ORDINANCE NO. 757 AN ORDINAN CE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, AMENDING OHDINANCE NO. 323 OF THE CITY OF ARCADIA BY ADDING A NEW SECTION THERETO TO BE KNOWN AS AND NUMBERED SECTION 43A. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Ordinance No. 323 of the City of Arcadia enti tIed "'An Ordinance of the City Counc11 of the City of Arcadia rela ting to Fire, Protection and Fire Prevention, Regulating the burning of brush, rubbish or other materials, for the protection of fire hose, fire apparatus and the water system of said City of Arcadia, prohibiting the taking of water without permission of an authorized officer of said City, establishing an incinerator district, creating the office of Chief of the Fire Department, establishing a district north of Foothill Boulevard as a fire hazard, providing for incinerators in residential districts, repealing Ordinances Nos. 120, 154, 199 and all Ordinances in conflict herewith and providing a penalty for the violation thereof." adopted September 17, 1935, be and the same is hereby amended by adding a new Section thereto to be known as and numbered Section 4:5A, which said section shall read as follows: shall follow immEldiately after Section 43 of said Ordinance and ~tytt-\.t'iJ 11r 'iJ~\). \\0' "SECTION 431l: It shall be unlaw1'ul for any person other than the ~~ ",II,' Cl.",,,~.. ,<'';; ~. <:i'l;: owner of an automobile fil1ing station, or the owner's employee or employees:, or attendant or attendants on duty, to operate any apparatus for the dispensing of gasoline or other motor fuel at any automobile filling station; and it shall be unlawful for the owner of any automobile fil1ing station, or the owner's employee or employees, or attendant or attendants on duty to permit the customer or customers of any a utomobile filling station to operate any apparatus for the dispensing of gasoline or other motor fuel.lt. SECTION 2. 'rhat this Ordinance is an emergency ordinance affect- ing the public peace, health and safety of said City and that the same -1- INDEXEC o.d, ?37 r shall therefore take effect and be in full force and effect upon final passage and adoption thereof. The facts constituting such urgency are as ..:follows : That there are now being planned and developed in the City of Arcadia Self-Service Automobile Fil1ing Stations which are proposed to be operated in such a manner as to create an immediate hazard to the public peace, h€alth and safety, which requires the immediate action of the City relating thereto, and the same therefoVS constituting a distinct present menace to the public's peace, health and safety in said City, and this Ordinance shall therefore take effect; at the earliest possible moment in order to effectively prevent evils herein sought to be corrected. ~t.?E"LUl f) '1 \ 0\\0.110' SECTION 3. The City C1fl rk shall certify to the adoption of this Ordinance Ilnd shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation published and circulated in said City of Arcadia, and thereupon and thereafter, the same shall take effect and be in force.
