HomeMy WebLinkAbout2165 ORDINANCE NO. 2165 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA , CALIFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE TO ADD A SUBSECTION 14 TO SECTION 9264.2.9 AND AMENDING SECTION 9275.1.39.3 TO ALLOW AUTOMOBILE FUELING STATIONS IN THE CBD/CENTRAL BUSINESS DISTRICT ZONE, SUBJECT TO A CONDITIONAL USE PERMIT. WHEREAS, on May 22, 2002, Mr. Leon E. Felus filed application no. TA 2002-001 to amend the Arcadia Municipal Code to add Automobile Fueling Stations to the list, "Uses Subject To A Conditional Use Permit" in the CBD/Central Business District Zone; and WHEREAS, a public hearing was held before the Planning Commission of the City of Arcadia on July 23, 2002, at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the Planning Commission recommended approval of the requested text amendment to the City Council of the City of Arcadia; and WHEREAS, a public hearing was held before the City Council on August 20, 2002, at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the City Council hereby finds that the primary purpose of the CBD/Central Business District Zone is to promote a strong pedestrian orientation through a mix of permitted uses and specific development standards. After significant review, and several years of implementation, the City Council has recognized that East Huntington Drive is not a traditional central business district street, but is a four-lane major arterial that intersects with the 210 Freeway and that commuter-related uses are a convenience to the community. However, because of the primary purpose of the CBD Zone, any automobile related use must be carefully designed so as not to interfere with, or significantly detract from the pedestrian environment fostered by the CBO Zone; and WHEREAS, the City Council determines that based upon the evidence presented, Automobile Fueling Stations, subject to a Conditional Use Permit can serve the public necessity, convenience and general welfare, and therefore the proposed text 2165 amendment ;s justified. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: Section 1. That Section 92642.9 of the Arcadia Municipal Code be amended by adding thereto Subsection 14 to read as follows: "14. Automobile Fueling Stations as described In and subject to Section 9275.4.7, subsection 4." Section 2. That Section 9275.1.39.3 of the Arcadia Municipal Code be amended to read as follows: "9275.1.39.3. Automobile Fueling Stations. CSD and C-1 or any less restrictive commercial or industrial zone." Section 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption.
