AN ORDINANCE O~ THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING ORDINANCE NO. 33 OF SAID CITY OF ARCADIA BY ADDING THERE- TO TWO NEW SECTIONS TO BE NUMBERED 57A AND 57B, RELATING TO THE TEMPORARY REMISSION OF PENALTIES ON DELINQUENT TAXES, PAYMENT OF DELINQUENT TAXES IN INSTALLMENTS AND THE REDEMPTION AND SALE OF PROPERTY SOLD TO THE OITY FOR DELINQUENT TAXES. THE CITY COUNCIL OF THE CITY OF ARCADIA DO ORDAIN AS FOLLOWS: SECTION 1: That Ordinance No. 33 of said City of Ar- cadia, entitled: "An Ordinance of the City of Arcadia providing for the assessment and collection of City Taxes and repealing Ordinances Nos. 9 and 12 of said City of Arcadia," adopted Febru- ary ~, 1913, be and the same is hereby amended by adding thereto a new Section to be known and numbered Section 57A, and to read a follows: SEOTION 57A: The word "Taxes" wherever used in this Section, includes all Taxes and Assessments and annual install- ments of Assessments charged on the Tax Roll. In all cases where real estate has been sold to the City on or before September 6, 1933, for delinquent taxes, and the Cit has not disposed of the same, the person whose estate has been sold, his heirs, executors, administrators or other successors in interest shall, at any time on or before the twentieth day of April, 193~, have the right to redeem such property by paying to the City Treasurer of the City of Arcadia, the amount of taxes du thereon at the time of such sale, and also all taxes that were a lien upon said real property at the time said taxes became delin- quent, and also all unpaid taxes of every description assessed against the property together with all taxes that. are a lien against the property, for each year since the sale, as shown on the delinquent assessment rolls in the then permanent custody of he Oity Olerk, or, if not so assessed, then upon the value of the , property as assessed in the year nearest the time of such redemp- tion, with interest on the whole amount of such taxes at the rate of seven per cent per annum computed from the first day of July, -1- OAC!';:?P ;? ,'-~ . D~\l. \10. ~1.3 z o ~ ~ OJ < z C>.J g '" ~ . :J < :i ..... < (/) > U w < ItS ~ ~ z 0 . z t: ~ :J ~ · c \,.,_~(~L(\) 0\\0,1\0- 5~ 30 31 32 1 1932, to the time of such redemption, except that interest upon 2 taxes, assessed or unassessed, for the fiscal year 1932-193', 3 shall be computed from July 1, 1933, to the time of such redemption. 4 The provisions of this Section shall be deemed to allow 5 the redemption of such real estate, on or before the twentieth day 6 of April, 193~, free from the payment of any costs, interest, 7 (other than the interest hereinbefore in this Section provided), 8 penalties for delinquency, or redemption penalties, which may have 9 accrued against said real estate on or before April 20, 193~. 10 The provisions of this Section Bhall have no application to the 11 amount or rate of penalties for delinquency or upon redemption, 12 for taxes of the fiscal year 1933-3~. 13 Except as otherwise in Section 57B and this Section 14 provided, such redemption shall be made in the manner prescribed in Section 58 of said Ordinance No. 33. 15 16 17 SECTION 2: That said Ordinance No. 33 be and the same is hereby amended by adding thereto a new Section to be numbered 18 Section 57B and to read as follows: 19 SECTION 57B: The word II Taxes II wherever used in this 20 Section, includee all Taxes and Assessments and annual install- 21 ments of Assessments charged on the Tax Roll. 22 In all cases where real estate has been sold to the City 23 on or before September 6, 1933, for delinquent taxes, and the City 24 has not disposed of the same, the person whose estate has been sold, his executors, administrators, or other successors in in- terest shall on or before April 20, 1934, have the right to elect to pay such delinquent taxes in installments as hereinafter pro- vided and by the payment of each of such installments, together with current City taxes, to extend the period of redemption of such real estate and to postpone the date of sale of such property at auction, as provided in Section 40 of said Ordinance No. 33, and the time of making a Deed of such property to the Oity as 25 26 27 28 29 -2- od ;,2,f;S 1 2 3 4 5 6 7 8 9 10 11 12 13 z o ~ ~ 14 OJ < z . Upon payment to the City Treasurer on or before April 20, 1934, of ten per cent, or more,of an amount equal to the total of unpaid taxes computed as prescribed in Section 57A of said Or- dinance No. 33, plus interest on the whole of said amount at the rate of seven percent per annum from July,1932, to date of such payment, (except that interest upon taies for the fiscal year 1932-1933 shall be computed ~rom July 1, 1933), and by the further payment on or before April 20, 1934,.of all City Taxes levied and assessed for the fiscal year 1933-1934, together with penalties and costs due thereon, the right of redemption in installments hereunder shall be extended to and. including April 20, 1935, dur- ing Which time no sale at auction of such prcperty shall be made a provided in Section 40 of said Ordinance No. 33, and no Deed to the City shall be made as provided in Section.43 of. said Ordinance No. 33, and no resale by the City shall be made in accordance with the provisions of Section 66 of said Ordinance No. 33. Upon payment to the City Treasurer, on or before April 20, in each of the years of 1935 to 1943, both inclusive, or until said amount has been paid, of ten per cent or more of said total amount together with interest, at the sam~rate from the date of the.preceding payment, on that part of said total amount remaining unpaid after such pre- ceding payment, and upon payment on or before April 20 in each of the years of 1935 to 1943, inclusive, of City taxes for each of said years, with penalties and costs thereon, the right of re- demption shall be extended, the time of sale at auction to the public and of Deed to the City shall be postponed and resale by the City shall be suspended, for successive periods of one year. Z ~ ~ :J < · C \I~~~,,\.~\l 25 Q\lU"l\Q, .)0 26 27 28 1 ified to be made on or before the dates herein set forth, the 2 right to pay such delinquent taxes in installments shall cease 3 and terminate and such property shall thereupon be subject to 4 sale at auction or may be deeded to the City or resold by the 5 City in the same manner as though no election to pay delinquent 6 taxes in installments had been made. 7 No such payment, nor all of them, shall be deemed a 8 redemption of real estate nor affect the right, title or interest 9 of the City thereto, but shall be deemed and considered as compen- 10 sat ion for the use and occupanpy of said real estate; provided, that if each installment of delinquent taxes and interest be paid 11 12 on or before the respective dates specified in this Section, and 13 if redemption of such property shall be made, on or before the twentieth day of April, 1939, in the manner hereinafter in this Section provided, the amounts previously paid under the authority of this Section shall be credited on the amount to be paid for such redemption. 14 15 16 17 18 The amount to be paid on or before the twentieth day of 19 April, 1939, to effect redemption of such property under this 20 Section shall be the sum of the following amounts: 21 (a) Unpaid taxes computed as prescribed in Section 57A 22 of said Ordinance No. 33, with interest thereon equal to the 23 amount of interest included in all installment! payments previous- 24 ly made, as authorized by this Section, and, in addition, interest 29 30 31 32 equal to the amount pf interest due at the time of such redemp- tion on the remainder, if any, of the amount payable in install- ments, as authorized by this Section; (b) Unpaid taxes for the fiscal years following the year ending June 30, 1933, with redemption penalties thereon com- puted in accordance with Section 5g of said Ordinance No. 33. The foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 17th. day of October, 1933, by the affirmative vote of at least three Ooun- cilmen, to-wit: AYES: Councilmen, Daniels, Krebs and Seaman, NOES, None, ABSENT: Councilmen Link and Schrader. and signed and approved this 17th. day of October, 1933.
