7 THE CITY COUNCIL OF THE CITY OF ARCADIA DO ORDAIN AS
ORDINANCE NO. 305.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AR-
CADIA REGULATING AND LICENSING THE BUSINESS OF CARRYING PASS-
ENGERS FOR HIRE IN MOTOR VEHICLES IN THE CITY OF ARCADIA; AND
REGULATING AND LICENSING CHAUFFEURS AND PROVIDING A PENALTY FOR
THE VIOLATION THEREOF.

SECTION 1:
The term '.'Owner" aB uBed in this Ordi-
10 nance, includ~B every person, firm or oorporation having UBe or
11 oontrol of, or right to use or oontrol any passenger-carrying
12 automobile, or motor propelled vehicle, as herein defined, under
13 o\~ership, lease or otherwise.
14 :J.'he termB "Driver" or "Chauffeur" as used in thiB
15 Ordinance inoludes every perBon in charge of or operating any
16 paBBenger-oarrying or motor propelled vehicle, aB herein defined,
17 either as agent, employee, or otherwise, under the direction of
18 the owner, as herein defined.
19 The term "Taxicab" as uBed in this Ordinance shall
20 mean every automobile or motor propelled vehicle used for the
21 transportation of paBsengers over the public streets of the City
22 of Arcadia, for compensation, and irrespeotive of whether the
23 operations extend beyond the boundary limitB of said City, at
24 rates for diBtanoe traveled or for waiting time, or for both.
SECTION 2:
It Shall be unla\vful for any owner to en-
gage in the businesB of operating any of the vehicleB defined in
Seotion 1 of this Ordinance without first having obtained a per-
mit in \vriting from the City Council so to do. - Applicants for
Buch permits shall file with the City Counoil an applioation upon
blanks furniBhed by the City Council oontaining suoh information
as the City Council may require.

The applioation shall Bhow that the owner haB secured
and paid in advance the annual premium upon an inBurance policy,
whereby the owner and the driver of eaoh of the taxicabs which
the owner will operate in the City of Arcadia are insured against
liability for injury to any person aB the result of the owner-
Bhip, operation, or use thereof; the maximum liability limits
upon eaoh taxioab being not lesB than Ten ~~ousand ($10,000)
Dollars for personal injury to anyone person, and Twenty
Thousand ($20,000) DollarB for perBonal injurieB reBulting to
two or more perBons in anyone aocident; for the indury to or
destruction of property in anyone accident, One Thousand ($l,OOO)
Dollars.
No permit shall be granted to any perBon, firm or
oorporation to engage in the businesB of operating any of the
above mentioned vehioles other than those in operation at time
of adoption of this Ordinance, until it haB been Bhovm to the
City Counoil'B satisfaotion that public oonvenience and neoessity
require the operation of suoh vehioleB; provided, that no permit
shall be issued to any perBon, firm or corporation whose oolor
soheme, name, monogram or insignia to be used on such oars shall
be in confliot with, or in the opinion of the City Counoil,
imitate any other oolor Boheme, monogram, name or inBignia uBed
by another ooncern in Buch manner aB to be misleading or tend to
deoeive or defraud the public. And no permittee shall use or
employ on his cars more than two different color schemes, or any
oolor soheme different or other than those described in its
applioation for a permit. The permits herein mentioned shall en-
title the holder thereof to obtain a license to engage in the
busineBB desoribed in said permit from the City Clerk upon paymen
of the lioense fee, at the rate of Twelve Dollars ($l2.00) per
year per oar therefor, payable in advance, and said City Clerk
shall iSBue to the holder of such permit a license setting forth

the kind of transportation for whioh such lioenBe iB issued and
the year when issued; said permit shall be filed with the City
Clerk.
SECTION 3: It shall be unlawful for any person to
drive, operate or be in oharge of any taxioab or automobile for
hire without firBt having obtained a permit in writing, so to do,
from the Chief of Police, of the City of Arcadia. Before any
permit is granted, the applioant therefor Bhall file with the
Chief of Police an applioation in writing, on blanks to be fur-
niBhed by the City containing suoh information as the Chief of
Polioe may require. Every such permit granted shall be filed
with the Chief of Polioe and upon payment to him of the Bum of
Two ($2.00) Dollars, he may iBsue to the holder a permit card
printed thereon, "TAXICAB CHAUFFEUR NO. , ARCADIA,
CALIFORNIA, NAME " .
SECTION 4: The Chief of Polioe shall have power to
grant the permits mentioned in Section 3 to persons who have oom-
plied with the provisionB of thiB Ordinance and any ruleB and
regulationB adopted by the City Council of said City of Arcadia,
and he Bhall alBo have the power to Buspend or revoke any permit
for failure, neglect or refuBal of any such person to comply with
the Ordinance of the City of Arcadia, or any rule or regulation
of Baid City Counoil.
SECTION 5: All ohauffeurs and owners of automobiles
for hire as defined by thiB Ordinanoe, Shall be governed by the
following rules and regulationB until modified, amended or re-
pealed by the City Council of the City of Aroadia:
(a) All applioationB for chauffeurB' permits will be
oonBidered by the Chief of Polioe, and either granted or denied
within thirty days, unleBs for good cause time for consideration
is extended.
(b) No permit will be granted to a ohauffeur of an

automobile for hire who is not an Amerioan citizen. Neither ITill
any Buch permit be granted to anyone in the diBcretion of the
Chief of Police who is not ~hysically qualified or who has not a
proper understanding of the English language.
(c) All permits granted shall expire at the end of
the Fiscal year and must be renewed before the 15th day of July
of eaoh year, unless sooner revoked.
(d) All owners will be held striotly aocountable by
the City Council to see that ohauffeurs employed by them are duly
lioenBed by having identification cardB issued by authority of
the Chief of Police of the City of Aroadia.
(el All chauffeurs will be required to pass suoh
examination as may be deemed necesBary aB to their knowledge and
understanding of the City Council's Rules, State Motor Vehicle
Act, City Ordinance and Traffic Regulations.
(f) All chauffeurs must present state chauffeur'B
badge, as required by the Uotor Vehicle Act, as a oondition
precedent to obtaining a permit.
(gl Transfer of ohauffeur's permit from one ohauffeur
to another is strictly prohibited and will be considered suffic-
ient oaUBe for the immediate revocation of the permit of the
chauffeur at fault.
(h) ChauffeurB Bhall at all times while operating any
vehiole for hire, carry the permit card issued hereunder, and
Bhall exhibit the same when requested to do so by any police
officer of the City of Arcadia.
(i) No chauffeur of any vehiole mentioned herein sha1
Bmoke any cigar, pipe, oigarette or burn tobacco, while'paBsenger
are oocupying any of the Beats of such vehiole.
(j) No operator of any vehicle hereunder shall carry
any passeDger in the driver's seat or compartment while there is
room for Buch passenger in the rear seat or passenger'B compart-

(k) All ownere and chauffeurs, shall obtain from the
3 Chief of Police of the City of Arcadia, a metal plate, whioh
4 pl&te shall be two and one-half (2t) inohes long and one (1)
5 inoh wide, and shall have Btamped upon it "Arcadia Permit

oue plaoe upon the front end of the automobile.
SECTION 6:
The Chief of Police will from time to
time, inveBtigate all oomplaints as to unfairneBS or disorimi-
nation in fares or chargeB or discourteous treatment of pass en-
gers; and any illegal or unreasonable charge or aot or discour-
tesy will be oonsidered cause for revocation of the permit of
the owner and chauffeur~ or either, at fault.
SECTION 7:
Any owner or ohauffeur may appeal to
the City Council of the City of Aroadia from any aot or action
taken by the Chief of Polioe affecting any matter in whioh the
party appealing haB an interest or is affected.

That any person, firm or corporation

violating any of the provisions of this Ordinance shall be deemed
guilty of a miBdemeanor and upon a conviction therefor shall be
puniBhable by fine not exoeeding the Bum of Three Hundred ($300)
Dollars, or by impriBonment in the City Jail of the City of
Aroadia or in the County Jail of the County of Los Angeles, at
the discretion of the committing magistrate, for a period not
exceeding three (3) monthB, or by both Buch fine and imprisonment.
SECTION 9:
The City Clerk shall certify to the adop-
tion of this Ordinanoe and shall cause the same to be published
onoe in the Arcadia Tribune, a weekly newspaper published and

1 oirculated in the City of Arcadia, and thirty daYB therefrom and
2 thereafter the same Bhall take effeot and be in force.
3 I hereby oertify that the foregoing Ordinanoe was
4 adopted at a regular meeting of the City Counoil of the City of
5 Aroadia, held on the 15th day of
January
