SUBJECT: AGREEMENT FOR THE IMPROVEMENT OF SANTA ANITA AVENUE -
LIVE OAK TO GRAND AVENUE
The City Council reviewed and approved a staff report dated April 21 , 1981
pertaining to subject improvement project and authorized the Mayor to so
advise the Honorable Pete Schabarum. The proposed project involves the City,
Temple City and County jurisdictions and the estimated share of the total
cost that would be borne by the City of Arcadia is $6300.
Attached hereto is a letter from the Los Angeles County Road Department
requesting that the City approve the attached agreement which, among other
things, would assign $6300 in Federal Aid Urban funds to the County to cover
the City' s estimated jurisdictional share of the construction cost.
It is requested that said agreement be approved and that the Mayor and City
Clerk be authorized to execute same in a form approved by the City Attorney.
It is further recommended that Resolution No. 4963 be adopted granting to
the County the necessary jurisdiction in order that they may proceed with
the proposed project.

GRAND AVENUE
RESURFACING PROJECT
Enclosed are four copies of a proposed agreement regarding County
participation with the City of Arcadia for the purpose of resur-
facing the roadway pavement on Santa Anita Avenue from Live Oak
Avenue to Grand Avenue , modifying median gutter , constructing
median catch basins and placing conduit for possible future
street lighting. Also enclosed are two certified copies of a
Resolution adopted by the Board of Supervisors of the County of
Los Angeles declaring Santa Anita Avenue between said limits ,
within your City, to be a part of the County System of Highways
for the above purpose. Please present this request for juris-
diction to your duly authorized City officials for their approval .
The agreement , which was prepared based on Supervisor Pete Schabarum' '
letter of April 13, 1981 and Mayor Gilb' s reply of April 22, 1981,
provides for the County to prepare plans , specifications and cost
estimates at County expense and administer the project under the
Federal-aid Urban Program with each agency paying its jurisdictiona .
share of the construction cost. The agreement also provides for thf
City to assign $6, 300 in Federal-aid Urban funds to the County to
cover the City' s estimated jurisdictional share of the construction
cost. The City' s actual cost will be determined by a final account-
ing after completion of the project.
If the proposed agreement is satisfactory , please present it to
your duly authorized City officials for approval and execution.
Upon execution, please return three copies of the agreement to

the Road Department for further action. After final approval by
the Board of Supervisors, we will return one fully executed copy
to your City.
The Public Resources Code provides that this type of project, by
reason of the work proposed , does not have a significant effect
on the environment. Accordingly and pursuant to Section 15101,
Class 1 ( c) of the State Guidelines for Implementation of the
Environmental Quality Act of 1970, we have found that this proj-
ect is categorically exempt from the provisions of said Act.
If you concur that this project is categorically exempt, please
have your duly authorized City officials make such a finding in
the Resolution or Ordinance of consent to the jurisdiction.
However , if your Council is unable to make the necessary envi-
ronmental finding, Council action granting jurisdiction should
be deferred until the environmental finding can be made.
It should be noted that Sections 1701 and 1850 of the Streets
and Highways Code provide that the City may consent to the
County ' s request for jurisdiction by Resolution . In addition,
Section 65402 ( b) of the Government Code provides that the
City Council may find in such Resolution that the project
involves improvements of a minor nature . Enclosed is a draft
of a Resolution containing the finding which, if enacted , will
meet the requirements of these statutes and expedite the project.
When your City has adopted the Resolution or an Ordinance of
consent, please send three certified copies to the Road Department.

A G R E E M E N T
THIS AGREEMENT, made and entered into by and between the
CITY OF ARCADIA, a municipal corporation in the County of
Los Angeles , hereinafter referred to as "CITY" , and the COUNTY OF
LOS ANGELES, a political subdivision of the State of California ,
hereinafter referred to as "COUNTY" :
W I T N E S S E T H
WHEREAS , Santa Anita Avenue is on CITY' S and City of Temple City' s
Select System of Streets and on COUNTY ' S Highway Plan ; and
WHEREAS, CITY, City of Temple City and COUNTY propose to resur-
face the roadway pavement on Santa Anita from Live Oak Avenue to
Grand Avenue , modify median gutter , construct median catch basins
and place conduit for possible future street lighting, which work
is hereinafter referred to as "PROJECT" ; and
WHEREAS, PROJECT is within the jurisdictional limits of CITY,
City of Temple City and COUNTY; and
WHEREAS, PROJECT is in the general interest of CITY, City of
Temple City and COUNTY; and
WHEREAS, COUNTY proposes to administer the construction of
PROJECT under Federal-aid Urban Program; and
WHEREAS, CITY is willing to finance its jurisdictional share
of the cost of PROJECT; and
WHEREAS, CITY proposes to assign a portion of CITY FAU funds
to COUNTY to cover its share of the cost of PROJECT; and

WHEREAS, COUNTY is willing to accept this assignment of FAU
funds .
NOW, THEREFORE, in consideration of the mutual benefits to be
derived by CITY and COUNTY and of the premises herein contained , it
is hereby agreed as follows ;
( 1 ) CITY AGREES:
a. To finance CITY' S jurisdictional share of the cost
of PROJECT, currently estimated at $6, 300.
b. To assign $6, 300 in City FAU funds to COUNTY to cover
CITY' S estimated share of the cost of PROJECT.
c. Upon completion of PROJECT to maintain in good condi-
tion and at CITY expense , all improvements constructed
as part of project .
(2) COUNTY AGREES:
a. To prepare plans , specifications and cost estimates,
at no cost to CITY.
b. To accept the assignment of CITY FAU funds .
c. To advertise PROJECT for construction bids , to award
and to administer the construction contract, to do all
things necessary and proper to complete PROJECT in
accordance with approved plans , and to act in behalf
of CITY in all negotiations pertaining thereto.

d. To furnish CITY, within 120 days after completion of
PROTECT, a final accounting itemizing actual unit costs
and actual quantities for PROJECT.
( 3 ) IT IS MUTUALLY UNDERSTOOD AND AGREED AS FOLLOWS:
a. PROJECT costs, as referred to in this Agreement, shall
consist of the costs of construction survey , required
materials, construction , final signing and striping,
construction engineering , administration , and all other
work necessary to construct PROJECT in accordance with
approved plans . PROJECT costs shall also include cur-
rently effective percentages added to total salaries,
wages , and equipment costs to cover overhead , adminis-
tration, and depreciation in connection with any or
all of the aforementioned items . PROJECT costs shall
not include the cost of preparing plans , specifications
and cost estimates .
b. That CITY'S actual FAU assignment will equal its juris-
dictional share of the cost of PROJECT based upon the
final accounting.
c. If CITY'S share of the cost of PROJECT, based upon final
accounting , exceeds the estimated amount specified in
Section ( 1 ) , paragraph a . , CITY ' S FAU assignment shall
be increased accordingly . Conversely , if CITY ' S share
of the cost of PROJECT, based upon final accounting , is
less than said estimate , CITY ' S FAU assignment shall be

decreased accordingly. COUNTY shall notify the State of
said increase or decrease in CITY ' S FAU assignment .
d. That if, for some reason , CITY has insufficient FAU
funds as set forth in Section ( 1 ) paragraph b. and
Section ( 3 ) paragraph c above , CITY will pay additional
funds to COUNTY so that , when combined with the FAU funds
available , will equal CITY ' S jurisdictional share of the
cost of PROJECT, based upon the final accounting .
e. This Agreement shall not take effect unless and until
COUNTY, pursuant to Section 1700 of the Streets and
Highways Code of the State of California , declares the
portion of Santa Anita Avenue between PROJECT limits
lying within CITY and Temple City to be a COUNTY highway
for the construction of improvements thereon and CITY and
Temple City, pursuant to Section 1701 of aforementioned
Code , shall consent to said portion of street becoming a
COUNTY highway for said purpose .
f . Neither COUNTY, nor any officer or employee of COUNTY,
shall be responsible for any damage or liability oc-
curing by reason of anything done or omitted to be
done by CITY under or in connection with any work,
authority or jurisdiction delegated to CITY under
this Agreement. It is also understood and agreed
that , pursuant to Government Code Section 895. 4 , CITY
shall fully indemnify, defend and hold COUNTY harmless

from any liability imposed for injury ( as defined by
Government Code Section 810. 8 ) occurring by reason of
anything done or omitted to be done by CITY under or
in connection with any work , authority or jurisdiction
delegated to CITY under this Agreement .
g. Neither CITY, nor any officer or employee of CITY, shall
be responsible for any damage or liability occurring by
reason of anything done or omitted to be done by COUNTY
under or in connection with any work, authority or juris-
diction delegated to COUNTY under this Agreement . It is
also understood and agreed that , pursuant to Government
Code Section 895. 4, COUNTY shall fully indemnify , defend
and hold CITY harmless from any liability imposed for

injury ( as defined by Government Code Section 810. 8 ) oc-
curring by reason of anything done or omitted to be done
by COUNTY under or in connection with any work, authority
or jurisdiction delegated to COUNTY under this Agreement .
IN WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed by their respective officers , duly authorized , by the
CITY OF ARCADIA on , 1981, and by the
COUNTY OF LOS ANGELES On , 1981.
