AN ORD:mANCE OF THE CITY COUJlCIL OF THE CITY OF ARCADIA AMElilDING OBDINAHCE NO. l70 OF SAID CITY OF ARCADIA, APPROV- ED MAROH 3. 1926. PURSUANT TO THE PROVISIONS OF SECTION 4 THEREOF. THE CITY COUJlCIL OF THE CITY OF ARCADIA DQ . ORDAIN AS FOLLOWS: SECTION 1: An applioation signed by Anita M. Baldwin haVing heretofore bean filed in the offioe of the City Planning COmmission, pursuant to Section 4 of Ordinanoe No. l70,entitled "An Ordinance of the Oi ty of Aroadia, California. Providing for the Establishment or Ereotion in said City of Seven Zones Con- sisting of Various Distriots and Presoribing the Olass of Build- e' ings, Structures, Improvements and Oooupancy in Said Seven Zones and the Use Thereof; The Peroentage of Area that May Be Covered by Improvements and the Height to whioh Buildings may. be Ereoted; Defining the Terms Used Therein and Prescribing the Penalties for the Violation of the Provisions Thereof". asking that exception be made affecting the property in said applioation and setting forth the specific reasons therefor and the oiroumatanoes in oonnection therewith, and reoommendation having bean made by the Planning Oommission to this Council, and a full investigation having bean made and oonsideration of the facts having been made by this Counoil, bearing upon such applio~tion; this Counoil de- termines that the granting of the request made therein will not be materially detrimental to the publio welfare or injurious to the property or improvements within the zone and distriot within which said property is looated, and will not be inoonsistent with the.general purpose of the said Ordinance No. 170, and that unless such requsst is granted, substantial property rights of the applioant will be curtailed. and that this Counoil therefor excepts from the provisions of Zone A of Ordinance No. 170 -1- ". ~ ,zO/ ---:.-..______- '___ - '---..J '- - . -------- -- --------- ,. ~ +-- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 of the City of Aroadia, the property hereinafter desoribed, but only so far as such exception is neoessary to permit the follow- ing desoribed property, to-wit: That portion of Lot 6 of Tract 949, in the City of Aroadia, County of Los Angeles, State of California, as per map recorded in Book 17, Page 13 of Maps, in the offioe of the Oounty Recorder of said Oounty,-de- soribed as follows: Beginning at a point in the southeasterly line of said Lot 6 distant thereon S 38 deg. 33' West 163.93 feet from the most easterly corner thereof; thence along said southeasterly line S 38 deg. 33' W 671.68 feet; thence N 61 deg. 27' W 607.71 feet to the southeasterly line of Huntington Drive as described in the deed to the Oity of Arcadia, recorded in Book 9396, Page 146 Official Records of said County; thence north- easterly, south and east along said southeasterly and . south lines of said Huntington Drive to a line which bears N 61 deg. 27' W and passes through the point of beginning; thence along said last mentioned line S 61 deg. 27' E 126.49 feet to the point of beginning. Oontaining 6.00 Acres more or less, . to be used for the purpose of oonstructing and maintaining a building or buildings to be used and oocupied as: (a) A museum, art gallery and for the purpose of hold- ing and oonducting exhibitions thereof or in connection therewith; (b) Ohildren's pony ring; . - (c) F.or the purpose of oonducting a trading post, provided, the business conducted at or in said trading post shall be limited to curios, Objects of.art or objects of a historical or antique, unique, or novel cheracter; (d) Studios for artists, architects and photographers; (e) A lunch room or cafe, provided that said lunoh room or cafe shall be maintained and conducted in conjunction with the museum, except that the time or periods of the use and oper- ation of said lunch room or oafe need not be ,governed or controlle by the time or periods of opening, suspension of exhibiting, or closing said museum; provided, that in the event that said museum is not operated or is closed for a continuous period of ninety (90) days, in any one year, then the rights and privileges of oonducting a lunch room or cafe shall terminate and cease. -2- O/ld 30/ .- -...:::;: ...........--> ---- ------ 1 2 This exception is granted upon the following conditions . (A) That no building permit be granted for the con- 3 struction or erection of any building upon said property, unless 4 the plans and specifications be first submitted to the Building 5 Inspector 9f the City of Arcadia, and that said plans and speci- 6 fications and said building or buildings shall, in all part iou- 7 lars, comply with the building ordinances and sanitary regula- 8 tionB of the City of Arcadia. 9 (B) That said building or buildings shall be completed 10 within a period of six (6) months from and after the foundation 11 of any building or buildings has been laid. 12 (C) That said property shall not at any time be used 13 for any purpose or purposes not specified in this Ordinance. 14 (D) The rights or privileges granted by this Ordinance 15 are granted and accepted by the persons affected thereby upon the 16 express condition that no building or bUildings of any kind or 17 oharacter shall be constructed or located on the southerly side 18 of. said Huntington Drive in said City of Aroadia, distant 75 feet 19 southerly from and parallel to the center line of said Huntington 20 Drive. 21 (E) That in case any of the provisions of this Ordi- 22 nance are violated the property above desoribed in this Ordinance 23 shall revert to Zone A of Ordinanoe No. 170, and the rights and 24 privileges herein granted shall terminate and aease, in the event 25 that any such violation is not terminated within thirty days, or 26 such further time as the City Council may decide that the owner 27 of said property, in the exeroise of due diligence, requires to 28 oorrect such violation, after the owner of said property has been 29 given written notice by the Oity Council of such violation. 30 SECTION 2: The Oity Clerk shall certifY to the 31 adoption of this Ordinance and cause the same to be published 32 once in the Aroadia Tribune, a weekly newspaper published and -3- cJ/lC.J: e:Y () j .r \.1 - ""......~ --,. 1 oiroulated in said City of Aroadia. and thirty days from and 2 thereafter the same shall take effeot and be in foroe. 3 I hereby oerti~ that the foregoing Ordinanoe was an Adjourned 4 adopted at/a regular meeting of the Oity Council of the City of 5 Aroadia held on the 27th day of November , . 1934. 6 by the affirmativa vote of at least three oouncilmen, to-wit: 7 8 9 10 11 12 13 14 .signed and approved this 27th day of AYES: Councilmen,Oorby, Daniels, Hoffman, Krebs and MoLean.
