HomeMy WebLinkAbout1887 ORDINANCE NO, 1887 AN ORDINANCE OF THE CITY OF ARCADIA ESTABLISHING MINIMUM LOT WIDTHS ON CORNER LOTS IN THE R-1 AND R-M ZONES; AMENDING SECTION 9113,6 RELATING TO MODIFICATIONS ON TENTATIVE MAPS AND TENTATIVE PARCEL MAPS; AND AMENDING SECTION 9115.12 RELATING TO TIME EXTENSIONS FOR TENTATIVE MAPS WHEREAS, Text Amendment 88-001 was initiated by the City for the consideration of (1) establishing a minimum lot width of 85'-0" for R-1 and R-M zoned comer lots fronting on a new street or reverse comer lots; (2) amending Section 9113.6 relating to modifications on tentative maps and tentative parcel maps to provide for approval by the Planning Commission; and (3) amending Section 9115.12 relating to time extensions for tentative maps to be consistent with the State Subdivision Map Act. WHEREAS, a public hearing was held on May 24, 1988 before the Planning Commission at which time all interested persons were given full opportunity to be heard and to present evidence, and WHEREAS, the Planning Commission of the City of Arcadia recommended approval of subject text amendment to the City Council, and WHEREAS, the City Council conducted a public hearing concerning the text amendment on June 21, 1988 and approved the amendment. WHEREAS, the City Council determines that: (1) increasing the minimum lot width on corner lots to 85'-0" will create lots which will provide larger building envelopes, especially in those areas where the new lot has frontage on an existing street with a special setback; (2) changing the authority to allow the Planning Commission to approve modifications on Tentative Maps and Tentative Parcel Maps will be consistent with the authority granted to the commission in processing other planning applications; and (3) amending the time frame for extensions on Tentative Maps will provide consistency with the State Subdivision Map Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the following wording be added to Sections 9113.3 and 9113.4 of the Subdivision Ordinance: "Exception: In the R-M and R-1 zones, corner lots fronting on a new street, or reverse corner lots shall have a minimum lot width of 85'-0"." -1- 1887 Section 2. That Section 9113.6 be amended to read as follows: "Section 9113.6. MODIFICATIONS, The Planning Commission, in the exercise of sound reasonable judgment after proof of necessity therefor has been presented and after a finding by a majority of the members of the Com- mission entered on the Commission minutes that a modification to the requirements of this Division is necessary by reason of the size, shape, topo- graphy or other conditions of the property within the subdivision or of adjacent property, may, by majority vote grant such modifications to this Division as are not prohibited by the Subdivision Map Act and as are not inconsistent with the General Plan." Section 3. That Section 9115,12 be amended to read: "9115.12. EXTENSION. Upon application of the subdivider, filed prior to the expiration of the approved or conditionally approved Tentative Map, the time at which such map expires may be extended by the Planning Com- mission for a period or periods not exceeding a total of twelve (12) months beyond the initial expiration day, Before accepting for filing an application for an extension, the City shall charge and collect a fee which shall be paid in an amount established by resolution of the City Counci1." Section 4.
