HomeMy WebLinkAbout2110 ORDINANCE NO. 2110 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA CHANGING THE ZONING FROM CPD-1 (COMMERCIAL PLANNED DEVELOPMENT) TO CoM (COMMERCIAUMANUFACTURING) FOR THE PROPERTY LOCATED AT 324 NORTH SECOND AVENUE WHEREAS, on April 4, 1999, Donald and Robert Johnson, filed an application to change the zoning from CPD-1 (Commercial Planned Development) to CoM (Commercial/Manufacturing, Community Development Division Case No. Z-99-002, on the property located at 324 North Second Avenue, more particularly described as set forth in Attachment A WHEREAS, a public hearing was held May 11, 1999, before the Planning Commission at which time all interested persons were given full opportunity to be heard and to present evidence, and WHEREAS, the Planning Commission of the City of Arcadia recommended approval of subject zone change to the City Council, and WHEREAS, the City Council conducted a public hearing concerning the zone change on June 15,1999, and approved said zone change. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the proposed CoM (Commercial/Manufacturing) zoning is more appropriate for the site because it allows more flexibility in the types of uses permitted including any use permitted in the C-2 (General Commercial) zone as well as wholesale businesses, storage buildings, light industrial uses and warehouses. The Map contained in Section 9233.8 of the Arcadia Municipal Code is hereby amended to reclassify and designate the described property as Zone CoM. Section 2. The City Council finds and determines that the CoM zoning designation is the most appropriate designation for this property because the property has some unique characteristics that are not typical to most commercial sites in the City; the site is isolated from other commercial parcels in the same general area; the uses surrounding the site are predominantly industrial in character (the Edison substation and the City Water Tanks) or public use in nature (the 210 Freeway -1- 2110 overpass and the flood control channel); and the public health, safety, general welfare and good zoning practice justify the proposed zone change. Section 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of said City within fifteen (15) days after its adoption. ALFORD, City Clerk of the City of Arcadia, hereby certify that the foregoing Ordinance No. 2110 was passed and adopted by the City Council of the City of Arcadia, signed by the Mayor and attested to by the City Clerk at a regular meeting of said Council on the 20th day of Julv , 1999, and that said Ordinance was adopted by the following vote, to wit: AYES: CouncilmeI'lber Harbicht, Kovacic, Marshall, Roncelli and Chandler NOES: None ABSENT: None Cit -2- 2110 ATTACHMENT "A" Legal Description, 324 North Second Avenue, Arcadia, CA: Those portions of Lots 7 and 23, in Block 84 of the Santa Anita Tract, in the City of Arcadia, in the County of Los Angeles, Sate of California, as per map recorded in Book 34, Pages 41 and 42 of Miscellaneous Records, in the Office of the County Recorder of said county, described as a whole as follows: Beginning at the intersection of the westerly line of said Lot 7 with the northerly line of the land described in the deed to the Pacific Electric Railway Company, recorded in Book 1576, Page 296 of Deeds, records of said county; thence easterly along said northerly line 384.91 feet; thence northwesterly in a direct line to a point in the westerly line of said Lot 12; distant northerly 505.85 feet, measured along the westerly lines of said Lots 7 and 12, from the point of beginning; thence southerly along said westerly lines, 505.85 feet to the point of beginning.
