ORDINANCE NO. 2216
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, AMENDING STORM WATER
AND URBAN RUNOFF CONTROLS FOR NEW
CONSTRUCTION
WHEREAS, under the provisions of the Porter-Cologne Act, the State Water
Resources Control Board (SWRCB) and nine regional water quality control boards
adopt policies and plans relating to water quality control in the State, which
together comprise the uniform water quality guidelines for California; and
WHEREAS, in December 2001, the Regional Board adopted Order No. 01-
182, which added additional categories of development projects requiring a
Standard Urban Stormwater Mitigation Plan (SUSMP) and replaced the previous
site visit with a requirement of site inspections; and
WHEREAS, on August 6, 2002, the City Council adopted additional
SUSMP requirements of the Regional Board, as required; and
WHEREAS, it is reasonable and appropriate for the City Council to amend
the Arcadia Municipal Code in order to comply with Order No. 01-182 adopted by
the California Regional Water Quality Control Board for Los Angeles County.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1.
Article VII, Chapter 8, Section 7823 subsection (c) of the
Arcadia Municipal Code is amended to read in its entirety as follows:

"(c) Best Management Practices for New Developments and
Redevelopments. No grading permit shall be issued for any development with a
disturbed area of one (1) acre or greater unless the applicant can show that (i) a
Notice of Intent to comply with the State Construction Activity Storm Water
Permit has been filed and (ii) a Storm Water Pollution Prevention Plan has been
prepared. The City may adopt regulations establishing controls on the volume and
rate of stormwater runoff from new developments and redevelopments of less than
one (I) acre as may be appropriate to minimize the discharge and transport of
pollutants. The Development Services Director may require that any developer or
construction contractor performing work in the City provide a Local Stormwater
Pollution Prevention Plan prior to the beginning of such work. Construction
activity does not include routine maintenance to maintain original line and grade,
hydraulic capacity, the original purpose of the facility or emergency construction
activities required to protect the public health and safety."
SECTION 2.
The City Clerk shall certify to the adoption of this
Ordinance and shall cause a copy or summary of same to be published in the
official newspaper of said City within fifteen (IS) days of its adoption.
