MINUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Tuesday, April 13, 1993 The Planning Commission of the City of Arcadia met in regular session on Tuesday, April 13, 1993, at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Tom Clark presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Amato, Daggett, Hedlund, Huang, Clark ABSENT: None MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to read all resolutions by title only and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting. MINUTES MOTION It was moved by Commissioner Amato, seconded by Commissioner Huang to approve the Minutes of March 9, 1993 as published. The motion passed by voice vote with none dissenting. Rae Shiau Consideration of a conditional use permit to operate a tutorial school. Staff report was presented and the public hearing was opened. William Skotnieki, 8803 Camino Real, San Gabriel, spoke on behalf of the applicant. He said as one of the teachers of the center, he is very impressed with the operation. This is a private tutorial school and they supplement education taught in public schools. They teach English, Social Studies, Math and History. The maximum number of students at any one time will not exceed 20 and the hours of operation will be weekdays from 3:30 p.m. to 6:30 p.m. and Saturdays from 9:00 a.m. to 12:00 p.m. He went on to say that many of their students are of Asian descent and their program is similar to the Out Reach program. On occasions they have acted as the mediator between the school and the parents who may not speak English. They might attend the school's open houses and have conferences with the teachers in the school and later relay the results to the parents. With regard to the traffic, he said they have van service that picks up the children directly after school and brings them to the site and after classes, some of the parents pick up the children and they take the others home. The teachers take the vans home with them, so they are not parked there overnight. The parents will park in the designated area and a teacher monitors the parking lot and the traffic and releases the children to their parents. He assured the Commission that the children will not be running around outside. All activities, including recess, take place inside the center. Joe Wilson, 55 Lucile, #A, said he is also one of the teachers at the center. He was very impressed with the way the center is run and asked for approval. No one else spoke in favor or in opposition to this item. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. The Commission was in favor of the proposed use. MOTION It was moved by Commissioner Huang, seconded by Commissioner Amato to approve CUP 93-003 subject to the conditions in the staff report. ROLL CALL: AYES: Commissioners Amato, Daggett, Hedlund, Huang, Clark NOES: None Chairman Clark noted there is a five working day appeal period after the adoption of the resolution. PUBLIC HEARING TPM 93-001 407 -409 El Dorado Annie Chen Staff report was presented. Consideration of a tentative parcel map to create condominium ownership for the two existing homes on the site. Staff said that a patio area shall be provided for the front unit in accordance with the current R -2 regulations, and subject to the Planning Department's review and approval prior to the recordation of the final map. The public hearing was opened. Ramiro Ligason, L & D Engineering, 111 N. Melrose, Monrovia, was there representing the applicant. He said they are in agreement with all of the conditions listed in the staff report. Vera Wykidal, 1718 S. Second, spoke against the proposed project. She said they own property to the east of the subject site. Many of the properties around there are very nice but the proposed site is a mess and the monstrosity in the rear is unacceptable. She did not think approving this would be fair to the other property owners and disservice to the residents. The motion passed by voice vote with none dissenting. Discussion ensued regarding the front unit and staff explained that the patio was required as part of the architectural design review and it is a condition of approval. The front unit was probably built in the 1930s. The entire site is well maintained and the two -story structure in the rear has been through the design review process. The single -story unit in the front has been restuccoed to match the rear unit. Commissioner Hedlund pointed out that this is an ownership issue and Chairman Clark agreed. Staff said the buildings on the site are consistent with the R -2 zone and the General Plan. Staff explained that the parcel is not large enough to subdivide and flag lots are not permitted in the City. They are not altering the existing configuration of the site. This process is to determine type of ownership. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Huang to approve TPM 93-001 subject to the conditions in the staff report. AUDIENCE PARTICIPATION None PLANNING COMMISSION DETERMINATION 118 La Porte, Unit B J. Clark Knodle The staff report was presented. Consideration of request for a proposed showroom for motor vehicles sales in the M -1 zone. Staff did not think the proposed use would affect the parking. He remarked this is a nice complex. This will be a special set -up. Automobile storage is permitted in the M -1 zone and this zone requires 2 parking spaces. A survey showed that there are no auto repairs on the subject site. Alfred Knodle, 320 E. Colorado, spoke on behalf of the applicant. He said that they will have no more than 3 vehicles at any one time. They will show these cars by appointment only and might do some detail work on them. They will have late model sports cars, and luxury cars such as Mercedes Benz and Cadillac. Ms. Butler pointed out that by granting this request, any person could do the same type of a business as long as they comply with the requirements. This determination is for any location in the M -1 zone and not only the subject location. She explained how the Planning Department would implement this new policy if approved. Arcadia City Planning Commission 4/13/93 Page 3 Commissioner Hedlund was concerned with having this type of a business anywhere in the City and setting a precedent. Commissioner Amato wondered where the patrons would park and stated he saw several auto repair shops and one tow truck business on the street. Ms. Butler remarked that there are no auto repairs shops on the subject site. Staff remarked this is the first type of a request of this kind and staff did not anticipate many similar requests. It would be very costly to run this type of a business. An automobile dealership would not be permitted nor appropriate in the M -1 zone. Staff does not believe that this would be a major operation and does not have any problems with the request. The parking at the site complies with the M -1 regulations. Staff looked at the request more in line of storage and felt the sales part would be minimal within the building. The Commission felt the request should be approved but only for the subject site. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to determine that the proposed use would be acceptable at 118 La Porte Street. ROLL CALL: AYES: Commissioners Amato, Daggett, Hedlund, Huang, Clark NOES: None TIME EXTENSION TPM 91 -002 251 Whispering Pines Summit Charles Bluth Consideration of a one -year time extension creating 3 -lots from two. The staff report was presented. Chairman Clark was not in favor of granting the time extension and remarked that Mr. Bluth has received many breaks and considerations from the City and he did not feel that he was entitled for more. Commissioner Amato agreed and said the City has had a lot of grief because of this project. Ms. Butler stated the water tank is located in Monrovia. She remarked 24" box trees will be planted around the tank She noted the request for time extension is due to litigation. Commissioner Hedlund indicated it would be difficult to deny the time extension and make findings to justify the action. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Huang to grant a one year time extension to March 12, 1994. The staff report was presented. MOTION It was moved by Commissioner Amato, seconded by Commissioner Huang to grant a one year time extension to May 14, 1994. ROLL CALL: AYES: Commissioners Amato, Daggett, Hedlund, Huang, Clark NOES: None RESOLUTION 1498 A resolution granting CUP 93 -003, for a tutorial school at 141 E. Duarte Rd. Ms. Butler read the title of the resolution. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to adopt Resolution 1498 and to formally affirm the decision of April 13, 1993 and the vote thereon. MATTERS FROM COUNCIL None MATTERS FROM COMMISSION Commissioners Amato and Daggett discussed the developments with the library addition. Commissioner Daggett said at a recent meeting the architect presented several options to the City, ranging from $3.5 -$5 million, and the least expensive option would not satisfy the library's request. They felt the addition could be accomplished by spending $3.5 million and still be able to accommodate the library. MATTERS FROM STAFF Staff gave a brief summary of what the Planning Department is working on.
