ORDINANCE NO. 2142
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ARCADIA, CALIFORNIA, EXTENDING FOR ONE (I)
YEAR SECTION 1 OF ORDINANCE NO. 2119 RELATING
TO PERMITTED USES IN THE S-1 ZONE (SECTION
9273.1.1 0.1)
WHEREAS, on April 18, 2001 Santa Anita Park requested a time extension
to Section I of Ordinance No. 2119 which amended Section 9273.1.10.1 of the
Arcadia Municipal Code allowing horse racing and other events to be telecast at
Santa Anita Park via satellite feed seven (7) days a week until no later than 1:30
a.m.; and
WHEREAS, a public hearing was held on May 8, 2001 before the Planning
Commission at which time all interested persons were given full opportunity to be
heard and to present evidence; and
WHEREAS, the Planning Commission ofthe City of Arcadia recommended
approval of the extension of hours per Section 9273.1.10.1 as set forth in
Ordinance No. 2119 with the provision that the ordinance shall terminate within
one year unless extended by Ordinance of the City Council following a noticed
public hearing before the City Council; arid
WHEREAS, a public hearing was held before the City Council on May 15,
2001 at which time all interested persons were given full opportunity to be heard
and to present evidence; and

WHEREAS, the S-l (Special Use) zone is the underlying zone of the Santa
Anita Race Track property and said zone identifies special uses that are allowed in
this zone. The predominant permitted uses set forth for the S-l zone are typical of
activities that take place at the Race Track throughout the year and with the
exception of horse racing, most are temporary in nature; and
WHEREAS, the City Council on June 6, 2000, adopted Ordinance No. 2119
amending Section 9273.1.1 0.1 and adding Sections 9273.1.18 and 9273.2.10 to the
Arcadia Municipal Code relating to permitted uses in the S-l zone and establishing
performance standards for certain nighttime activities. Said Ordinance became
effective July 6, 2000; and
WHEREAS, in order to allow the City Council an opportunity to review the
impact of the increased hours and potential increased activity as a result of any
special events, the City Council added Section 4 to said Ordinance providing a one
(1) year sunset provision noting that Section 9273.1.1 0.1, "shall remain in effect
for a period of one (1) year following the effective date of this ordinance, at which
time Section 1 of this Ordinance will terminate unless extended by ordinance of the
City of Arcadia following a noticed public hearing...."; and
WHEREAS, Santa Anita Park filed a request for an extension to this Section
to allow the continuance of horse racing and other events to be telecast at Santa
Anita Park via satellite feed seven days a week until no later than 1 :30 a.m. Since

the adoption of Ordinance No. 2119 in June of 2000, there have been no special
events, unrelated to live horse racing, that have taken place on the premises; and
WHEREAS, the current code pennits horse racing and other events via
satellite feed seven (7) days a week until 1 :30 a.m.; and
, WHEREAS, the City Council hereby finds that allowing the use of satellite
feed for horse-racing and other activities seven (7) nights a week until 1 :30 a.m.
with the appropriate perfonnance standards would have a negligible impact on the
adjoining neighborhoods.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 9273.1.10.1 of the Arcadia Municipal Code is hereby
extended and shall remain in effect for a period of one (1) year from the effective
date of this Ordinance, at which time said Section shall tenninate unless extended
by ordinance of the City of Arcadia following a noticed public hearing. In
detennining that a two (2) year amortization (including the one (1) year extension
set forth in this Ordinance) for the tennination of the uses set forth in Section
9273.1.1 0.1 is reasonable and appropriate, the City Council has taken into
consideration the following: that this amortization period is made known to all
owners of property in the S-1 Zone in advance of the adoption of Ordinance No.
2119 and this Ordinance, and that the owners of property in the S-1 Zone will

likely not, and will not be reasonably required to, expend significant funds in
installing pennanent improvements solely for the purpose of pursuing the uses set
forth in Section 1 of this Ordinance, and which could not also be used for other
uses pennitted in the S-1 Zone.
SECTION 2. The City Clerk shall certify to the adoption of this Ordinance
and shall cause a copy of the same to be published in the official newspaper of said
City within fifteen (15) days after its adoption.
