ORDINANCE NO. 2126 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA EXTENDING ORDINANCE NO. 2123 TO PROHIBIT THE APPROVAL OF CERTAIN LAND USE ENTITLEMENTS AND PERMITS ON PROPERTY GENERALLY LOCATED AT 2606,2615 GREENFIELD, 2601, 2600, 2607 LEE AVENUE, 2601 AND 2600 SECOND AVENUE, 2601 AND 2600 THIRD AVENUE, 2601 AND 2536 FOURTH AVENUE FOR AN ADDITIONAL PERIOD OF TEN (10) MONTHS, FIFTEEN (15) DAYS, FROM THE DATE OF EXPIRATION OF ORDINANCE NO. 2123, PENDING THE COMPLETION OF A LAND USE STUDY AND THE ADOPTION OF ANY AND ALL AMENDMENTS TO THE CITY'S LAND USE REGULATIONS THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. On June 20, 2000, the City Council adopted a 45 day interim urgency ordinance (Ordinance No. 2123) prohibiting the construction of all multi-family residential units on properties generally located at 2606 and 2615 Greenfield; 2601, 2600 and 2607 Lee Avenue; 2601 and 2600 Third Avenue; and 2601 and 2536 Fourth Avenue (also known as Assessor Parcel Nos. 5789-020-007, 5789-021-015, 5789-020-022, 5789-020- 024,5789-020-023,5789-020-018, 5790-027-028, 5790-027-003, 5790-028-021, 5790- 028-003 and 5790-030-007) (hereinafter the "Study Area"). By its terms, Ordinance No. 2123 expires on August 4, 2000. SECTION 2. This interim urgency ordinance is adopted pursuant to Section 65858 of the California Government Code to extend the previous 45 day moratorium on land use entitlements adopted by ordinance No. 2123 for an additional period of ten (10) months and fifteen (15) days. In accordance with California Government Code Section 65858, the City Council hereby finds, determines and declares that this interim urgency ordinance is 2126 ,- .. .. ,. .. t .. .{" ." ,1,.;.- ,.' . '. Jr, _, ,.:". l .. ... . \. ....... necessary for the current and immediate protection of the public health, safety and welfare of the residents of the City of Arcadia for the following reasons: A. The General Plan and Zoning Ordinance of the City are currently inconsistent regarding the density of residential development allowed in the Study Area. The City is in the process of conducting a comprehensive land use study of the Study Area. The study will evaluate the appropriate density, suitability of development, development standards and needed infrastructure for the Study Area in order to meet the goals of the City's General Plan. Thus, continued development of potentially inconsistent and incompatible uses under the existing zoning regulations will have a detrimental effect on the City's ability to implement its General Plan goals and policies. B. Moreover, continued development under existing development standards will also have a detrimental effect upon the City's ability to implement comprehensive community design plans and public improvement programs since it is possible that revised development standards will also be generated that are different and incompatible with existing development standards. C. Pursuant to the recital of facts contained in subsections Band C, above, approval of additional land use entitlements inconsistent with the General Plan would result in a current and immediate threat to the public health, safety and welfare, SECTION 3. The City of Arcadia shall not issue or approve any building permit for any type of use other than one (1) single-family dwelling unit on a lot, conditional use permit, variance, subdivision map or other land use entitlement for any development or land use on any properties described in the attached Exhibit "A" ("Study Area") during the -2- 2126 ---, ...... .~ -. .. .,."... . A graphic representation of the properties and the boundaries of the Study Area are also reflected in the attached Exhibit liB." SECTION 4. This interim ordinance shall take effect immediately upon its adoption by a four-fifths vote of the City Council and upon the expiration of Ordinance 2123. This interim urgency ordinance shall continue in effect for ten (10) months, fifteen (15) days from the date of expiration of Ordinance 2123 on August 4,2000 until ten (10) months and fifteen (15) days thereafter, on June 16, 2001; and shall thereafter be of no further force' and effect unless, after notice pursuant to California Government Code Section 65090 and a public hearing, the City Council extends this interim urgency ordinance pursuant to California Government Code Section 65858. SECTION 6. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of said City within fifteen (15) days after its adoption.
