SUBJECT: ARCADIA CITY LARIO URBAN TRAIL MAINTENANCE COSTS
GENTLEMEN:
The Lario Urban Trail Corridor (bikeway ) extends southward from
the Peck Road Fishing and Conservation Area to Whittier Narrows
and from there to the ocean.
In order to provide greater accessibility to these recreational
areas for Arcadia residents , the City of Arcadia utilized its
allotment of SB 821 funds and $28 ,000 of regional bikeway funds
for the construction of an extension to the Lario Urban Trail ,
which extends northward from the southeast corner of Peck Road
Fishing and Conservation Area , along the Santa Anita Wash to
Live Oak Avenue ( 3/4 mile ) .
The City Council at its April 1 , 1980 regular meeting approved
a Joint Powers Agreement under which the County would maintain
the bikeway for a period of two years at a rate not to exceed
$5,000 per year payable in advance to the County. Any monies
remaining in excess of the actual costs were to be refunded to
the City or credited toward the next year' s obligation.
At the time the Council approved the agreement , staff was directed
to attempt to use State SB 821 funds for the maintenance costs .
The first $5,000 was paid out of the City' s SB821 Bikeway ac-
count . Unfortunately, the State disallowed the use of SB 821
funds for maintenance costs . Therefore , there exists a $5 ,000
amount which must be repaid to this account .
On March 12 , 1982 we received a statement of actual maintenance
costs for 1981 in the amount of $6 ,811 . 48 (attached) . The City
was only obligated for the $5 ,000 previously paid to the County.
The County has requested the second year ' s $5 ,000 advance pay-
ment for 1982 bikeway maintenance .
4 The Council should move to approve the expenditure of not to
exceed $10,000 from the City ' s Capital Improvement funds ( $5 ,000
to reimburse the City' s Bikeway Account and $5 ,000 to the County
of Los Angeles for 1982 Bikeway maintenance pursuant to the Joint
Powers Agreement .

Staff believes that the City can maintain this bikeway at sub-
stantially less cost than the County, and will provide the
Council a report and recommendation prior to the expiration of
the existing maintenance agreement in January, 1983 .

A G R E E M E N T
THIS AGREEMENT, made and entered into by and between the
CITY OF ARCADIA , a municipal corporation in the County of Los
Angeles, hereinafter referred to as "CITY" and the COUNTY OF
LOS ANGELES, a political subdivision of the State of California,
hereinafter referred to as "COUNTY'' .
W I T N E S S E T H
WHEREAS , the LARIO Urban Trail Corridor is on the County
• Master Plan of Bikeways; and
WHEREAS , the LARIO Urban Trail Corridor is a regional trail

project connecting twenty-one (21 ) cities between the Angeles
National Forest and the Pacific Ocean ; and
WHEREAS, COUNTY and CITY desire to construct a portion of the
LARIO Urban Trail Corridor between Peck Road Fishing and Conserva-
tion Area and Live Oak Avenue, which work is hereinafter referred
to as "PROJECT" ; and
WHEREAS , PROJECT has received an allocation of local and
regional SB 821 funds; and
WHEREAS , 'PROJECT is in the general interest of both CITY and
COUNTY; and
WHEREAS , the Corps of Engineers proposes to design and ad-
minister the construction of PROJECT under the Code 710 Program;
and

WHEREAS, CITY is willing to finance a portion of the PROJECT
cost ; as evidenced by the City Council ' s approval of Resolution No.
4802, January 2 , 1979 , through the use of the City ' s reserved local
SB 821 funds; and
WHEREAS , the City is willing to contribute additional funds
to ensure completion of the portion of the LARIO Trail project with-
in the City of Arcadia.
NOW, THEREFORE, in consideration of the mutual benefits to be
derived by both CITY and COUNTY and of the premises herein contained,
it is hereby agreed as follows:
(1) CITY AGREES :
a. To pay $6 , 011 to COUNTY after execution of this Agree-
ment and upon demand as its fixed share of PROJECT
• cost . This amount represents the additional cost of
the local agencies ' share of the PROJECT after taking
into account Code 710 and previous commitment of SB
821 funding.
b. Upon completion of PROJECT to reimburse COUNTY for
maintenance of all PROJECT improvements constructed
• within the CITY limits.
c. The initial maintenance costs shall be set at a rate
of not to exceed $5 , 000 payable annually in advance
to the COUNTY on January 1 of each year , commencing
with the year 1981. Cost reports detailing the work
performed and the actual cost incurred pursuant to

this Agreement shall be submitted to the CITY within

thirty ( 30) days of completion. Any monies remain-
ing in excess of the actual costs for a calendar year
shall be either refunded to CITY or credited toward
the CITY 'S payment obligation of said amount for the
following calendar year .
(2 ) COUNTY AGREES :
a. To coordinate PROJECT with the Corps of Engineers .
b. To pay the remaining local agencies ' share of PROJECT
cost in excess of the amount herein set forth as
CITY'S share.
c. Upon completion of PROJECT to maintain all PROJECT im-
provements in good condition until termination of this
Agreement , starting January 1981, subject to payment there-
fore by CITY.
d. The maintenance of the PROJECT shall be limited to
sweeping and repair of the trail surface , fencing and van-
dalism repair as necessary to guarantee trail safety.
e. The CITY and the COUNTY shall review the level of trail
maintenance on an annual basis, and by mutual agreement ,
the annual cost for that maintenance shall be adjusted
to guarantee an adequate level of maintenance .
(3) IT IS MUTUALLY UNDERSTOOD AND AGREED AS FOLLOWS :
a. Neither COUNTY nor any officer or employee of COUNTY
shall be responsible for any damage or liability occurr-
ing by reason of anything done or omitted to be done by
CITY under or in connection with any work , authority ,

or jurisdiction delegated by CITY under this Agree-
ment . It is also understood and agreed that , pursuant
to Government Code Section 895 .4 , CITY SHALL fully in-
demnify , defend, and hold COUNTY harmless from any
liability imposed for injury (as defined by Government
Code Section 810. 8) occurring by reason of anything done
or omitted to be done by CITY under or in connection
with any work, authority, or jurisdiction delegated
to CITY under this Agreement .
b. Neither CITY, nor any officer or employee of CITY , shall
be responsible for any damage or liability occurring by
reason of anything done or omitted to be done by COUNTY
under or in connection with any work authority , or
jurisdiction delegated to COUNTY under this Agreement .
It is also understood and agreed that , pursuant to
Government Code Section 895 . 4 , COUNTY shall fully in-
demnify , defend, and hold CITY harmless from any
liability imposed for injury (as defined by Government
Code Section 810 . 8) occurring by reason of anything
done or omitted to be done by COUNTY under or in connec-
tion with any work, authority , or jurisdiction delegated

to COUNTY under this Agreement .
c. This Agreement shall terminate on January 1 , 1983, subject
to renegotiation and mutual consent of the parties.
IN WITNESS WHEREOF, the parties hereto have caused this Agree-
ment to be executed by their respective officers , duly authorized,
