HomeMy WebLinkAbout2146 ....._r. _ ORDINANCE NO. 2146 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE BY ADDING NEW SECTIONS 9273.2.11, ET SEQ. ESTABLISHING DESIGN REVIEW PROCEDURES IN THE S-l (SPECIAL USE) ZONE. WHEREAS, Text Amendment T.A. 2001-02 was initiated by the Development Services Department at the direction of the City Council to establish design review procedures for new structures, additions and exterior alterations in the S-I (Special Use) Zone, specifically pertaining to Santa Anita Racetrack; and WHEREAS, on May 8, 200 I, a public hearing was held before the Planning Commission on said matter at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the Planning Commission voted 5 to 0 to recommend to the City Council approval of Text Amendment 2001-02 and further to consider the addition of the United States Department of Interior Standards and Guidelines for Historic Preservation; and WHEREAS, on June 5, 2001, the City Council held a public hearing on said text amendment; and WHEREAS, as part of the record of this hearing, the City Council reyiewed and considered: I. All staff reports and related attachments and exhibits submitted by the Community Development Division of the Development Services Department to the City Council; 2. The record of the. Planning Commission hearing regarding Text Amendment T.A. 001-002; 1 2146 3. All information and material presented as part of the public testimony at the City Council public hearing on June 5, 200 I, including the staff report, the environmental documents including the Negative Declaration, and all documentation presented at the public hearing; and WHEREAS, based upon the existing criteria in the S-I (Special Use) zone, if a project complies with the underlying regulations and is in conformance with the General Plan, it is permitted without any review by the City; and WHEREAS, the City Council recognizes that the Santa Anita Racetrack located in the S-I (Special Use) zone is a key community feature and an important component of Arcadia's character, especially as noted in the General Plan; and WHEREAS, because of the importance of the Racetrack to the community, the City Council hereby finds that adding design reyiew procedures to the S-I zoning regulations will help to implement the goals of the City's General Plan and ensure that the architectural design of any additions, exterior alterations and new structures and their materials and colors will be visually harmonious with the existing Racetrack architectural design. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: Section 1. Article IX, Division 3 (S-I Special Use Zone) of the Arcadia Municipal Code is hereby amended by adding Sections 9273.2.11 et seq. to read as follows: 9273.2.11. DESIGN REVIEW OBJECTIVES, The following design review procedures are intended to implement the goals of the City's General Plan and the following purposes: 2 2146 A. Ensure that the architectural design of any additions, exterior alterations and new structures and their materials and colors are visually hannonious and compatible with the existing Racetrack architectural design and functionally build upon the Racetrack's attributes, B. Ensure that the location and configuration of structures are visually hannonious with their sites and with surrounding sites and structures and do not dominate their surroundings to an extent inappropriate to their use. C. Ensure that new buildings and structures respect the architectural and cultural heritage represented by the existing Racetrack buildings. D. Ensure that the grandstands remain recognizable from key locations along the perimeter of the Racetrack. E. Ensure that the design and location of signs and their materials and colors are consistent with the character and scale of the buildings to which they are attached or which are located on the same site and ensure that signs are visually hannonious with surrounding development. 9273.2.11.1. APPLICABILITY. Architectural design approval within the S-l (Special Use) zone is required prior to: A. The issuance of a building penn it or sign pennit; B. The approval or conditional approval of a conditional use pennit, variance or modification with respect to any and all exterior alterations, additions and new construction; C. Installation of exterior lighting for the infield and parking areas; and D. Installation of perimeter and parking lot landscaping and signing improvements. The review and approval, conditional approval or disapproval shall be by the Planning Commission and the City Council, except as noted in Section 9273.2.11.2. The provisions ofthis Chapter shall not apply to building permits for 3 2146 work which is located entirely within a building and which does not alter the external appearance of said building. 9273,2.11.2. ADMINISTRATIVE DESIGN REVIEW A. The Development Services Director or designee (hereinafter referred to as "Director") shall have the authority to review and approve, conditionally approve or disapprove applications for: . minor exterior alterations not affecting the architectural integrity of the existing grandstand fayade; . minor modifications to existing housing for racetrack employees; . mmor improvements directed towards stabling and care of thoroughbreds; . minor exterior lighting plans within the infield and parking areas; . landscaping improvements; and . minor signing improvements, This process shall be deemed to constitute "Administrative Review". B. The Director shall haye the discretion to refer said applications to the Planning Commission for review and approval, conditional approval or disapproval when it is determined that an application is beyond the scope of the intent of the Administrative Review process, C. The Director shall review an application submitted for design approval and which is subject to Administrative Review within thirty (30) working days of acceptance of an application and may approve, conditionally approve or disapprove the application or refer the application to the Planning Commission for review and approval, conditional approval or disapproval. 4 2146 Within five (5) working days after a decision, the Director shall mail a notice of the decision to the applicant and shall provide a copy of such notice to the City Council. D. The applicant may appeal the Director's decision to the Planning Commission within five (5) working days by submitting a request to the Director. Such request shall be accompanied by an appeal fee as set forth by Resolution of the City Council. E. Any decision of the Planning Commission under this Section (9273.2.11.2) may be appealed to the City Council within five (5) working days of the decision of the Planning Commission accompanied by an appeal fee as set forth by Resolution of the City Council. F. Anyone or more members of the City Council may, within fifteen (15) calendar days after the Director's notice of decision, request that the Director place the design review for consideration on the agenda of the next reasonably available City Council meeting. G. The provisions of Section 9600 (Review of Planning Commission Decisions) shall also be applicable. 9273,2,\1.3. INITIATION OF DESIGN REVIEW - ADMINISTRATIVE OR PLANNING COMMISSION/CITY COUNCIL. Design review shall be initiated by an application submitted to the Director. The application shall be in a form prescribed by the Director and shall include such plans and materials required for adequate review, including but not limited to: A. Site Plan B. Floor plan drawn to scale including square footage C. Building elevations including all building facades D. Building perspectives E, Colored rendering of building elevations and site plan 5 2146 F. Materials sample board including a description of the types of materials, colors, treatment, etc. Some of the above information may be waived if it is determined by the Director that said information is not necessary. More information may be required if it is deemed necessary by the Director to adequately evaluate the application. The application shall not be deemed to be received by the City until the Director determines that it is complete and accompanied by the required fee. 9273.2.11.4, DESIGN REVIEW PROCESSING AND PUBLIC HEARING. A. An application for Administrative Review shall be submitted to the Director for review, as set forth in Section 9273.2.11.2 B, An application for design review before the Planning Commission and City Council shall be submitted to the Development Services Department for scheduling of a public hearing before the Planning Commission for its review and recommendation to the City Council. C. The City Council following its receipt of the Planning Commission's recommendation shall conduct a public hearing and shall approve, conditionally approve or disapprove said application based upon consistency with the City's zoning regulations and the General Plan. D. Notices of public hearings before the Planning Commission and the City Council concerning design review shall be given by mailing notice to the owners of properties within a radius of one thousand (1,000) feet of the exterior boundaries ofthe entire Racetrack property. 9273.2.11.5. FEE. An applicant for design review shall pay to the City, at the time of initial application, a fee in an amount established by Resolution of the City Council. 6 2146 9273.2.11,6. EXPIRA nON OF APPROVAL. Design review approval or conditional approval shall expire one (1) year following the date of approval or conditional approval unless plans have been submitted for plan check to the Deyelopment Services Department. 9273.2.11. 7. EXTENSION OF APPROVAL. The Director or the legislative body that granted approval or conditional approval of the application may extend the design review approval or conditional approval time not to exceed one (1) year beyond the initial expiration date, The applicant shall submit to the Director a letter requesting an extension a minimum of thirty (30) days prior to the initial expiration date. Not more than one (I) time extension may be granted. Section 2. The City Clerk shall certifY to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of said City within fifteen (15) days after its adoption.
