HomeMy WebLinkAbout0759 ORDIN~lCE NO. 759 AN ORDINANCE OF THE CITY COUNCIL 0 F THE CITY OF ARCADIA APPROVING THE ANNEXATION OF CERTAIN TERRITORY DESIGN~ED AS "WEST ARCADIA ANNEX NO.4 ". THE CITY COUNCIL OF THLCITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, pursuant to t he "Annexation of Uninhabited Territory Act of 1939", the verified petition of Winchester Cooley and Hattie C. Iler was filed with the City Council requesting the annex- at:l.on to the City of Arcadia, State of California, of that certain un- inhabited territory contiguous to the City of Arcadia designated as, "West Arcadia Annex No. 411, and hereinafter more particularly described; and WlillREAS, at a regular meeting of the City Council held on the 1st day of February, 1949, Resolution No. 1834 was adopted by said Council giving notice of and fixing the 1st day of March, 1949, at 8:00 O'clock P. M., in the Council Chamber in the City Hall of the City' of Arcadia, as -the day, hour and place when and where any and all persons owning real property within such territory so proposed to be annexed, and having any objections to the proposed annexation, might appear be- fore the City Council 0 f the City of Arcadia and show cause why such territory should not be so annexed; .and . WHEREAS, a copy of said resolution was published in the City of Arcadia at the 1;imes and in the manner required by Section 5 of said "Annexation of Uninhabited Territory Act of 1939" ; .and WHEREAS, no persons owning real property within said territory proposed to be unnexed to the City of Arcadia appeared before said City Council at the hour of 8:00 o'clock P. M., on the 1st day of March, 1949, who had aI~ objections whatsoever to the annexation of said un- inhabi ted terri1;ory to the City of Arcadia; and WHEREAS, on March 1, 1949, there was filed with the City Clerk the written con8ent of the petitioners, wherein consent was given that the said property, after its annexation to the City of Arcadia, may be taxed equally w1th the property within the City of Arcadia to pay the bonded indebtedness of t he city outstanding on the date of such -1- /.' ~c (J.-td, 76 /" annexation for 1946 Sewer Bonds heretofore authorized and issued by the City of Areadia, or my indebtedness therefore authorized and to be represented by bonds of the City of Arcadia, thereafter to be 'issued, and WHEREAS, all proceedings have been in conformity with law: NOW, THEREFORE, the annexation of that certain uninhabited terri- tory contiguoml to the City of Arcadia, in the County of Los Angeles, State of California, designated as, lI'liest Arcadia Annex No.4"', as hereinafter more particularly described, hereby is approved, and that said property, after its annexation to the City of Arcadia, shall be taxed equally vii th the property wi thin the City of Arcadia to pay the bonded indebte<mess of the City outstanding on the date of such annex- ation for 1946 Sewer Bonds heretofore authorized and issued by the City of Arcadia, or any indebtedness theretofore authorized and to be represented by bonds of the City of Arcadia thereafter to be issued. Said property is bounded on the east by, and is contiguous to, certain property within the corporate limits of the City of Arcadia, to wit: certa:lh property on and along Baldwin Avenue in said City of Arcadia, County of Los Angeles, State of California, and the property hereb:f annexed as aforesaid is more particularly described as follows: That portion of Lot 5, Block "Art of the Santa Anita Land Company's Tract, County of Los Angeles, State of California, as per map recorded in Book 6 page 137 of Maps, in the office of the County Recorder of said County, described as follows: BEGINNING at the Northeasterly corner of said Lot 5; THENCE South 800 451 West, along the Northerly line thereof 166.08 feet, mor,~ or less to the Northeasterly corner of the land conveyed by Edward T. Shekell to Anna H. TIilliams by deed dated 1/18/24, and recorded in Book 3081, Page 98 official Records of Los Angeles County, California; THENCE South 80 50' East, parallel with the Uesterly line of said Lot 5, 207 feet more or less to the Northerly line of land conveyed by Edward T. Sheke,lJL -2- O I ~<~ ..to, 7~ ./ and wife to Walter- C, Shekell and wife, by deed recorded in Book 6411 Page 78 of deeds, Records of Los Angeles County; THENCE Easterly along said Northerly liLe and the Easterly prolongation thereof to the Easterly line of said Lot 1:.; TIlliNCE Northerly along said Easterly line to the point of BEGINNING. EXCEPT the Nor therly 25 feet included within the lines of Naomi Drive, and That portion of Lot 5, in Block IIAII of the Santa Anita Land' Company's Tral~t, in the County of Los angeles, State of California, as per map recorded in Book 6, Pase 137 of Maps, in the office of the County Recorder of said. County, described as follows: BEGINNING at a point in the North line of said Lot 5, distant thereon West 266.08 feet from the Northeast corner thereof; THENCE South 8050' East, parallelwith the \7esterly line of said lot, 207 feet more or less, to the intersection with the Westerly prolongation of the Northerly line of the land conveyed by Edward T.Shekell and wife, to Walter C. Shekell and wife, by deed recorded in Book 5380, Page 251 of Deeds; THENCE Easterly along said prolongation and tbn Northerly line of the land so conveyed, 100 feet; THENCE North 80 50' West, parallel with the Westerly line of s aid Lot 5, 207 feet, more or less, to the North line of said Lot 5; THENCE West along the Northerly line of said Lot 5, 100 feet to the point of BEGINNING. EXCEPTING therefrom the Northerly 2~ feet, included within the lines of Naomi Drive, 50 feet wide as now established. SECTION 2. The City Clerk shall certify to the adop.tion of this Ordinance and prio.r to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof s aid Ordinance shall take effect and be in force. -3- /.17<3'V' O./!-Cf!: / I HEREBY Cm,TIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 15th day of March, 1949, by the affirmative vote of at least three Councilmen) towit: AYES NOES Councilmen, Boucher) Klomp, Libby, Nugent and Russell . .
