URGENCY ORDINANCE NO. 2170
AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ARCADIA EXTENDING INTERIM URGENCY
ORDINANCE NO. 2169 PROHIBITING THE PROCESSING OF
MUL TIPLE-F AMIL Y PROJECTS LOCATED ON R-2 AND R-3
ZONED PROPERTIES WITH THE EXCEPTION OF PLANS THAT
HA VE BEEN ACCEPTED FOR FORMAL PLAN CHECK WITH THE
CITY'S DEVELOPMENT SERVICES DEPARTMENT PENDING THE
COMPLETION OF AMENDMENTS TO THE CITY'S R-2 AND R-3
ZONING REGULATIONS
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION I.
On October 1, 2002, the City Council adopted a 45 day
interim urgency ordinance ("Ordinance No. 2169") prohibiting the processing of any
multiple-family projects located on R-2 and R-3 zoned properties, with the exception
of plan check applications received by the City, on or prior to October I, 2002,
pending the completion of amendments to the City's R-2 and R-3 zoning regulations.
By its terms, Ordinance No. 2169 expires on November 15,2002, unless extended by
the City Council.
SECTION 2.
This interim urgency ordinance is adopted pursuant to
Section 65858 ofthe California Government Code to extend the term of Ordinance No.
2169 for an additional period often (10) months and fifteen (15) days to and including
October 1,2003. In accordance with California Government Code Section 65858, the
City Council hereby finds, determines and declares that this interim urgency ordinance
is necessary for the current and immediate protection of the public health, safety and
welfare of the residents of the City of Arcadia for the following reasons:
A. The Development Services Department of the City of Arcadia is
considering and proposing major amendments to the R-2 and R-3 zoning code
provisions of the City which may affect setbacks, entry heights, parking, open space
and other regulations. Thus, continued development of potentially inconsistent and

incompatible uses under the existing zonmg regulations contrasted with the
development which may occur following the consideration and possible adoption of
new regulations, will have a detrimental effect on residents and property owners within
R-2 and R-3 zones. The existing regulations contain standards which, under current
conditions and circumstances found within R-2 and R-3 zones within the City, are
inadequate and outdated, and which may not provide for sufficient open space,
parking, traffic circulation and landscaping, among other factors, to provide residents
within the R-2 and R-3 zones a suitable and reasonably safe environment within which
to reside.
B. Moreover, continued development under existing development
standards will have a detrimental effect upon the City's ability to implement
comprehensive community design plans and public improvements programs since it is
possible that revised development standards will be generated that are different from
and incompatible with existing development standards. The sizing and layout of public
improvements will depend, in large part, upon the standards and design of
development in R-2 and R-3 zones. It is important for the City to have in place revised
R-2 and R-3 development standards and regulations in order to proceed with the City's
determination of public infrastructure needs, and to relate such needs to development
standards which are modern, reasonable, supported by current conditions within the R-
2 and R-3 zones and well thought-out.
C. Pursuant to the recital of facts contained in subsections A and B,
above, approval of additional land use entitlements would result in a current and
immediate threat to the public health, safety and welfare.

SECTION 3. The City Council hereby adopts as the written report and
findings described in Government Code Section 65858 that certain Staff Report
presented to the City Council together with this interim urgency ordinance.
SECTION 4. Ordinance No. 2169 is extended for a period of ten (10)
months and fifteen (15) days, to and including October I, 2003, unless sooner
terminated by the City Council following consideration of amendments to the City's R-
2 and R-3 zoning regulations.
SECTION 5.
This interim urgency ordinance shall take effect immediately
upon its adoption by a four-fifths vote of the City Council and shall continue in effect
to and including October I, 2003; and shall thereafter be of no further force and effect
unless, after notice pursuant to California Government Section 65090 and a public
hearing, the City Council extends Ordinance No. 2169 and this interim urgency
ordinance pursuant to California Government Code Section 65858.
SECTION 6. The City Clerk shall certify the adoption of this Ordinance and
shall cause a copy of the same to be published in the official newspaper of the City of
Arcadia within fifteen (15) days after its adoption.
