ORDINANCE NO. 752
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIF-
ORNIA, MAKING A PERMMr~NT EXCEPTION TO CERTAIN PROVISIONS OF
ORDINANCE NO. 439 OF SAID CITY, ADOPTED JUNE 28, 1940.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS:
SECTION 1. Petition of MILLARD F. HARTLEY, having been filed in
the office of the Planning Commission of the City of Arcadia, pursuant
to the provisions of Ordinance No. 439 of said City, adopted June 28,
1940, asking that an exception be made affecting the property described
in said petition, and setting forth the specific reasons therefor and
the circumstances in connection therewith, and recommendation having
been made by the Planning Commission to this Council, and a ful1 in-
vestigation and consideration of the facts having been made by this
Council pertinent to this petition; this Council determines that there
are exceptional or extraordinary circumstances or conditions applicable
to the property involved and to the intended uses thereof that do not
generally apply to the property or classes of uses in the same zone or
district in which said property is located, and wil1 not be inconsistent
with the general purposes of Ordinance No. 439, and that said property
should be excepted from the provisions of the zone created by said
Ordinance No. 439 affecting said property, but only insofar as herein-
after set forth; and the requirements of said Ordinance No. 439 pertain-
ing to the consent of adjacent property owners having been complied with;
This Counci~ therefore, excepts from the provisions of the respective
zone of Ordinance Ho. 439 of the City of Arcadia the hereinafter described
property, but only insofar as such exception is necessary to permit the
followlng described property to wit;
Lots 32, 33 and 34, Block 76, Santa Anita Tract, as shown on
Map recorded in Book 15, pages 89 and 90, records in the office
of the County Recorder of Los Angeles County.
to be used for the purpose of operating, maintaining and conducting
thereon a Steam laundry.
This exception is granted upon the following conditions:
(a) That said property shall not at any time be used for any pur-

pose or purposes not allowed in Zone C-2, of the City of Arcadia, except
as provided in this Ordinance:
(b) That all improvements permitted or required by this Ordinance
shall be constructed substantially in accordance with the general plan
now on file in the office of the Planning Conunission of the City of
Arcadia, and provided further that the construction of all such improve-
ments shall be corr.menced within t bree months from the effective date of
this ordinance, and shal1 be completed substantially in accordance with
the plan forming part of the aforesaid petition within one year from
the effective date thereof, delays caused by acts of God and circumstances
or conditions not under the control of petitioner, his grantees, lessees
or assignees excepted.
(c) That no building p ermi t be granted for the construction or
erection of any bu:tlding upon said property unless the plans and speci-
fications be first submitted to the Building Inspector of the City of
Arcadia, and that said plans and specifications and said building or
buildings shall in a 11 particulars comply with the building ordinances
and sanitary regulations of the City of Arcadia.
(d) Thai; said property shal1 not at any time be used for any
purpose or purposes not specified in this ordinance.
(e) That in the event any of the provisions of this ordinance
are violated, the property above described shall revert to Zone 0-2, as
defined in Ordinance No. 439, and the rights and privileges hereingranted
shall terminate and cease in the event any such violation is not ter-
minated within thirty days or such further time as the City Council may
decide that the owner of said property, in the exercise of due diligence,
requires to correct such violation, after the owner of said property has
been given written :notice by the City Council of such violation.
SECTION 2. The City Clerk shall certify to the adoption of this
Ordinance, and priol~ to the expiration of fifteen (15) days from the
passage thereof, shall cause the same to be published once in the Arcadia
Tribune and Arcadia News, a newspaper of general circulation, published
and c:irculated in the City of Arcadia, and thirty (30) d!jV s from and

I HEREBY CERTIFY that the foregoing Ordinance was adopted at
a regular meeting of the City Council of the City of Arcadia, held on
the 15th day of February, 1949, by the affirmative vote of at least
three Couhcilmen, towit:
