HomeMy WebLinkAbout2169 URGENCY ORDINANCE NO. 2169 AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA PROHIBITING THE PROCESSING OF MUL TIPLE- FAMILY PROJECTS LOCATED ON R-2 AND R-3 ZONED PROPERTIES WITH THE EXCEPTION OF PLANS THAT HAVE BEEN ACCEPTED FOR FORMAL PLAN CHECK WITH THE CITY'S DEVELOPMENT SERVICES DEPARTMENT PENDING THE COMPLETION OF AMENDMENTS TO THE CITY'S R-2 AND R-3 ZONING REGULATIONS THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. This interim urgency ordinance is adopted pursuant to Section 65858 of the California Government Code for the immediate protection of the public health, safety and welfare of the residents of the City of Arcadia. SECTION 2. The City of Arcadia shall not process applications for, or issue any permits or approvals with respect to any architectural design review, modification, plan check submitted after October 1,2002, subdivision, or other land use entitlement(s) for multiple-family projects located in any R-2 or R-3 zone within the City of Arcadia during the time that this interim urgency ordinance is in effect. Notwithstanding any provision herein to the contrary, subdivision applications may be processed and approved and permits may be issued for construction of multiple-family projects with respect to any project for which a plan check application was received by the City on or prior to October 1, 2002. SECTION 3. The City Council hereby finds, determines and declares that this interim urgency ordinance is necessary for the current and immediate protection of the public health, safety and welfare of the residents of the City of Arcadia for the following reasons: A. The Development Services Department of the City of Arcadia is considering and proposing major amendments to the R-2 and R-3 zoning code provisions of the City which may affect setbacks, entry heights, parking, open space and other regulations. Thus, continued development of potentially inconsistent and incompatible uses under the existing zoning regulations contrasted with the development which may occur following the consideration and possible adoption -1- 2169 of new regulations, will have a detrimental effect on residents and property owners within R-2 and R- 3 zones. The existing regulations contain standards which, under current conditions and circumstances found within R-2 and R-3 zones within the City, are inadequate and outdated, and which may not provide for sufficient open space, parking, traffic circulation and landscaping, among other factors, to provide residents within the R-2 and R-3 zones a suitable and reasonable safe environment within which to reside. B. Moreover, continued development under existing development standards will have a detrimental effect upon the City's ability to implement comprehensive community design plans and public improvement programs since it is possible that revised development standards will be generated that are different from and incompatible with existing development standards. The sizing and layout of public improvements will depend, in large part, upon the density standards and design of development in R-2 and R-3 zones. It is important for the City to have in place revised R-2 and R- 3 development standards and regulations in order to proceed with the City's determination of public infrastructure needs, and to relate such needs to development standards which are modern, reasonable, supported by current conditions within the R-2 and R-3 zones and well thought-out. C. Pursuant to the recital offacts contained in subsections A and B, above, approval of additional land use entitlements would result in a current and immediate threat to the public health, safety and welfare. SECTION 4. Ten (10) days prior to the expiration of this interim urgency ordinance, and any extension thereof, the City Council shall issue a written report describing the measures which the City has taken to alleviate the conditions which led to the adoption of this interim urgency ordinance. SECTION 5. This interim urgency ordinance shall take effect immediately upon its adoption by a four-fifths vote of the City Council. This interim urgency ordinance shall continue in effect for forty-five (45) days from the date of its adoption and shall thereafter be of no further force and effect unless, after notice pursuant to California Government Code Section 65090 and a public hearing, the City Council extends this interim urgency ordinance pursuant to California Government Code -2- 2169 Section 65858. Prior to the expiration of fifteen (15) days from the passage of this interim urgency ordinance, the ordinance, or a summary of the ordinance, along with the names of the City Council members voting for and against the ordinance, shall be published in a newspaper of general circulation in the City of Arcadia.
