RECOMMENDING APPROVAL OF A JOINT POWERS AGREEMENT
WITH THE CITY OF' ARCADIA FOR ASSISTANCE IN LAND-
SCAPING A SEGMENT OF THE SANTA ANITA WASH RIDING
AND HIKING TRAIL
(FIRST SUPERVISORIAIJ DISTRICT)
The following RECOMMENDATIONS are submitted:
1. That your Board execute the attached Joint Powers
Agreement with the City of Arcadia for assistance
in landscaping a segment of the Santa Anita Nash
Riding and Hiking Trail.
2. That the Executive Officer-Clerk of the Board be
instructed to forward the executed original and
five copies of the Joint Powers Agreement to the
Department of Parks and Recreation for distribution
to the City of Arcadia.
The purpose of this Joint Powers Agreement with the City of Arcadia
is to provide funds for tile landscaping of a 3.5 mile segment of the
Santa Anita Wash Riding and Hiking Trail entirely within that city.
On November 5, 1974, the Arcadia City Council executed a Joint Powers
Agreement, which when executed by Los Angeles County will provide
funding for this project cost of $8,000.00 th 11 contribute
approximately $4,000.00. The total project cdW involve $2,500.00
to obtain and plant the trees, and $5,500;0($( M'rCfnSiiiteAahbe of the

The project will involve planting 1055 trees along the Santa Anita
Wash Riding and Hiking Trail within Arcadia. Existing work forces
of the County Forester and Fire Warden will obtain and plant the
material, and then maintain the plants for three years. The
existing crews of the Department of Parks and Recreation will main-
tain the plant material on an as needed basis after the initial
three year maintenance period.
Funds for this project have been identified in the 1974-75 County
Budget as Capital Project No. 8816.48 and we have determined that the
project is categorically exempt under Class 4-Minor Alterations To
Land as per the County's adopted environmental reporting procedures
and guidelines. The attached Joint Powers Agreement with the City
of Arcadia has been reviewed and approved by County Counsel.

JOINT POWERS AGREEMENT
WITH THE CITY OF ARCADIA

This greement, made and entered into this //62Z-.16 day of

By and between
County of Los Angeles, a
body corporate and politic,
hereinafter referred to as
"County, "
And
1
City of Arcadia, hereinafter
referred to as "City,"
Witnesseth:
Whereas, Title 1, Division 7, Chapter 5, of the Governmental
Code of the State of California establishes a procedure for the
exercise of powers common to contracting parties where those
parties are within the definition of the term "public agency; "
and
Whereas, the County and the City are within the term "public
agency; " and
Whereas, County and City desire to enter into a joint powers
agreement for the purpose of landscaping approximately three and
one-half miles of the west side of the Santa Anita Wash adjacent
to the existing equestrian and hiking trail situated within the
City; and
Whereas, County and City desire to enter into a joint powers
agreement to maintain said landscaping for a period of three years
from the time of the completion of planting; and
Whereas, the County and City have deemed that it will be
in the best interest of the citizens of their respective communities
to establish such landscaping by jointly cooperating therein;
Now, Therefore, in consideration of the mutual promises,
covenants and condition hereinafter contained, the parties, and
each of them do agree as follows:

1. The County agrees to cause to be planted 1055 trees
o along approximately a three and one-half mile
segment of the west side of the Santa Anita Wash Riding
and. Hiking Trail within the City, said plant material
installation to be completed in accordance with the
specifications approved by the County. The County agrees
to perform any and all supervision and inspection as may
be necessary, it being the intention of the parties that
the County is to have primary control over all operations
affecting this project. The County agrees that the City,
through its authorized representatives, shall have the
right to be present at all times during the planting
period to advise and make recommendation to the County
where necessary.
2. The County agrees to perform any and all acts and bear
any and all expenses necessary for the proper maintenance,
repair and upkeep of the plant material in the healthy
state for a period of three years after initial planting.
3. The City agrees to pay fifty percent of the actual costs and
expenses attributable to the plant material installation
and maintenance of said plant material, not to exceed
$4,000.00. The City herewith deposits with the County the
sum of Four Thousand and No/100 Dollars ($4,000.00) toward
that purpose. The actual costs and expenses attributable
to the said installation of plant material and maintenance
of said planted material for three years shall include the
following costs: purchase price of 1055 trees,
manpower, equipment and materials to install the plant
materials, and manpower, equipment and materials to maintain
the planted materials in a healthy state for a period of
three years from the time of planting.
Upon completion of the entire project the County agrees
to render a final accounting to the City. If the
expenses herein agreed to be paid by the City are less
than $4,000.00 the County shall refund to the City that
portion of said $4,000.00 which is in excess of fifty
percent of the actual costs and expenses attributable to
said landscaping and maintenance.
4. It is understood and agreed that in the event the County
fails or neglects, for any reason, to install the plant
material and begin the three year maintenance period
within a period of twelve (12) months from the date of
execution of this agreement, all sums transmitted here-
under shall be refunded to the City on demand.

5. The County agrees to save, keep and hold harmless the
City and all its officers and agents from all damages,
costs or expenses in law or equity (including costs of
suit and expenses for legal services) that may at any
time arise or be set up because of damages to property
or death or injury to persons received or suffered by
reason of the operations of the County hereunder or
which may be occasioned by any negligent act or omission
to act which amounts to negligence on the part of the
County or any of its agents or employees or any act or
omission to act on the part of said County, its agents or
employees which results in a dangerous or defective
condition of property or the maintenance of a dangerous
or defective condition of property, until said plant
material installed and maintenance is completed.
In Witness Whereof, the County of Los Angeles, by order of its
Board of Supervisors has caused this agreement to be executed on
its behalf by the Chairman of said Board and attested by the Clerk
thereof, and the City of Arcadia has executed the day, month, and
year first above written.
