SEC'l'ION 2: That no water shall be furnished to any consumer or rate payer by the Arcadia ~ater Department, whsther for domestic or irrigating pur pos es, except where the water so furnis hed is ~ metered. Consumers and rate payers shall be held responsible and charged for all water passing through their meters. -1- t:lJ ;yy~ SECTION 3: When a consumer rents an irrigation meter from the Arcadia Water Department, to be installed for the purpose of measuring irrigation water, an addit ional charge shall be made and collected as follows: For installing, locking and unlocking, up to and including a two-inch meter for measuring each run of irrigating water of a forty- eight hour run or less ~1.00; for installing, locking and unlocking from a two-inch to a four-inch meter for measuring each run of irri- gating water of a forty-eight hour run or less ~1.50. An owner who shall cause his own irrigation meter to be installed, shall maintain the meter in such condition that said meter shall measure accurately all water passing through it. Said meter shall be at all times subject to inspection and approval by the Water Department of said City of Arcadia. Irrigation meters owned by con- surners shall be considered to be in the possession of the Arcadia Water Department as a pledge for prompt payment of all water rates due. SECTION 4: All meters installed by the Arcadia Water De- partment, after the effective date of this Ordinance, shall be of a type first approved by the Superintendent of the Water Department. SECTION 5: If the amounts of any bill rendered for water furnished for domestic or irrigating use Shall not be an exact multiple bf five cents, such bill shall be reduced or increased to the next nearest multiple of five cents. SECT! ON 6: For water furnished for the construction of streets, the following charges shall be made and collected: a. For pavement, for each 100 lineal feet b. No. 7.s- 'I 1~.3 ~ SECTION 7: In case a house becomes vaoant the regular minimum rate shall be charged and.collected from the owner thereof, whether water is used or not, unless the Water Department is notified, in writing, of the fact that the property is unoccupied and requ~sted to cut off water therefrom. SECTION 8: The Superintendent of the Water Department shall have the power in his discretion to adjust complaints and, in the event of any dispute as to the water bill rendered to be paid by any consumer or rate payer, he shall determine the s~me, subject to the approval of the City Council. SECTION 9: Tha t where a rmter fails to register during any period, a charge will be made, based upon an average of the water con- sumed during the same month of the -previous year; in the event that a meter has not been installed for a period of one year, then an average daily consumption of such peri.cd as said meter shall have been regis- tering, or the nearest month when the meter was registering. SECTION 10: The City Council of the City of Arcadia re- serves the right in its discretion to grant rebates from the rates in this Ordinance specified to charitable institutions and indigent per- sons. For water furnished for public works declared by resolution of the City Council to be of sufficient benefit to warrant a special rate for a specified period, the City Council may specify the rate to be charged in said resolution. SECTION 11: That it shall be unlawful for any person, firm or corporation, to take, appropriate or draw any water from any water main, circulating lin~ or any part of the water system of the City of Arcadia without first making application to the Water Department of the City of Arcadia, and without permission of the Superintendent of the Water Department. Meters over 4 inches in size shall be installed by the Arcadia Water Department, at the expense of the consumer on a cost basis which shall include the cost of installation and the cost of the meter and AMENDED ORD. SECTION 13: All services and water meters installed by the Arcadia Water Department, after the effective date of this Ordinance, except irrigation meters when paid for by irrigation consumers, shall become and remain a part of the Arcadia Water System. and shall remain -4- c~ 3Y:T at all times the property of the City of Arcadia and shall be main- tained, repaired and renewed by the Water Department when rendered unserviceable through. reasonable wear and tear;. that where replace- ments, repairs or adjustments are rendered necessary by the act, negligence or carelessness of the consumer or any member of his family or person in his employ, or any person by direction or consent of the oonsumer, any expense caused to the City of Arcadia thereby shall be charged against and collected from the consumer. For the purpose of this Ordinance, an irrigation meter is hereby defined to be a 3 inoh meter or larger. SECTION 14: Before water shall be supplied to any person or to any premises from the said Arcadia water system the owner or occupant of the property shall make a written applioation for such service upon a form provided by said Ylater Department for that purpose at the office of the Water Department in the City Hall of said City, and which application shall contain the following information: (a) ~he name and address of the applicant. (b) A description of the real property to which said water is to be furnished and the name of the street upon which the property fronts and the official house number, if any, as assigned to the premises for which water is to be furnished. (c) Applicant's relation to the property, as owner, tenant, or otherwise. (d) ~he purpose for which said water is desired, whether for domestic purpos es or irrigation. (e) Size of connection desired. (f) Signature of applicant. SECTION 15: Such application shall contain a contract on the part of the applicant to pay the stipulated rates at the time and in the manner provided for in this Ordinance, reserving to said City of Aroadia the rjght to enforoe and collect rates and penalties in the mannsr provided for in this Ordinance; to change rates and to -5- tJd ~Y;:.J> temporarily disoontinue the service at any time without notice to the oonsumer, and further to provide that said Water Department shall not be responsible for any damage by water or otherwise re- sulting from defeotive plumbing, broken or faulty services or water mains, SECTION 16: The Aroadia" Water Department, as a oondition to granting suoh applioation and furnishing water to said premises is authorized and shall require a deposit as follows: A. From tenants for single family domestic meters, B, From rate payers of oourts and flats, for each AMEMOS>> unit, O\ID. *' C, From tenants for irrigation meters for each .5'...".1 aore of ground to be irrigated, $ 5.00; %\ 2.00; ~ 3,00. Deposit will be refunded when the services are disoontinued, provided all oharges to the applicant by the Water Department have been paid, otherwise applied on the aooount, SECTION 17: Meter rates are due and payable on the last day of eaoh month. Aooounts for meter rates beoome delinquent on the 15th day of eaoh calendar month following the month in whioh water is furnished and a penalty often per oent of the amount due shall be added to all meter. rates then unpaid. 'If the amount due for water together with the amount of such penalty be not paid on or before the 20th day of suoh oaleniar month following the month in whioh water is furnished, notioe in ~ writing shall be served upon the said delinquent oonsume.r personally 4vf or by mailing, postage prepaid, together with a statement of the amount due and delinquent, to his last known plaoe of residenoe, to the effect that if said delinquent account is not paid before the first of the following month, the water will be out off without further notioe, If the amount due together with such penalty is not paid on or before the first day of the following month, the water shall be shut off, until payment of the amount due is made, with the addition of ~1.00 -6- ~ 3' y;.r for the expense of turning the water off and on. SECTION 18: In addition to any other remedy provided for here- in for the enforcement and collection of any water rate, all water rates provided for in this Ordinance ~hall be charged against the real property upon which it is furnished and against the owner there- of and shall be a lien .against the premises to which any water may be supplied and a charge against the owner thereof and the occupant thereof using the water, and if for any cause any sums owing there- for become delinquent. the water shall be shut off and in no case shall it be turned on to the same property until all such delin- quencies shall have been paid in full and such property owner and occupant shall be severally responsible to the said City in an action waged by said City in any court of competent jurisdiction for the amount of all such water rates as may be due and unpaid, together with all penalties as herein specified and costs. No change of owner- ship or occupation shall affect the application of this Section. SECTION 19: The applicant having complied with all the requirements of this Ordinance relating to application for meter and service and having paid all charges incurred, the said \later Department shall cause the property described in said application to be connected with the water mains of said City in the manner following: Vfuere the property is located upon a street in which a water main of not less than four inches in diameter is laid, same shall be connected with said water system by a service pipe extending at right angles from the main to the curb line, a stop cock placed inside the line of. the street curb, with a meter-box and a gate valve on the property owner's side of the meter. SECTION 20: When water bill is rendered for two weeks or t.tAl"llal QR!l. "0. ..(.... \ less the consumer shall be charged one-half the regular monthly mini- mum charge for domestic and irrigation meter rates. SECTION 21: It shall be unlawful for any person, firm or corporation to cause a connection to be made or to allow a connection to exist for any purpose whatever between the Arcadia Water System and -7- c:::J~ ;J Y:;;T any other source of supply. SECTION 22: Should the occupant of any premises or.any person for him or on his behalf turn on water after it has been turned off at .the curb by the Water Department, the meter will be taken out and a charge of ~5.00 made in addition to all bills due before water shall be turned on. SECTION 23: That any consumer or rate payer may demand that the meter through whioh water is being furnished be examined aDd tested by said Water Department for the purpose of ascertaining whether or not it is registering correctly the amount of water which is being delivered through it. Such demand shall be made in writing to said Water Department and shall be accompanied by a deposit of ~1.00. Upon receipt of such demand it shall be the duty of the Water Department to cause the meter to be examined and tested, for the pur- pose of ascertaining whether or not it is registering correctly the amount of water being delivered through it. If on such examination and test the meter shall be found to register over two per cent (2%) more water than actually passes through it, another meter will be substituted therefor and the fee of $1.00 shall be repaid to the per- son making said application and the water bill for the current period (ourrent periOd is defined to be the two months immediately preceding the test by the Water Department) adjusted to and not to exceed a percentage equal to error shown in meter, otherwise, said deposit shall be retained by the Water Department and the water bill paid as rendered. SECTION 24: No bypass or connection between the meter and the main shall be made, maintained or permitted by any consumer, exc~pt such as may be installed by permission of said Water Department. SECTION 25: No consumer shall provide water regularly to any person, firm or corporation other than the occupant or occupants of the premises of said consumer, except where said parties cannot be reasonably connected with said water system. The question as to the reasonableness of said connection shall be determined by said Water -8- c:::td :J Y:?, 1iY.~~!rl lJ~ ~&t1 t. . Superintendnet, but unless sanctionsd by said City Council, no such delivery shall be made. SECTION 26: That where more than one family occupy the same premises independent of each other, each such family shall pay the minimum monthly rate as if oc cupying separate houses or premises and such other rates as may be specified in this Ordinance. SECTION 27: That in all cases in which water is served to premises occupied by two or more different and independent consumers of water, which said premis es are wholly held under t he same ownsr- ship, the owner or owners of said premises shall be and are hereby required to provide for independent service to the curb line for each such independent consumer. Provided, however, that if the owner of said premises so served with water shall agree in writing to be re- sponsible for and pay all money due for water used upon said premises, such independent service shall not be required. Should the owner or owners fail and refuse to provide such independent service or to as- sume responsibility for money due for water used upon said premises, the said Water Department shall after thirty (30) days' notice to the consumer so served and to the owner of said premises, either by mail- ing a copy of said notice to the owner at his last known place of residence, postage prepaid, or by posting a copy of such notice on the said premises, cut off the water from said premises until the independent services herein required are installed, or the agreement assuming responsibility for money due for water served to said premises, is made as hereinabove provided.. SEC'J.'ION 28: That no service connection Shall be hereafter made for the purpose of supplying watsr through a common service to two or more independent co nsumers occupying the premis es under the same ownership unless the owner or owners of said premises shall agree in writing to pay the monthly minimum rate for each such independent consumer and such other water rates as are herein provided for. SECTION 29: That no water shall be served to two or more parcels of property separately owned, through a common service pipe, -9- ?l~ :3Y:;r unless the consumer first in order of service from the main shall, in writing, guarantee the payment of water rates for all parcels of property so served. SECTION 30: All persons engaged in the erection or con- struction of a building or other structure upon premises other than his own, in the erection or construction of which water is required, shall before using any water therefor, apply at the office of the water Superintendent for permission therefor and said Water Superin- tendent shall require a deposit thereon in an amount not exceeding the estimated quantity of water to be used and such permit shall be exhibited upon the work for which the same was issued. SBCTION 31: It shall be unlawful for any person, firm or corporation to draw water from the Arcadia City pipes directly into any stationary steam boiler, hydraulic elevator, power pump or simi- lar apparatus. This section shall not apply to hot water tanks used exclusively for domestic use. SECTION 32: V~ere Arcadia City water is used to supply a steam boiler, hydraulic elevator, power pump or other similar apparatus, its owner shall provide a tank of sufficient capacity to afford a supply of water for at least twelve hours into which the service pipe shall be discharged. ~his section shall not apply to hot water tanks used exclusively for domestic purposes. SECTION 33: No person shall tap, open or connect with any water main or pipe which forms any part of the system of the water works of the City of Arcadia, without first notifying and obtaining written permission so to do from the Superintendent of the ~ater De- partment of the .City of Arcadia, who shall issue no such permit to or for any person whose indebtedness to the City of Arcadia for water or damages to hydrants is delinquent, or who has on one or more occa- sions taken water from the distributing system of the City of Arcadia without having given the notice and received the permission herein provided, even though such person has paid for water so taken. -10- c::/d .J YJ SECTION 34: For the convenience of consumers and as a meaeurs of safety to the service, the following rules and regula- tions are enacted and made a part of this Ordinance: Rule 1: In all cases where any consumer has been guilty of a violation of any of the ~ovisions of this Ordinancs, said City may, through its authorized officers, cut off the water supply from the premis ss to which said water has been he retofore furnished. Rule 2: All consumers must keep their service pipes, fix- tures, stopcocks, gate valves and other apparatus, (but not the service pipe put in and owned by said City) in good repair and free from leakage at their own expense and they will be liable for all damages which may result from their failure to comply herewith. Rule 3: It shall be unlawful for any person, firm or cor- poration to wilfully or negligently waste water of said City water system in any manner whatever, and any person having knowledge of any condition whereby water is being wasted shall immediately notify the Water Department of such fact. Rule 4: No consumer shall be allowed to use water for any other purpose than that reported to said City in the application made therefor, without having first obtained the consent of the Water Superintendent or other proper authority of said City nor in any way s~pply water to other persons or families. Rule 5: All water outlets through which a continuous stream of water can be conducted, must be shut off promptly upon an alarm of fire being given by said City and the water from same shall not be turned on again until the fire occasioning said alarm shall be extinguished. Rule 6: Except in any emergency of fire, it shall be unlawful for any person, firm or corporation other than an employee of said City, to break a seal or turn water into premises from which the Water Department has cut it off. Rule 7: No person, firm or corporation shall place on, about or around any meter, hydrant or stopcock connected with the pipes of the water system of said City, any building material, rubbish or other -11- c~ Sy~ obstruction so as to prevent free access to the same. On failure to remove any such obstruction within a reasonable time after notice. the water shall be shut off and not turned on again until such ob- struction is removed and the sum of $1.00 paid for the expense of turning said water off and on. Rule 8: The City will not be responsible for the breaking of any pipe or service oock or for any other interruption of the supply of water by reason of such break or by reason of the breaking of machinery or stoppage for necessary repairs. Rule 9: The City of Arcadia reserves the right at any time to shut off the water in the mains for the purpose of making repairs to mains, services, extensions or for other purposes. Owners and users of water heaters in domestic uss, depending upon the pressure of the water pipes of the City of Arcadia to keep them supplied, are here- by cautioned against danger of collapse and explosion. Rule 10: No allowance or rebate shall be made in water rates charged against any property or premises while the water remains con- nected therewith and full rates shall be charged against any and all property as hereinabove specified until said Water Department has been notified in writing to shut off or disconnect the water there- from. Rule 11: , When water is shut off from any meter for any reason at the request of the consumer, it shall not be turned on again ex- cept on the payment of 50 cents for the expense of turning the water off and on. /Rule 12: ~~aSSing through the tap or service pipe furnishing the water. Rule 13: When water is aqut off from any consumer because of non-payment of the water rates as hereinabove specified, or for any -12- t:Jd .7Y,;;? other reason as in this Ordinance provided, no person, firm or cor- poration shall allow such person to receive or take water from pipes' belonging to said person, firm or corporation. Rule 14: The Uater Superintendent or other ~oper officers of said City shall have access, at all times, to all parts of the premises supplied with water, to see that everything pertaining to the water service of said ~emises is in good repair and that all rules and regulations of this Ordinance. are being observed. Rule 15: Said City hereby reserves the right to amend, add to or revise these rules and regulations and to change the water rates from time to time, as experienoe may dictate. SECTION 35: Fire hydrants are provided for the purpose of extinguishing fire and are to be opened and used only by the Water and Fire Departments of said City, and by such persons as may be speCially authorized by the Water Superintendent. To insure the safety of fire hydrants, any person or persons authorized to open fire hydrants will be required to use only an approved spanner wrenoh and failure to do so will be sufficient cause to prohibit further use of the fire hy- drants and the refusal to grant subsequent permits for the use of same. Every person authorized to open fire hydrants must replaoe the oaps on the outlets when not in use and failure to do so is hereby deolared to be suffioient oause to prohibit further use of fire hy- drants by suoh person or persons and the further granting of subse- quent permits for the use of same. SECTION 36: It shall be unlawful for any person, firm or corporation to conduct or oarrywater in any way from any fire hydrant without written permission to do so from said Water Superintendent. SECTION 37: That all water systems laid within the cor- porate limits of said City of Arcadia and oonneoted with or supplied with water from the water mains of said City, shall be construoted under the supervision of and in accordanoe with plans and specifi- cations approved by the Water Superintendent. -13- ~~3~ SECTION 38: That Ordinance No. 66 of said City of Arcadia, entitled: "An Ordinance of the Board of Trustees of the City of Aroadia Regulating the Rates and Compensation to be Collected by said City for Supplying Water for Domestic, Irrigation and other purposes. to the Inhabitants of said City, prescribing Rules and Regu- lations for the Government of the Uater Service and providing a Pen- alty for the Violation thereof, in said City of Arcadia," adopted Deoember 20, 1916, be and the same is hereby repealed. SECTION 39.: That Ordinance No. 67 of said City of Arcadia, entitled: "An Ordinance of ths Board of Trustees of the City of Ar- cadia, amending Section 6 of Ordinance No. 66 of said City of Ar- cadia," adopted December 20, 1916, be and the same is hereby repealed. SECTION 40: That Ordinance No. 69 of said City of Arcadia. entitled: "An Ordinance of the Board of Trustees of the City of Ar- cadia, Amending Section 1 of Ordinance No. 67 of the City of Arcadia," adopted March 26, 1917, be and the same is hereby repealed. SECTION 41: That Ordinance No. 88 of said City of Arcadia, entitled: "An Ordinance of the Board of Trustees of the City of Ar- cadia amending Section 3 of Ordinance No. 66 of said City of Arcadia enti tled "An Ordinance of the Board of Trus tees of the City of Arcadia regulating the rates and compensation to be collected by said City for supplying ~ater for Domestic, Irrigation and Other Purposes to the Inhabitants of said City, Prescribing Rules and Regulations for the Government of the Hater Service and Providing a l'enalty for the Vio- la tion Thers of ," adopt ed December 20, 1916. bs and the same is hereby repealed. SECTION 42: That Ordinance No. 98 of the City of Arcadia, entitled: "An Ordinance of the Board of Trustees of the City of Ar- cadia Repealing Ordinance No. 88 of said City of Arcadia, adopted JulY 2, 1919, and amending Section 3 of Ordinance No. 66 of said City of Arcadia," adopt ed December 20, 1916, be and the same is hereby re- pealed. -14- cd 3Y-:S SECTION 43: That Ordinance No. 113 of said City of Arcadia._ entitled: "An Ordinance of the Board of Trustees of the City of Arcadia Repealing Section 16 of Ordinance No. 66 of said City of Arcadia," adopted December 20, 1922, be and the same is hereby repealed. SECTION 44: That Ordinance No. 119 of saii City of Ar- cadia entitled: "An Ordinance of the Board of Trustees of the City of Arcadia, Repealing Ordinance No. 98 of said City of Arcadia and amending Section :3 of Ordinance No. 66 of said City of Arcadia," adopted April 18, 1923, be and the same is hereby repealed. SECTION 45: That Ordinance No. 120 of said City of Ar- cadia entitled: "An Ordinancs of the Board of Trustees of the City of Arcadia regulating the Burning of Brush, Rubbish or other mater- ials within said City, and also for the Protection of Fire Hose, Fire Apparatus and the Water System of said City, and Prohibiting the taking of Water without Permission from said Water System in said City of Arcadia," adopted April 18, 1923, be and the same 15 hereby repealed. SECTION 46: That Ordinance No. 135 of said City of Ar- cadia entitled: "An Ordinance of the Board of ~'rustees of the City of Arcadia amending Section 6 of Ordinance No. 66 of said City of Arcadia entitled: 'An Ordinance of the Board of Trustees of the City of Arcadia Regulating the Rates and Compensation to be Col- lected by said City for Supplying Water for Domestic, Irrigation and other Purposes to the Inhabitants of said City, prescribing Rules and Rsgulations for the Government of the Water Service aId providing a Penalty for the Violation thereof,' in said City of Ar- cadia," adopted December 20, 1916, be and the same is hereby repealed. SECTION 47: That Ordinance No. 164 of said City of Ar- cadia, entitled: "An Ordinance of the Board of ~rustees of the City of Arcadia repea.ling Ordinance No. 113 of said City of Arcadia," adopted the 21st day of October, 1925, be and the same is hereby repealed. -15- dd 3'-/:)" . SECT IOl~ 48: That Ordinance No. 165 of the City of Ar- cadia, entitled: "An Ordinence of the Board of Trustees of the City of Arcadia Amending Section 3 of Ordinance No. 66 of said City of Arcadia," adopted October 21, 1925, and all other ordinances or parts of ordinances of said City of Arcadia, in conflict herewith, be and the same are hereby repealed. SECTION 49: That any person, firm or corporation violat- ing any of the provisions of this Ordinance shall be deemed guilty of a Misdemeanor, and upon conviction thereof, shall be punishable by a fine not exceeding ~300.00 or by imprisonment in the City Jail of said City of Arcadia or in the County Jail of the County of Los Angeles, State of California, at the discretion of the committing magistrate, for a period not exceeding three (3) months or by both such fine and imprisonment. SECTION 50: The City Clerk shall certify to the ado~tion of this Ordinance and shall cause the same to be pUblished once in the ARCADIA NEWS, a weekly newspaper published and circulated in said City of Arcadia, and thirty days from and after the final passage thereof the same shall take effect and be in force.
