AGREEMENT
LOS ANGELES COUNTY REGIONAL IDENTIFICATION SYSTEM

AGREEMENT BETWEEN THE CITY OF ARCADIA AND THE CO -ITY IF LOS
ANGELES FOR THE ARCADIA POLICE DEPARTMENT TO PARTICIPATE IN THE
LOS ANGELES COUNTY REGIONAL IDENTIFICATION SYSTEM.
This AGREEMENT is made and entered by and between the City of
Arcadia, a municipal corporation , and the County of Los Angeles ,
a political subdivision of the State of California, hereinafter
referred to at times as COUNTY.
W I T N E S S E T H
WHEREAS , the Los Angeles County Sheriff' s Department , hereinafter
referred to as LASD, is the proprietory agency for the Los
Angeles County Regional Identification System, hereinafter
referred to as the LACRIS , a participant in the State of
California Identification System/Remote Access Network, herein-
after referred to as CAL-ID/RAN; and
WHEREAS , the LACRIS is governed by the Los Angeles County Local
CAL-ID RAN Board , established pursuant to Section 11112.4(a) &
(c) of the California Penal Code, and hereinafter referred to as
Local CAL-ID RAN Board; and
WHEREAS , the LACRIS consists of two subsystems , the Automated
Fingerprint Identification System, hereinafter referred to as
AFIS , and the Automated Latent Print System, hereinafter referred
to as ALPS; and
WHEREAS , the LACRIS includes remote access through Local Input
Terminals , hereinafter referred to as LIT' s ; and
WHEREAS , the Arcadia Police Department , hereinafter referred to
as Arcadia PD, a criminal justice agency, desires to participate
in the LACRIS ; and

WHEREAS , LASD agrees to provide Arcadia PD access to the LACRIS ,
which is to include both AFIS and ALPS inquiries ;
NOW THEREFORE, the parties hereto agree that Arcadia PD will be
provided access to the LACRIS through the LASD LIT site,
Sheriff' s Station, or any agency participating in the existing
LASD Facsimile Network for AFIS inquiries , and through the LASD
LIT site for ALPS inquiries , in the minimum amount of 0.4970 of
total available system time , pursuant to the following terms and
conditions .
A. LOS ANGELES COUNTY REGIONAL IDENTIFICATION SYSTEM ACCESS COSTS
1 . The CITY of Arcadia agrees to pay COUNTY a total one-time
sum (based upon a use percentage 0.4970) of $10 ,303.00, or
a sum of $2 ,061 .00 annually for a period of five (5) years
to cover the cost of all equipment and site preparation.
2. The CITY of Arcadia agrees to pay COUNTY a sum (based upon
a use percentage 0.49%) of $3,106.00 annually to cover the
cost of maintenance and operation.
3. The 'CITY of Arcadia agrees to pay a one-time sum (based
upon a use percentage of 0.52%) not to exceed $2,600.00 to
cover fingerprint data conversion costs .
4. The CITY of Arcadia agrees to pay COUNTY for the afore-
mentioned costs identified in paragraph A.1 . , A.2. and A.3
of this AGREEMENT within thirty (30) days after receiving
an invoice from COUNTY for such costs .
5. COUNTY agrees to audit the LACRIS upon completion of the
first year of operation and on an annual basis thereafter,
and to adjust upwards or downwards the non-fixed costs
(maintenance and operations) set forth in paragraph A.2.

chargeable to the City of Arcadia based upon Arcadia PD' s
actual use of LACRIS. The annual sum payable pursuant to
paragraph A.2. shall be increased or decreased at the same
percentage of Arcadia PD' s actual use of LACRIS.
For purposes of this paragraph, the term "actual use"
shall mean Arcadia PD' s percentage of the total number of
system inquiries , including but not limited to ALPS , AFIS
and special inquiries as well as total use of system time.
B. SYSTEM USAGE AND FEES
1 . Arcadia PD shall not be charged for AFIS inquiries made
through the LASD LIT site , Sheriff' s Station or any agency
participating in the existing LASD Facsimile Network.
2 . With the exception of special requests , Arcadia PD shall
not be charged for ALPS inquiries made through the LASD
LIT site.
3. Special requests for latent fingerprint services , such as
tracings are not included as a part of system usage and
are subject to charge.
a. The charge for latent fingerprint tracings
by LIT Agency personnel on behalf of Arcadia PD shall
be $20.00 per tracing.
b. All other special latent fingerprint services
performed by LIT Agency personnel on behalf of
Arcadia PD shall be charged at an hourly rate of
$34.00.
4. Billing for the services described in paragraph

be made to the CITY of Arcadia by the LASD a

C. SYSTEM RULES , POLICIES AND PROCEDURES
1 . Arcadia PD agrees to abide by all current rules ,
policies , procedures , and security and privacy
regulations pertaining to the LACRIS as provided by LASD,
as well as any rules , policies and procedures hereinafter
adopted LASD.
2. Arcadia PD agrees to abide by all state and federal
statutes , as well as all policies adopted by LASD or
Local CAL-ID RAN Board concerning the security, privacy,
and dissemination of any and all fingerprint identifi-
cation data contained in the LACRIS and CAL-ID System.
3 . LASD agrees to make access available to the LACRIS twenty-
four (24) hours each day, barring system failure or
unavailability beyond the control of LASD.
4. Notwithstanding participation in the LACRIS , Arcadia PD
agrees to submit a fingerrprint card for all specified
arrests to the Department of Justice as required by law,
and as prescribed by Department of Justice policy and
administrative procedures .
5. LASD agrees to ensure the proper and effective operation
and maintenance of equipment used to participate in the
LACRIS and the State CAL-ID System.
6. LASD agrees to implement a system of routine audits , and
shall make all audit reports available to the Local CAL-ID
RAN Board.

D. TERM OF AGREEMENT
1 . This AGREEMENT becomes effective on April 1 , 1987 , and
shall run continuously thereafter for a period of five (5)
years , subject to termination by any party, upon one
hundred eighty (180) days written notice. At the conclu-
sion of the five year period , this AGREEMENT shall be
extended for an additional year, each year, unless
terminated by any party upon ninety (90) days written
notice to each of the other parties . All fixed costs
(e.g. , equipment and site preparation) set forth in
paragraphs A.1 . and A.3. and all accrued non-fixed costs
set forth in paragraph A.2. not previously paid, shall be
immediately due and payable to COUNTY by CITY of Arcadia
at time of termination, provided that in the event this
AGREEMENT is terminated by the COUNTY and not as a result
of a breach of this AGREEMENT or a violation of the rules
and policies established pursuant to paragraphs C.1 . and
C.2. hereof on the part of the City of Arcadia, the City
of Arcadia shall be liable for those fixed costs set forth
in paragraph A.1 . on a pro rata basis in proportion to the
amount of time Arcadia PD participated in the system, or
Arcadia PD' s actual use of the system, whichever is
greater.
For purposes of this paragraph, the term "actual use"
shall be defined in the same manner in which the term is
defined in paragraph A.S. of this AGREEMENT. Each party
shall be responsible for any other termination costs that
they may incur, including but not limited to, the costs of
transporting equipment , restoring office space to previous
condition, closing out billings , or personal expenses.
2. Should either party elect to terminate this AGREEMENT as
a result of the other party' s failure to abide by its
terms or conditions , the terminating party shall provide
written notice to the other party the specific reason or
reasons for termination.
E. INDEMNIFICATION
1 . COUNTY agrees to indemnify, defend and save harmless the
City of Arcadia, their agents , officers and employees
from and against any and all liability, expense ,
including reasonable defense costs and reasonable legal
fees , and claims for damages of any nature whatsoever,
including, but not limited to, bodily injury, death,
personal injury, or property damage arising from the acts
or omissions of the COUNTY in its performance under this
AGREEMENT.
2. CITY of Arcadia agrees to indemnify, defend and save
harmless COUNTY, their agents , officers and employees from
and against any and all liability, expense , including
reasonable defense costs and reasonable legal fees , and
claims for damages of any nature whatsoever, including,
but not limited to, bodily injury, death, personal injury,
or property damage arising from or connected with the acts
or omissions of the City of Arcadia in connection with its
use of the services provided under this AGREEMENT.
3. This AGREEMENT is made by and between the COUNTY of LOS
ANGELES , and the the CITY of Arcadia. It is not intended
and shall not be construed to create the relationship of
agency, servant , partnership , joint venture, or associa-
tion between the COUNTY and the City of Arcadia .

F. NON-DISCRIMINATION
Each of the parties to this AGREEMENT agree that they will
not discriminate against any person in their performance of or
use of services under this AGREEMENT and will comply with any
applicable federal , state , County and city equal opportunity
laws , rules and regulations .
