AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING ORDINANCE NO. 170 OF SAID CITY OF ARCADIA, APPROVED MARCH 3, 1926; PURSUANT TO THE PROVISIONS OF SECTION 4 THEREOF. . THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1: An application signed by Rancho Santa Anita Inc., a corporation, having heretofore been filed in the Office of the City Planning Commission pursuant to Section 4 of Ordinance No. 170 entitled: An Ordinance of the City of Arcadia, Califor- nia, providing for the establishment or erection in said City of seven zones consisting of various Districts and prellcribing the class of buildings, structures, improvements and occupancy in said seven zones and the use thereof; the percentage of area that may be covered by improvements and the height to which buildings may be erected; defining the terms used therein and prescribing the penalties for the violation of the provisions thereoflf, asking that an exception be made affecting the property in said appli- cation and setting forth the specific reasons therefor and the circumstances in connection therewith, and recommendation having been made by the Planning Commission to this Council, and a fUll investigation having been made and consideration of the facts having been made by this Council, bearing upon such application; this Council determines that the granting of the request made therein will not be materially detrimental to the public welfare or injurious to the property or improvements within the zone and district within which said property is located, and will not bea inconsistent with the general purpose of the said Ordinance No. 170, and that unless such request is granted, substantial property rights of the applicant will be curtailed, and that this Council therefor excepts from the provisions of Zone A of Ordinance No. 170 of the City of Arcadia, the property hereinafter described, ;. -1- ad sf/P but only so far as such exception is necessary to permit the following described property, to-wit: PARCEL 1. Those portions of Lots 1. and 5 of Tract No. 949, in the City of Arcadia, County of Los Angeles, state of California, as shown on map recor- ded in Book 17, Page 13 of Maps, Records of said County, and of Huntington Drive, vacated as described in Ordinance No. 233 of the City of Arcadia, recorded in Book 9568, Page 282 Official Records of said County, described as follows: Beginning at the intersection of the Westerly line of Lot 5 of said Tract No. 949, as established and shown on County Surveyor's Map No. B. Ill, Sheet 4" with the North line of that parcel of land as described in deed to the City of Arcadia, recorded in Book 9396, Page 145 Official Records of said County; thence North 3 deg. 541 55" East along said Westerly line of Lot 5, a distance of 1828.72 feet to the beginning of a tangent curve concave to the East and having a radius of 1,000 feet; thence Northeasterly along said curve a distance of 519.09 feet to the end thereof; thence North 33 deg. 39' 25" East tangent to last mentioned curve, a distance of 686.77 feet to the beginning of a tangent curve concave to the West and having a radius of 1000 feet; thence Northerly along said curve, a distance of 1083.73 feet to the end thereof; thence North 28 deg. 26' 10" West tangent to the last mentioned curve, a dilltance of 27.20 feet to the in- tersection with a curve concave to the Northwest and having a radius of 600 feet, a radial line to said point of in- te.rsection bears South 41 deg. 121 33" East; thence North- easterly along said last mentioned curve, a distance of 338.15 feet to the end thereof; thence North 16 deg. 30' 00" East, tangent to last mentioned curve, 'a distance of 72 feet; thence East 782.01 feet; thence North 69 deg. 52' 31" East, a distance of 2265.23 feet, more or less, to a point in the Westerly boundary line of that parcel of land described in deed to the City of Arcadia, end recorded in Book 9396, Page 145 Official Records of said County, said point being distant North 29 deg. 29' 45" West 2021.28 feet from the point of intersection of said last mentioned Westerly line with the Northerly boundary line of Parcel No. 1 of that parcel of land conveyed to Los Angeles Turf Club, Incorporated, and described in deed recoraed in Book 12619, Page 275, et seq., Official Records of said County; thence South 29 deg. 291 45" East a distance of 2021.28 feet to the last mentioned point of intersection; thence Westerly and Southerly along the Northerly and Westerly boundary lines of Parcels No. 1 and No. 3 of said parcel of land conveyed to the Los Angeles Turf Club, Incorporated, as follows: South 60 deg. 30' 15" West 271.56 feet; North 68 deg. 59' 35" West 2457.18 feeq South 58 deg. 55' 35" West 1299.32 feet; South 3 deg. 54' 55" West 2262.08 feet; North 86 deg. 05' 05" West 100.00 feet; South 3 deg. 54' 55" West a distance of 1109.06 feet, more or less, to the intersection with the curved Northerly line of that parcel of land described in deed to the City of Arcadia and re- corded in Book 9396, Page 145 Official Records of said County; thence Westerly along said last mentioned Northerly line to the point of beginning. Page 282 Official Records of said County, described as follows: Beginning at the Southwest corner of Parcell. as described in deed to Los Angeles Turf Club. Incorporated. recorded in Book 12619, Page 275 et seq Official Records of said County; thence South 86 deg. 05' 05" East along the South boundary line of said Parcell. a distance of 2498.93 feet to its intersection with the Northwesterly line of that parcel of land as described in deed to the City of Arcadia. and recorded in Book 9396. Page 145 Official Records of said County; thence South 38 deg. 33' 00" West along the Northwesterly line of said last mentioned parcel of land, 745.13 feet to the beginning of a tangent curve therein, concave to the Northwest and having a radius of 915.37. feet; thence Southwesterly along said curve a distance of 884.01 feet to the end thereof; thence North 86 deg. 07' 00" West along the Northerly line of said last mentioned parcel of land. tangent to said last mentioned curve, a distance of 1322.78 feet; more or less, to the intersection with the Easterly line of Parcel 3, as described in deed to said Los Angeles Turf Club Incorporated. and recorded in Book 12619, Page 275 et seq of Official Records of said County; thence North 3 deg. 54' 55" East along said Easterly line of said Parcel 3, a distance of 1008.94 feet, more or less. to the point of beginning, to be used for the following purposes, and no other: A. For the purpose of constructing and maintaining a building or buildings to be used and occupied as a turf club, horse racing plant, automobile parking lot and such other necessary and inci~ dental uses as may be necessary in ,the conduct of the turf club and horse racing plant. B. That the rights or privileges granted by this Ordinance are granted and accepted by the persons affected thereby upon the express condition that the said property shall not be used for any purpose other than the purposes stated in this Ordinance. C. That if the property is used for any purposes other than the purpose or purposes specified in this Ordinance then in that case, ~ithout any further action on the part of the City Council of the City of Arcadia, the property shall revert to and become a part of Zone A as provided in Ordinance No. 170 of the City of Arcadia. D. That in case or in the event that by any law, state or -3- d~ 3VgJ local or otherwise, horse racing with pari mutuel betting upon the results thereof is prohibited or in any other case the said horse racing with pari mutuel wagering on the results thereof is prohibited or in case the Turf Club discontinues for a period of two (2) years the business of operating a turf club and horse racing with pari mutuel wagering on the results thereof, then in that case the above described property shall revert to and become a district of Zone A and the rights and privileges granted /' by this Ordinance shall cease, terminate and come to an end! SECTION 2: The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published once / in the Arcadia Tribune, a daily newspaper published and circulated in said City of Arcadia and thirty (30) days therefrom and there- after the same shall take effect and be in force. I hereby certify that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia held on the 2nd day of February, 1937, by the affirmative vote of at least three councilmen, to-wit: AYES: Councilmen, corby.
