THIS AGREEMENT, made and entered into and effective on this 10th
day of December , 1974 , by and between the City of Arcadia and
the City of El Monte, both municipal corporations, organized and existing under
and by virtue of the laws of the State of California.
W I T N E S S E T H
WHEREAS, the parties hereto are geographically located in proximity to
each other in the County of Los Angeles and other counties contiguous thereto;
and •
WHEREAS, each City furnishes to the other mutual aid on a day-to-day basis;
and
WHEREAS, it is to the mutual advantage and benefit of the parties hereto
that fire fighting personnel of the City of Arcadia maintain a high degree of
skill in fire fighting operations, and
WHEREAS, maintenance of such skills requires periodic training at a drill
tower; and
WHEREAS, the City of El Monte has a training tower which is located within
a close proximity to the City of Arcadia;
NOW, THEREFORE, in consideration of their mutual convenants, the parties
hereto agree as follows: •
1. The City of El Monte shall reserve for exclusive use by the City of
Arcadia the El Monte Fire Department drill tower and grounds on
every Sunday for the period of this Agreement.
2. In consideration of the exclusive use of the drill tower and grounds
on Sundays, the City of Arcadia shall pay to the City of El Monte
five hundred dollars ($500.00) per annum. Such payment shall be
made within thirty days of the signing of this contract by both
parties, and shall be paid annually on or about the same date as
the original payment, unless terminated as hereinafter set forth.

3. The City of El Monte further agrees to keep and maintain said
tower in good repair and shall be responsible for any repair or
maintenance to the drill tower or grounds occurring as a result of
the normal wear and tear of training operations by the Arcadia Fire
Department.
4. The City of Arcadia shall be responsible for any extraordinary
damage occurring to the drill tower or grounds as a result of
training operations by the Arcadia Fire Department. A report of
any such extraordinary damage shall be submitted to the City of
Arcadia by the City of El Monte. The City of Arcadia shall have
the option of making necessary repairs, or may authorize the City
of El Monte to proceed with such repairs, and therefore assume the
liability for any reasonable costs incurred.
5. The City of Arcadia agrees to save and hold harmless the City of
El Monte from any liability for damage or injury to any person or
property arising from the City of Arcadia operations covered by
this Agreement.
6. This Agreement shall not be construed as or deemed to be an
agreement for the benefit of any third party or parties, and no
third party or parties shall have any right of action hereunder
for any cause whatsoever.
7. This Agreement shall become effective immediately, and continue for
a one year period, and thereafter from year to year unless terminated
by written notice by one party to the other at least 60 days prior
to the anniversary date of the Agreement. It may be modified or
amended by mutual consent, but any such alteration shall be in
writing.

IN WITNESS WHEREOF, the Agreement has been executed the day and year
first written above by the parties hereto through their respective Mayors
first thereunto duly authorized by their respective City Councils.
