HomeMy WebLinkAbout2123 URGENCY ORDINANCE NO. 2123 AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA PROHIBITING THE APPROVAL OF ALL LAND USE ENTITLEMENTS AND PERMITS ON CERTAIN PROPERTY GENERALLY LOCATED AT 2606, 2615 GREENFIELD, 260 I, 2600, 2607 LEE AVENUE, 2601 AND 2600 SECOND AVENUE, 2601 AND 2600 THIRD A VENUE, 2601 AND 2536 FOURTH A VENUE FOR A PERIOD OF 45 DAYS, PENDING THE COMPLETION OF A LAND USE STUDY AND THE ADOPTION OF ANY AND ALL AMENDMENTS TO THE CITY'S LAND USE REGULATIONS THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINEANp ORDAIN AS FOLLOWS: '. .1 . .' SECTION 1. This interim urgency'ordinance is adopted pursuant to Section 65858 of the California Government Code for the immediate protection of the public health, safety and welfare of the residents of the City of Arcadia. SECTION 2. The City of Arcadia shall not issue or approve any building permit, conditional use pertuit, variance, subdivision map or other land use entitlement for any development or land use on any properties described in the attached Exhibit "A;"("Study Area") duriIig:!htnime that this ihterim urgency ordinance is in effect. A graphic repr~sentation'ofthe properties 'and the boundaries of the Study Area is also ref1~cted in the attached Exhibit "B." 1 2123 SECTION 3. The City Council hereby finds, determines and declares that this interim urgency ordinance is necessary for the current and immediate protection of the public health, safety and welfare of the residents of the City of Arcadia for the following reasons: A. The General Plan and Zoning Ordinance of the City are currently inconsistent regarding the density of residential development allowed in the Study Area. The City intends to conduct a comprehensive land use study of the Study Area. The study will evaluate the appropriate density, suitability of development, development standards and needed infrastructure for the Study Area in order to meet the goals of the City's General Plan. Thus, continued development of potentially inconsistent and incompatible uses under the existing zoning regulations will have a det~imental effect on the City's ability to implement its General Plan goals and policies. B. Moreover, continued development under existing development standards will also have a detrimental effect upon the City's ability to implement comprehensive community design plans and public improvement programs since it is possible that revised development standards will also be generated that are different and incompatible with existing development standards. 2 2123 C. Pursuant to the recital of facts contained in subsections A and B, above, approval of additional land use entitlements would result in a current and immediate threat to the public health, safety and welfare. SECTION 4. Ten (10) days prior to the expiration of this interim urgency ordinance, or an extension thereof, the City shall issue a written report describing the measures which the City has taken to alleviate the conditions which led to the adoption of this interim urgency ordinance. SECTION 5. This interim urgency ordinance shall take effect immediately upon its adoption by a four-fifths vote of the City Council. This interim urgency ordinance shall continue in effect for forty-five (45) days from the date of its adoption and shall thereafter be of no further force and effect unless, after notice pursuant to California Government Code Section 65090 and a public hearing, the City Council extends this interim urgency ordinance pursuant to California Government Code Section 65858. Prior to the expiration of fifteen (15) days from the passage of this interim urgency ordinance, the ordinance, or a summary of the ordinance, along with the names of the City Councilmembers voting for and against the ordinance, shall be published in a newspaper of general circulation in the City of Arcadia. 3 2123 Passed, approved and adopted this 20th day of June ATTEST: 221<;:Al ~-\ APPROVED AS TO FORM: ~P.~ Stephen P.
