HomeMy WebLinkAbout2119 ORDINANCE NO. 2119 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 9273.1.10.1 AND ADDING SECTIONS 9273.1.18 AND 9273.2.10 TO THE ARCADIA MUNICIPAL CODE RELATING TO PERMITTED USES IN THE S-l ZONE AND ESTABLISHING PERFORMANCE STANDARDS FOR CERTAIN NIGHTTIME ACTIVITIES WHEREAS, this text amendment (T.A. 00-001) was initiated by the Los Angeles Turf Club (LA TC) requesting the following changes and additions to the S-l (Special Use) zoning regulations (1) to allow horseracing and other events to be telecast via satellite feed seven days a week until no later than 1 :30 a.m.; (2) to allow for year-around usage of the enclosed restaurant located in the grandstand area for non-horseracing activities; and (3) to use the big screen monitor- in the infield for code permitted uses at the track; and WHEREAS, a public hearing was held on January 25, 2000 before the Planning Commission at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the Planning Commission of the City of Arcadia recommended approval of the usage of the restaurant and the big screen monitor, but further recommended that the extension of days and hours for horse racing and other 1 2119 events via satellite feed be allowed only with an approved conditional use permit; and WHEREAS, public hearings were held before the City Council on March 7th and May 2nd, 2000 at which time all interested persons were given full oppor- tunity to be heard and to present evidence; and WHEREAS, the S-l (Special Use) zone is the underlying zone of the Santa Anita Race Track property and said zone identifies special uses that are allowed in this zone. The predominant permitted uses set forth for the S-l zone are typical of activities that take place at the Race Track throughout the year and with the exception of horse racing, most are temporary in nature; and WHEREAS, the existing code permits horse racing via satellite feed on Friday and Saturday nights until 1 :30 a.m., and the proposed text amendment would allow horse racing and other events via satellite feed seven days a week until no later than 1 :30 a.m. In addition, this text amendment would allow the operation of the big screen monitor in the infield for all code permitted uses; and WHEREAS, the City Council hereby finds that allowing the operation of the big screen monitor in the infield for code permitted activities and permitting the use of satellite feed for horse-racing and other activities seven nights a week until 1 :30 a.m. with the appropriate performance standards would have a negligible impact on the adjoining neighborhoods. 2 2119 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 9273.1.10.1 of the Arcadia Municipal Code is amended to read as follows: 9273. 1.10. 1. Horse racing with or without pari-mutuel wagenng on the results thereof, sporting events and special events of a national or international significance as determined by the Development Services Director, shall be allowed seven (7) days a week, except between the hours of 1 :30 a.m. and 8:00 ( a.m:; provided that such events are displayed by telecast, telephone, satellite and/or cable feed, or similar transmission and are not events conducted live at the race track. Such events shall comply with the performance standards set forth in Section 9273.2.10. SECTION 2. That Section 9273.1.18 is added to the Arcadia Municipal Code to read as follows: 9273.1.18. Use of the big screen monitor in the infield shall be allowed for all S-l code permitted uses. There shall be no outdoor sound amplification or use of outdoor loudspeakers in conjunction with the use of the big screen monitor other than during live horse racing at this track. SECTION 3. That Section 9273.2.10 is added to the Arcadia Municipal Code to read as follows: 3 2119 9273.2.10. The following performance standards shall be applied to activities permitted via satellite feed as set forth in Section 9273.1.1 0.1. a. No persons, other than employees of the race track, shall be allowed in the unenclosed areas of the grandstand and race track between the hours of6:00 p.m. and 8:00 a.m.; except that between 6:00 p.m. and 10:00 p.m., up to 3,500 patrons of the racetrack may occupy the outside box seat, Club Court and Turf Club areas existing at the racetrack as of May 2, 2000 in order to watch and listen to individual televisions located at tables therein or to view the big screen monitor in the infield of the racetrack. b. There shall be no outdoor sound amplification or use of outdoor loudspeakers between the hours of6:00 p.m. and 8:00 a.m. c. Windows in the enclosed restaurant located within the grandstand structure shall be closed between the hours of 6:00 p.m. and 8:00 a.m. d. There shall be no parking fee for events taking place after 6:00 p.m. The northerly parking lot shall not be utilized for patron parking. e. In the event that the racetrack desires to conduct an outdoor event beyond 10:00 p.m., but in no case continuing past 11 :00 p.m., then the racetrack may submit a written application to the Development Services Director at least four (4) weeks prior to the date proposed for such event. The Development Services Director shall approve the application, with or without conditions, if 4 2119 he/she finds that conducting the event past 10:00 p.m. will not be harmful to the enjoyment of property by residents nearby the racetrack, will not be materially detrimental to property values nearby the racetrack, and will not harm the public health, safety and welfare. The decision of the Development Services Director may be appealed in writing to the City Manager within five (5) calendar days following the date of the Director's decision. The City Manager may approve, with or without conditions the application upon making the aforesaid findings. SECTION 4. Section 1 of this Ordinance shall remain in effect for a period of one (1) year following the effective date of this Ordinance, at which time Section 1 of this Ordinance will terminate unless extended by ordinance of the City of Arcadia following a noticed public hearing. In determining that a one (1) year amortization for the termination of the uses set forth in Section 1 of this Ordinance is reasonable and appropriate, the City Council has taken into consideration the following: that this amortization period is made known to all owners of property in the S-l Zone in advance of the adoption of this Ordinance, and that the owners of property in the S-l Zone will likely not, and will not be reasonably required to, expend significant funds in installing permanent improvements solely for the purpose of pursuing the uses set forth in Section I of this Ordinance, and which could not also be used for other uses permitted in the S- 1 Zone. 5 2119 SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of said City within fifteen (15) days after its adoption.
