Please insert the date that your Mayor and City Clerk sign same. Please retain one for your City Clerk, Chief of Police and Attorney and return the other copies to the undersigned. AGREEMENT THIS AGREEMENT, made and entered into and effective this 19th day of November , 1969, by and between the City of Arcadia and the City of . Baldwin Park both of which are municipal corporations, organized and existing under and by virtue of the laws of the State of California; W I T N E S S E T H: WHEREAS, the parties hereto are geographically located in proximity to each other in the County of Los Angeles; and WHEREAS, it is to the mutual advantage and benefit of the parties hereto to render supplemental police protection to each other in the event of a disturbance or other local emergency of a magnitude that has developed or appears to be developing beyond the ability of the City's forces to maintain control and, therefore, requires suppl mc:rital assi5 Lance of the other party to control; NOW, THEREFORE, in consideration of their mutual covenants, the parties hereto agree as follows ; 1. In the event of any disturbance or other local emer- gency which cannot be met with the facilities of one of the parties, the other party agrees, upon request, to furnish aid in controlling such disturbance or local emergency upon either an actual, or standby basis . The extent of aid to be furnished under this agreement shall be determined solely by the party or department thereof furnishing such aid, and it is understood that the aid so furnished may be recalled at any time at the sole discretion of the furnishing party . 2. Details as to methods of requesting mutual aid and the names of persons authorized to send and receive such requests, -1- { • together with lists of equipment and personnel which will be subject to call, will be covered by correspondence between the parties and the Chiefs of Police thereof. 3. Personnel who are furnished will work as far as possible under their own supervisors, and equipment furnished will ordinarily be operated by personnel .of the party furnishing the equipment. General directions relative to the work will be given by the appropriate officers or persons of the party receiving such aid. 4. Neither party to this agreement .shall be required to pay any compensation to the other party for services rendered here- under; the mutual advantages and protections afforded by this agree- ment being considered adequate consideration for the services rendered. 5. This agreement covers day-to-day mutual aid only and shall be of no force and effect in cases in which a state of extreme emergency has been proclaimed and when the California Disaster and Civil Defense Master Mutual Aid Agreement becomes operative . 6. This Agreement does not relieve either of the parties hereto from the necessity and obligation of providing adequate police protection for persons and property within its own boundaries . 7. It is also mutually understood and agreed that aid and assistance pursuant to the terms of this Agreement will be called for only when, in the opinion of the police chief of the party requesting aid, it is deemed necessary to request outside assistance because all of the normal facilities at his command have been exhausted and outside assistance is needed to control and suppress a disturbance or other local emergency. • _2_ • _ r..• 8. This Agreement shall not he construed as or deemed to' be an agreement .for the benefit of any third party or parties, and no third pa.rty• or parties shall have any right of action hereunder for any cause whatsoever. Any services performed or expenditures made in connection with furnishing mutual aid under this Agreement by either party hereto shall be deemed conclusively to be for the direct protection and benefit of the inhabitants and property of such party. 9 . This Agreement may be terminated at any time by either party, upon thirty days ' written notice to the other and, the termination shall be effective upon the date specified in the notice .
