
3) Fireplaces not exceeding eight (8) feet in widtll which do not
project more than two (2) feet from tlle building wall.
4) Architectural features (not including eaves) on tlle first floor which
do not project more tllan two (2) inches for each one (1) foot of tlle width of
such side yard,
5) A maximum two (2) foot eave may extend or project beyond the
required setback on both the first and 5e(ond story."
Section 5., That Sections 9251.2.5, 9251.2,8,1, and 9251.2,8.2 be amended to
read as follows:
"9251.2.5, SAME. CORNER LOT. On corner lots the required side yard
adjoining the interior lot shall be not less tllan ten (10) feet in width, The required
side yard on Ule street side of a corner lot shall be not less Ulan twenty (20) feet.
The interior side yard setback for any portion of a single-story in excess of twelve
(12) feet and/or any portion of a second story including second story architectural
features, walls and roof, shall be a minimum of ten (10) feet or five (5) feet plus
10% of the width of the lot as measured at the front property line, whichever is
greater. 'The maximum setback requirement for a second story shall be fifteen (15)

feet. The lot width on lots with more than 50% frontage on a cul-de-sac terminus
shall be measured at the building setback line,

"9251.2,8,1. SAME, SAME. CORNER LOTS. On corner lots no accessory
building shall be located less than twenty (20) feet from the street side lot line or
less than three (3) feet from the rear lot line. On corner lots an accessory portion
of a main building not exceeding one ( 1) story in height may be located not less
than twenty (20) feet from the street side lot line and not less than ten (20) feet
from the rear lot line. The interior side yard setback for any portion of a single-
story in excess of twelve (12) feet and/or any portion of a second story including
second story architectural features, walls and roof, shall be a minimum of ten (10)
feet or five (5) feet plus 10% of the width of the lot as measured at the front
property line, whichever is greater. The maximum setback requirement for a
second story shall be fifteen (15) feet, The lot width on lots with more than 50%
frontage on a cul-de-sac terminus shall be measured at the building setback line.

Exceptions:

(10) feet except as may be approved pursuant to the modification regulations,

projoct more than two (2) feet from the building wall,
4) Architectural features (not including eaves) on the first floor which
do not projoct more than two (2) inches for each one (t) foot of the width of
such side yard,
5) A maximum two (2) foot eave may extend or projoct beyond the
required setback on both the first and second story."
"9251.2,8.2, SAME. SAME, REVERSE CORNER LOTS, On reverse corner lots
no accessory building shall be located less than twenty (20) feet from the street
side lot line or less than five (5) feet from the rear lot line, On reverse corner lots
an accessory portion of a main building not exceeding one ( 1) story in height may
be located not less than twenty (20) feet from the side street lot line and not less
than ten (10) feet from the rear lot line, The interior side yard setback for any

Section 6. That Sections 9252,2.4, 9252.2.5, 9252,2.11.1 and 9252,2,11.2 be
amended to read as follows:
"9252.2,4, SIDE YARD. On interior lots tlJ.ere shall be a side yard on each
side of every building of not less tlJ.an five (5) feet in widtlJ., Any portion of a
single-story in excess of twelve (12) feet and/or any portion of a second story
including second story architectural features, walls and roof, shall be a minimum of
ten (10) feet or five (5) feet plUS 10% of tlJ.e WidtlJ. of tlJ.e lot as measured at tlJ.e
front property line, wtlichever is greater. The maximum setback requirement for a
second story shall be fifteen (15) feet. The lot widtlJ. on lots witlJ. more tlJ.an 50%
frontage on a cul-de-sac terminus shall be measured at tlJ.e building setback line,
Exceptions:

5) A maximum two (2) foot eave may extend or project beyond the

"9252.2.5, SAME, CORNER LOT. On corner lots the required side yard

opening directly upon a side street shall be located not less than twenty (20) feet

features, walls and roof, shall be a minimum of ten (10) feet or five (5) feet plus
10% of the width of the lot as measured at the front property line, Whichever is
greater, The maximum setback requirement for a second story shall be fifteen ( 15)
feet. The lot width on lots with more than 50% frontage on a cul-de-sac terminus
shall be measured at the building setback line,

Section 7, That Section 9250,3.12 be added to the R-M zone as follows:
"9250.3.12. LOT COVERAGE. The combined ground floor area of all buildings
on anyone lot shall not exceed forty -five (45) percent of the total lot area,.
Section It That Section 9250,3.4. be amended to read as follows:
"9250,3.4. REAR YARD, There shall be a rear yard of not less than twenty-
five (25) feet, Any two-story portion of a dwelling shall have a rear yard setback
of not less than thirty-five (35) feet,
Section 9.. That Section 9250,3.6. be amended to read as follows:
"9250,3.6. PARKING,
A. At least two (2) covered off -street parking spaces measuring not
less than ten (10) feet by twenty (20) feet each with adequate individual
access shall be provided for each dwelling unit.
B. A garage or carport opening directly upon a side street shall be
located not less than twenty (20) feet from the street side lot line,
C. The required off -street parking shall be paved."
Section 10, That Section 9250.3.7 be amended to read as follows:
"9250.3,7. DRIVEWAY,
A. A paVed driveway shall be provided to the required parking areas,
B. Said driveway shall have not less than ten (to) feet of
unobstructed vertical clearance.
C, Said driveway shall not exceed a maximum slope of ten (10)
percent,
Section 11. That section 9251.2.6 be amended to read as follows:
"9251.2.6. REAR YARD. There shall be a rear yard of not less than thirty-
five (35) feet.
Section 12. That Section 9252,2,5. be amended to read as follows:
"9252.2.5, REAR YARD. There shall be a rear yard of not less than twenty-
five (25) feet. Any two (2) story portion of a dwelling shall have a rear yard
setback of not less than thirty-five (35) feet.
Section 13.. APPLICATION OF ORDINANCE REQUIREMENTS,
a, To assure fairness and predictability for the processing of projects pending the
effective date of this Ordinance, to minimize the cost effect on pending projects and to
provide an orderly and expeditious transition for the benefit of the public by avoiding the
abrupt denial of building permits for submitted but unapproved plans as subject

ordinance takes effect, subsection b (below) shall apply to provide a reasonable transition
for application of this Ordinance.
b. The new (revised) requirements of the City of Arcadia as set forth in ordinance
No, 1551 shall not apply to projects and developments (new homes and additions or
alterations to existing homes) for which proper plans have been submitted to the City
Building Department or a Homeowner Association Architectural Review Board on or
before midnight April 5, 19M.
Section 14, The City Clerk shall certify to the adoption of this ordinance and shall
cause a copy of the same to be published in the official newspaper of said City within
fi{~n (15) days after its adoption.
