HomeMy WebLinkAbout2130 ORDINANCE NO. 2130 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ADDING SECTIONS 7823(k) AND 7824 TO, AND AMENDING SECTION 8130.11 OF THE ARCADIA MUNICIPAL CODE PERTAINING TO THE IMPLEMRNT A TION OF STORM WATER AND URBAN RUNOFF CONTROLS FOR NEW CONSTRUCTION, AND IMPOSING RELATED SERVICE FEES WHEREAS, the State Water Resources Control Board and nine regional control boards adopt policies and regulations relating to water quality control in the state, which together comprise the water quality requirements for California; and WHEREAS, these boards also implement portions of the Federal Water Pollution Control Act, as amended (the Clean Water Act), and administer the National Pollutant Discharge Elimination System (NPDES) permit program; and WHEREAS, in July 1996, the California Regional Water Quality Control Board, Los Angeles Region (Regional Board), issued a municipal separate storm sewer system NPDES permit to the County of Los Angeles, as Principal Permittee, and eighty-five incorporated cities, including the City of Arcadia, as co-permittees to control and minimize the discharge of pollutants associated with storm water and urban runoff; and 1 2130 WHEREAS, the County-wide NPDES pennit requires each permittee to develop and implement a program of development planning and construction control measures in accordance with Best Management Practices (BMPs) and a model Standard Urban Stonn Water Mitigation Plan (SUSMP) to be developed by the pennittees and approved by the Executive Officer of the Regional Board; and WHEREAS, all Los Angeles County pennittees have until September 8, 2000, to adopt ordinances to incorporate the SUSMP requirements and until October 8, 2000 for the new ordinance provisions to take effect. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Section 7823(k) is hereby added to the Arcadia Municipal Code to read as follows: "(k) Standards for Private Drains and Catch Basins. Persons owning or operating drainage facilities that are directly connected to the public storm drain system shall clean those facilities between May 1 and September 30 of each year, and re-clean those facilities, as needed, before their sumps are forty percent (40%) full of material. This requirement includes, but is not limited to, catch basins, culverts and parkway drains." SECTION 2. Section 7824 is hereby added to the Arcadia Municipal Code to read as follows: 2 2130 "7824. STANDARD URBAN STORM WATER MITIGATION PLAN AND STORM WATER BEST MANAGEMENT PRACTICES REGULATIONS AND FEES. Regulations pertaining to the implementation of the Standard Urban Storm Water Mitigation Plan (SUSMP) and Storm Water Best Management Practices (BMPs) as well as any related service fees and charges related to the implementation of such regulations, shall be adopted by resolution of the City Council." SECTION 3. Section 8130.11 of the Arcadia Municipal Code is hereby amended to read as follows: "8130.11 AMENDMENT. Volume I, Section 107.3 in Chapter I of said Uniform Building Code is amended to read as follows: 107.3. Plan Review Fees. (a) When submittal documents are required by Section 106.3.2, a plan review fee shall be paid at the time of submitting documents for plan review. Said plan review shall be sixty-five percent (65%) of the building permit fee. (b) When submittal documents are required to be reviewed for compliance with the State's Energy Conversation Regulations, an energy plan review shall be paid at the time of submitting documents for review. 3 2130 Said energy plan review shall be twenty percent (20%) of the building permit fee. (c) When submittal documents are required to be reviewed for compliance with the City's Fire Code by the Fire Department, a plan review fee shall be paid at the time of submitting documents for review. Said Fire Department plan review fee shall be nine point seventy-five percent (9.75%) of the building permit fee. (d) When approved plans are revised, a supplemental plan review fee shall be paid to the City either in an amount set by City Council resolution or equal to the actual cost to review the plans plus an administrative fee of ten percent (10%) as applicable. (e) The plan review fees specified in this section are separate fees from the permit fee specified in Section 107.2 and are in addition to the permit fees. (f) When submittal documents are incomplete or changed so as to require additional plan review, or when the project involves deferred submittal items as defined in Section 106.3.4.2, an additional plan review fee shall be charged at the rate determined by the fee schedule adopted by City Council resolution. 4 2130 (g) When submittal documents must be reviewed for compliance with the City's Standard Urban Storm Water Mitigation Plan and Storm Water Pollution Prevention Control Plan Regulations, a plan review fee as adopted by City Council resolution shall be paid at the time of submitting the documents." SECTION 4. The City Council hereby declares that, should any provision, section, subsection, paragraph, sentence, phrase or word of this ordinance be rendered or declared invalid or unconstitutional by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the City Council would have independently adopted the remaining provisions, sections, subsections, paragraphs, sentences, phrases or words of this ordinance and as such they shall remain in full force and effect. SECTION 5.
