' ESTABLISHING A ,DISTRICT NORTH OF FOOTHILL BOULEVARD AS A FIRE HAZARD, PROVIDING FOR INCINERATORS IN RESIDENTIAL DISTRICTS, RE- PEALING ORDINANCES NOS. l20, 154, 199 AND ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. 6 7 8 9 10 11 THE CITY COUNCIL OF THE CITY OF ARCADIA DO ORDAIN AS FOLLOWS: :-. ; SECTION 1: That Ordinance No, 120 of the City of 12 Aroadia entitled, "An Ordinance of the Board of TrusteeB of t'he 13 City of Arcadia regulating the burning of brush, rubbiBh or 14 other materials within Baid City and for the proteotion of fire 15 hose, fire apparatus and the water system of Baid City, and pro- 16 hibiting the taking of water without permission of said water 17 system", approved April 18, 1923, be and the same iB hereby 18 repealed. 19 SECTION 2: That Ordinance No. l54 of the City of 20 Aroadia entitled, "An Ordinanoe of the Board of Trustees of the 21 City of Aroadia relating to fire protection and prevention", 22 approved May 6, 1925, be and the same is hereby repealed. 23 24 25 26 27 28 SECTION 3: That Ordinance No. 199 of the City of Aroadia entitled, "An Ordinance of the Board of Trustees of the City of Aroadia amending Seotion 128 of Ordinance No. 81 and alBo amending Seotion 7 of Ordinance No. 154 of Baid City of Aroadia", approved May l8, 1927, be and the Bame is hereby repealed. 29 SECTION 4: That all OrdinanceB or partB of ordinances 30 in conflict with thiB Ordinance, be and the same are hereby re- 31 peal ed. 32 SECTION 5: That the offioe of Chief of the Arcadia -1- a~-d 3.<3' \ 1 City Fire Department is hereby oreated and eBtabliBhed. 2 SECTION 6: The Chief of the Aroadia City Fire Depart- 3 ment shall be appointed by the City Council of the City of Aroadia 4 and Bhall hold offioe at the pleasure of the City Council; the 5 City Counoil shall alBo fix theoompensation of the Chief of the 6 Fire Department. 7 SECTION 7: Fire Marshal. If no appointment iB made 8 to the offioe of Fire Marshal, the Chief of the Fire Department 9 of the City of Arcadia shall be ex-offioio Fire MarBhal and Bhall 10 perform all the duties, and be vested with all the powers of such 11 Fire MarBhal, 12 13 REPEALED 58 SECTION 8: ORD. No. 1 of the Fire Department Authority to Appoint Deputies. The Chief shall have authority to appoint Deputies, 14 Buch appointments being subjeot to the approval of the City Coun- 15 oil. The Deputies shall be BUbjeot to removal either by the 16 Chief of the Fire Department or by the City Counoil. 17 SECT ION 9: Duties of the Chief of the Fire Department. 18 It Bhall be the duty of the Chief of the Fire Department and his 19 deputies to enforoe the proviBions of th1B Ordinanoe and all other 20 ordinances of the City of Arcadia for fire pro,tection or fire 21 prevention; to report to the City Council any conditions existing 22 within the corporate limits of the City of Arcadia likely to oause 23 destruction of life or property by fire and make reoommendations 24 to the City Counoil'how to remedy the same. 25 REPEALED SECTION 10: Authority to Enter Upon Premises. The ORO. No. 7.:r.? 26 Chief of the Fire Department and his deputies shall have the right 27 to enter upon any premises within the corporate limitB of the 28 City of Aroadia at all reasonable hOurB for the purpose of in- 29 Bpecting the premiseB for fire riskB or fire hazardB existing 30 thereon or therein. 31 SECTION ll: Firemen Badges. It shall be unlawful for 32 any person to wear, oarry, display, or have in his pOBsession, any -2- cd 3.<70' " 1 fireman's badge, unlesB suoh person belongB to and is a member of 2 the Fire Department, or has been given the authority to oarry, or 3 have in hiB posBeBsion, such badge. 4 SECTION 12: Right-of-Way. It shall be unlawful for ;; any pEll:'BOn to park, or drive any automobile or other vehiole in 6 any Btreet or alley within Bix hundred (600) feet of any burning 7 building or, other burning Btruoture; or to park any vehicle with- 8 in fifteen (15) feet of any fire hydrant at any time, 9 The Fire Department, firemen and their apparatus of all 10 kindB and publio offioials of the City of Aroadia, when gOing to 11 or on duty at a fire, or responding to calls or alarms, shall have 12 the right-of-way over all other persons and vehioleB of all kinds, 13 on any street or through any prooeBsion. It Bhall be unlawful ~or 14 the driver of any vehicle in or upon any street in the City, or an 15 perBon 'stand 1ng or walking in any Buch Btreet, to refuBe Or 16 negleot to allow the right-of-way to any fireman or apparatus of 17 the Fire Department, when the same is going to or on duty at a 18 fire. 19 Upon the approach of any apparatuB of the Fire Depart- 20 mant, the driver of any vehicle in or upon any street Bhall im- 21 mediately stop Buch veh~ole, aB near as posBible to the right 22 hand ourb of such street, and it shall be unlawful for any Buch 23 driver to oause or permit suoh vehiole to be moved until such 24 apparatus shall have passed such vehicl e not leBs than five 25 hundred (500) feet. It Bhall be unlawful 26 27 corporation to run or oonduct any animal 28 or vehiole over, upon or againBt any fire hOBe, or to tamper or 29 interfere with any fire apparatus of the City of Arcadia, 30 SECTION l4: Driving or Parking Near Fire. Tha tit 31 Bhall be unlawful for any person, other than the members of the 32 Fire Department or Polioe Department of said City of Arcadia, to -3- cJd 3.:<0' \ 1 drive or park any vehiole wi thin 500 feet 0 f the location 0 f any 2 fire to whioh the Fire Department has been sUmmoned; provided 3 however, that all persons Bhall have reaBonable opportunity to 4 drive out of the area affected thereby, and while BO driving out 5 shall not be deemed to be in violation hereof, There is also G excepted from the operation hereof, any ambulanoe or person en- 7 tering the area affeoted hereby for the purpose of saving life or 8 property or preventing or relieving injury to perBonB. 9 SECTION l5: Fire HydrantB. It Bhall be unlawful for 10 any person to break, tap, open or in any way inj~e any fire 11 hydrant, water main, pipe, oonduit, or reservoir in the City of 12 Aroadia, without permiBsion to do BO from the Chi ef of the Fire 13 Department and the ~ater Superintendent. 14 SECTION 16: Drawin~ Water from Fire Hydrants. It 15 shall be unlawful for any perBon; firm, or oorporation, to draw, 16 or take or cause to be drawn or taken, any water from any fire 17 hydrant, water main, pipe, conduit or reBervoir, or caUBe any 18 water to flow therefrom, without firBt obtaining a permit in 19 writing from the Chief of the Fire Department and Water Superin- 20 tendent; provided, however, that the proviBions of this Section 21 shall not apply to the offioers or employeeB of the City of Ar- 22 oadia, when taking water from any Buch hydrant, water main or 23 pipe, cOl).duit or reservoir for munioipal purp10ses or to users of 24 Buoh water in the regular oourse, 25 RE~EAlEll 7 ~g SECTION l7: Aooumulation of Combustible RubbiBh. ORD, No. '7 It shall be unlawful for any person, firm or corporation to keep or to caUBe or permit to be kept, any explosive or inflammable oompound or oombustible material of any kind near any doorway or Btairway of any building, in such plaoe or manner aB to obstruot Buch doorway or Btairway or render egress hazardous in caBe of fire.
