AN ORDINANCE OF THE CITY COUNCIL 0]' THE CIT"i OF ARCADIA AMENDING ORDINANCE NO. 170 OF SAID CITY OF ARCADIA, APPROVED MARCH 3, 1926, PURSUANT TO THE PROVIS lOllS CF SECTION. 4 THEREOF. THE CITY COUNCIL O.l!' THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1: An application signed by the Citizens National Bank of Los Angeles and Carl ~. Thomas having heretofore been filed in the office of the City Planning Commission, pursuant to Section 4 of Ordinance No. 170 entitled "An O.rdinance of the City of Arcadia, California, providing for the establishment or erection in said City of seven zones consisting of various districts and prescribing the class of buildings, structures, improvements and occupancy in said seven zones and the use thereof; the percentage of area that may be covered by improvements and the height to which buildings may be erected; defining the terms used therein and prescribing the penal- ties for the violation of the provisions thereof", asking that ex- ception be made affecting the prope rty in said application and set- ting forth the specific reasons therefor and the circumstanoes in , connection therewith, and recommendation having been made .by the Planning Commission to this Coun011, and a full investigation having been made and oonsideration of the facts having been made by this Council bearing upon such application; this Council determines that the granting of the request made therein will not be materially detrimental to the publio welfare or injurious to the property or improvements within the zones and districts within which said pro- perty is located, and will not be inconsistent wi th the general pur- pose of said Ordinance No. 170, and. that unless such request is granted, substantial property rights of the applicants will be cur- tailed, and that this Council therefore excepts from the provisions of Zones A, B and C of Ordinance No. 170 of the City of Aroadia, the property hereinafter described, but only so far as such exception -1- . CAd ssS- is necessary to permit the following described property,. to-wit: That portion of Lot 6 of Tract No. 948 in the City of Arcadia, County of Los Angeles, State of Cali- fornia, a6 per map recorded in Book 17, Page 21 of Maps in the office of the County Recorder of said County, described as follows: Beginning at a point in the West lins of Santa Anita Avenue 387.79 feet North of the most Southerly cor- ner of Lot 6, Tract No. 948; thence North 315 feet along the Westerly line of Santa Anita Avenue; thence West 885.63 feet to the Northerly line of the Atohison Topeka Santa Fe right of way; thence South 51 deg. 34' 00" East 506.75 feet to the Northerly line of Colorado Boulevard; thence East 488.68 feet along said Northerly line of Colorado Boulevard to the point of beginning; all being more or less, - to be used for the purpose of constructing and maintaining a build- ing or buildings to be used and occupied as: (a). A residence; (b) A restaurant; (c) Poultry and f~wl raising; (d) Bakery goods, meats, groceries, farm products, dairy products, a modern food market, hardware and flower stores; (e) Soft drinks and soda fountain service, tobacco, cJ cigarettes, postcards, candy, live and dressed poultry, souvenirs. This except ion is granted upon the follow 1ng conditions.: (a) That no building permit be granted for the construc- tion or erection of any building upon said ~operty, unless the plans and specifications be first submitted to the Building Inspeo- tor of the City of Arcadia, and that said plans and specifications and said build.1 ng or buildings shall, in all particulars ,comply with the building ordinances and sanitary regulations of the City of Arcadia. (b) That said ~operty shall not at any time be used for. any purpose or purposes not specified in this ordinance. (c) That there shall not at any time be sold, stored, held for sale nor held for any other purpose, any intoxicating liquors, beer or any other intoxicating beverages, upon said property. (d) That no dancing, gambling, race track bookmaking or -2- cd. 3$~ " raoe track lookout shall ever be permitted, conducted or allowed upon said property or any Pl-rt thereof, (e) That in oase any of the provisions of this Ordinanoe are violated, the property above desoribed in this Ordinance shall revert to Zones A, Band C of Ordinance No, 170, and the rights and privileges herein granted and the privileges granted by Ordinance No, 170, Zones A, B and C thereof, shall terminate and cease. SECTION 2: The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once in the Arcadia Tribune, a daily newspaper published and circulated in said City of Arcadia, and thirty days therefrom and thereafter the same shall take effect and be in force. I hereby certify that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Aroadia held on the 21st da;v of JUly , 1936, by the affirmative vote of at least three councilmen, to-wit: AYES: Councilmen, Corby, Daniels, Griffitts and McLean.
