HOWARD CITY MANAGER DIRECTOR OF PUBLIC WORKS SUBJECT: REQUEST FOR COUNTY AID TO CITIES FUNDS TRAFFIC SIGNAL MAINTENANCE - RESOLUTION NO. 5310 Each year the City is allocated a certain amount of money from the County Aid to Cities Fund. This money is used to partially offset the cost of operation and maintenance of our traffic signal system. For Fiscal Year 1986-87, the cost of maintenance of the traffic signal system will be approximately $157,000 with $77,809 being available from the County Aid to Cities Fund to partially offset this cost. It is recommended that the City Council adopt Resolution No 5310 requesting an allocation of County Aid to Cities monies in the amount of $77,809.00 for maintenance of said signal system. COZAD FROM, CHESTER No HOWARD CITY MANAGER DIRECTOR OF PUBLIC WORKS SUBJECT: REVISED AGREEMENT FOR TRAFFIC SIGNAL MAINTENANCE The County of Los Angeles Road Commissioner has prepared and transmitted a revised agreement for signal maintenance. The revision concerns itself primarily with defining services under routine and extraordinary maintenance and establishing a current year rate of $45 per intersection per month, The new rate is $8 per month less than that for the last fiscal year Other changes include establishing a separate safety lighting maintenance rate and placing equipment repainting in the extraordinary category. Recent equipment acquisitions by the Department of Public Works for street light main- tenance make it possible for City crews to perform the necessary functions in the latter two items reducing contract costs by $632 per year for the lighting maintenance service. Repainting will be done as needed rather than on an on-call basis by L.A. County Road Department and should further reflect a savings to the City. It is recommended that the agreement be approved with the two exceptions noted above and that the City Council authorize the Mayor and City Clerk to execute the four copies of said agreement, Respectfully submitted, \ j i CHESTER N. Approve the enclosed agreements with the Cities of Arcadia (1), • Compton (4), Hawthorne (2), and Torrance (4). 2. Instruct the Chairman to sign the agreements. The enclosed proposed agreements cover County and City maintenance and operation of traffic signal and highway safety lighting facilities under the jurisdiction of the County of Los Angeles and/or the respective Cities of Arcadia, Compton, Hawthorne and Torrance. These agreements incorporate certain new wording which reflects current maintenance practices and contain revised provisions which will result in more efficient administration. Individual traffic signals and highway safety lighting installations may be added or deleted under the terms of these agreements by written approval of both the affected City and the County or by so stipulating in construction agreements. (1) County Counsel (1) CITY ORIGINAL A G R E E M E N T gioe 23919 The COUNTY OF LOS ANGELES, a political subdivision of the State of California, hereinafter referred to as "COUNTY" , and the CITY OF ARCADIA, a municipal corporation , hereinafter referred to as "CITY" , do enter into the following Agreement: WHEREAS, COUNTY and CITY desire to provide for the maintenance of certain traffic signal and highway safety lighting installations at locations which are partially or wholly under jurisdiction of one or both of the parties hereto; and to arrange herein for the particular maintenance functions to be performed and to specify the cost of such maintenance; NOW THEREFORE , it is mutually agreed as follows: 1 . COUNTY will perform routine traffic signal and highway safety lighting maintenance, hereinafter referred to as "routine maintenance" , and extraordinary traffic signal and highway safety lighting maintenance, hereinafter referred to as "extraordinary maintenance" , at locations shown in Appendix "A" , and CITY shall perform such services at locations shown in Appendix "B". For each highway intersection shown, the parties hereto shall share the expense of such services in the same proportion that the number of approaches or percentages of approaches under their respective jurisdiction bears to the total number of approaches entering said intersection. 2. Routine maintenance includes patrolling for traffic signal malfunctions and highway safety lighting outages ; inspection, testing, and timing of traffic signal controllers , and minor repairs necessary to insure satisfactory traffic signal service; and minor touch-up painting. 3. Each party that provides routine maintenance shall establish a flat monthly rate per intersection for traffic signal maintenance and a separate flat monthly rate for each highway safety light maintained. These monthly rates shall be the average monthly cost of routine maintenance for all traffic signals and highway safety lighting that each maintains and operates, regardless of location. These monthly rates shall be used for billing under paragraph 7 hereof, and shall be revised and adjusted for each fiscal year to insure an equitable annual cost. 4. Extraordinary maintenance includes replacement or addition of major traffic signal and highway safety lighting equipment due to obsolescence, wear or inadequacy; repair due to damage from any cause, including vandalism; replacement of non-repairable traffic signal components ; repair or replacement of inductive loop detectors and detector pads; extensive repainting; and relamping and replacement of ballasts for highway safety lighting. Excepted are those highway safety lighting installations owned and maintained by the Southern - California Edison Company. • 5. Extraordinary maintenance which exceeds $200 in cost (except that necessary to maintain operation) shall be subject to the approval of CITY' s Director of Public Works when performed by COUNTY and subject to the approval of the Road Commissioner when performed by • CITY. All costs shall be assessed directly against the installation involved. 6. COUNTY will provide for the furnishing of electrical energy at locations shown in Appendix "A" which are partially under the jurisdiction of either of the parties hereto and CITY shall provide for the furnishing of electrical energy at locations shown in Appendix "B" which are partially under the jurisdiction of either of the parties hereto. Each party hereto will provide for the furnishing of electrical energy at locations , whether shown in Appendix "A" or "B" , which are wholly within their respective jurisdiction. 7. Bills for all routine maintenance, extraordinary maintenance, and electrical energy shall be rendered quarterly. The first bill for routine maintenance in the fiscal year shall show the itemization of salaries and wages, material, equipment, and operation upon which % the . flat rates referrbmi to in paragraph' 3 is bask Materials shall include miscellaneous items of service and expense. All bills for extraordinary maintenance shall show the itemization specified above. 8. On bills for routine and extraordinary maintenance , current percentages may be added to salaries and wages for overhead and to equipment costs for depreciation of equipment. These percentages, if added, shall be shown as separate items in the rates for routine maintenance and on the bill for extraordinary maintenance. 9 . Traffic signal or highway safety lighting installations may be added to or deleted from Appendix "A" or Appendix "B" under the terms of this Agreement by so stipulating in subsequent installation or modification agreements or by written approval of both the Road Commissioner of the County of. Los Angeles and CITY' s Director of Public Works. By the same procedure, each agency 's share of the cost of maintenance may be revised as changing jurisdiction may necessitate. 10 . Neither COUNTY nor any officer or employee of COUNTY shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by CITY under or in connection with any work, • authority or jurisdiction delegated to CITY under this Agreement. It is also understood and agreed that , pursuant to Government Code Section 895. 4 , CITY shall fully indemnify, defend and hold COUNTY harmless from any liability imposed for injury (as defined by Government Code Section 810. 8) occurring by reason of anything done or omitted to be done by CITY under or in connection with any work , authority or jurisdiction delegated to City under this Agreement. 11 . Neither CITY nor any officer or employee of CITY shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by COUNTY under or in connection with any work, authority or jurisdiction delegated to COUNTY under this Agreement. It is also understood and agreed that, pursuant to Government Code Section 895. 4, COUNTY shall fully indemnify, defend and hold CITY harmless from any liability imposed for injury (as defined % Nod by Government Code Section 810 . 8) occurring by reason of anything done or omitted to be done by COUNTY under or in connection with any work, authority or jurisdiction delegated to COUNTY under this Agreement. 12. This Agreement shall supersede all prior CITY-COUNTY agreements regarding the maintenance of traffic signals and highway safety lighting. 13. This Agreement shall be affective as of August 1, 1974 and may be terminated upon thirty days ' written notice by either party.
