ADV~TIS E1IENTS UPON THE STREETS OR l'RO.P.GRTY OF mE RESIDmTS OF THE CITY OF ARCADIA AND REPEAL- ING ORDINANCE NO. 210 OF THE SAli) CITY OF ARCADIA AND ALL ORDINANCES OR PllRTS OF ORDINANCES IN CONFLICT HEREWITH", ADOPrED MARCH 6, 1929, BY ADDING niERE'l'0 A NEW SECTION TO BE NUMBERED S~CTION 3-A. THE CITY COUNCIL OF THE CITY OF ARCADIA DO ORDAIN AS FOLLOWS': i SECTION 1 - That Ordinance No. 225 of the City Council of the City of Arcadia entitled, "An Ordinance of the City Council of the City of Arcadia regulating the distribution of advertising samples, handbills, dodgers, ci,irculars, booklets and other notioes of advertisements upon the streets or property of the residents of the City of Arcadia and repealing Ordinance No. 210 of the said City of Aroadia aDd all ordinances or parts of ordinances in oon- flict herewith", adopted MarCh 6, 1929, be and the same is hereby amended by adding thereto a new section to be known and numbered Section 3-A and to read as follows: SECTION 3-A - That it shall be unlawful for any person, firm or corporation to distribute, cause or permit to be distri- buted, give away, give to any person, hand to any person, offer to give, hand to or sell to any person to or among pedestrians, ocoupants of automobiles, or to place in any automobile, or upon any automobile or any part thereof, or any other vehiole or any part thereof, whether parked, standing, moving or otherwise, along or upon any publio street, parkw~, alley, oourt, public park, playground or other public place or upon any private driveway, private yard, private lawn, private road, private walk or private sidewalk, or upon any vacant lot or vaoant property in the City of Arcadia, any tip sheet, dope sheet, dodger, handbill, ciroular, booklet, or any other pr inted or written advertising, pertaining to any horse race, choioe of horse, horses, recommending any -1- c:Jd 30.9'0 horse or horses; or giving or conveying any information about any horse, horse race or oontest of endurance or speed between horses, or beasts; or giving, conveying or advertising any plaoe, person, firm or oorporat ion or telephone number where any matter, thing or aot prohibited by this Ordinance may be obtained, had or acquired. Providing, that nothing in this Ordinance shall prohibit the sale, distribution or delivery of newspapers of general oir- culation as defined by Sections 4460 ani 4462 of the Political Code of the state of California. SECTION 2 - That any person, firm or corporation violating any of the provisions. of this Ordinance shall be deemed guilty of a m1a.demeanor aDd upon oonviction thereof shall be puniahable by a fine not exceeding Three Hundred 1~300.00) Dollars \\t\'f}I\.lO or by imprisonment in the City Jail of the said City of Arcadia 0\\0. ~g or in the County Jail of the Count y of Loa Ane; ele a, State of ~(p California, at the discretion of the co=ittiog JIl9.gistrate for a term not exceeding three 131 months, or by both such fine and imp:risonment. SECTION 3 - This Ordinance is declared to be an \\t\'v.\.i.Il 6\\9. ~ 3l..~ urgency measure necessazy for the immediate preservation of the public peace, health and safety, and the facts which constitute such neoessity are as follows: Due to the opening of the Santa Anita Race Track, many persons, vagrants, unscrupulous persons and persons with di vers schemes to defraud th e gene ral public have ado pt ed the praotice of causing to be printed dodgers, pamphlets, circulars and other advertising matter, and placing themselves upon the streets of the City of Arcadia and in public places in the City of Arcadia, and distribute, hand out or give away the dodgers, pamphlets, circulars and handbilla, and throw the same into passing automobiles and into automobiles which are coming out of the race track enclosure; oftentimes, blocking the traffic, annoying persons in automobiles and endangering the lives of '. SECTION 4 - The City Clerk shall certify to the adop- tion of this Ordinance and shall CBUse the same to be published once in the Arcadia Trihune. a weekly newspaper published and circulated in the City of Arcadia. and thereupon and thereafter "'\.~ ,,~ "0- - ~v~ the same shall take effect and be in force. adopted I hereby certify that the foregoing Ordinance was 44/01.101......
