HomeMy WebLinkAbout0762 .> , ' ORDINANCE NO. 762 AN ORDINANCE ADOPTING A PLUMBING CODE FOR THE CITY OF '< ARCADIA, CALIFORNIA THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1: '.l:hat a certain document, three copies of which are on file for use and examinatidn by the public, in the office of the City Clerk of the City of Arcadia, being marked and designated as "Uniform PlUI)1bing Code, 1948 Edition, adopted by Western Plumbing Officials AssI,ciation at the Eighteenth Annual Canference, October 1947", consis.ting of 85 pages, together with the Index portion of said Code to be found on Pages 86 to 101, both inclusive, be and the same is hereby adopted as the Plumbing Code of the City of Arcadia, t;o provide for the protection of the public health and safety, and the EIXtt amination, registration and licensing of persons engaged in the business of plumbing or laboring at the trade of plumbing; requiring a permi 1; for the installation or alterationof plumbing, gas and drainage systems;; creating the Office of Plumbing Official and the Board of Plumbing &~- aminers, and prescribing their duties; defining certain terms; es- tablishing minimum regulations for the installation, alteration or rl3pair of plumbing, gas or drainage systems, and the inspection thereof; anli providing penalties for its violation; and each and all of the regu- lations, provisions, penalties, conditions and terms of such "Uniform Plumbirg Code, 1948 Edition, adopted by Western Plumbing Officials Association at the Eighteenth Annual Conference, October, 1947", includ- ing said Index thereto, heretofore referred to as being adopted, on f:ile in the office of the City Clerk as ~foresaid, are hereby referred to, adopted and ~ade a part hereof as if fully set out in this Ordinance, pro vided, however, that certain Sections of said Uniform Plumbing Code snallbe and t.he same are hereby amended as hereinafter set forth in this Ordinance. SECTION 2. Section 102 of said Uniform Plumbing Code is hereby amended to read as follows: -1- \l"DE~ED Jpe/ /' If cc;(, "SEGTION 102. PLUMBING OFFICIAL AND ASSISTANTS. To provide for the administration and enforcement of this Ordinance, th3 Office of Plumbing Official is hereby created. The City Council shall appoint the Plumbing Official and may appoint assistants to the Plumbing Official to aid him in the discharge of the duties of his office. Any person orpersons appointed under the provisions of t;his Section shall hold office at the pleasure of the City Council". SECTION ~ Section 103 of said Uniform Plumbing Code is hereby amended to read as follows: "SECTION 103. PLUMBING OFFICIAL'S QUALIFICATIONS. "The Plumbing Officials and/or all Assitant Plumbing Officials hereafter appointed shall be familiar with all of the pro- visions of this Code, and qualified to enforce tthe same". SECTION 4: Section 104 of said Uniform Plumbing Code is hereby amended by inserting in the blank space provided in said Section 104 the word, IIBuildingll. SECTION 5: Section 108 of said Uniform Plumbing Code is hereby amended by inserting in the first paragraph of said Section the words, "Five Hundred Dollar s"; and in the second blank space provided in said Section, the words, "Six months ". SECTION 6: Section202 of said Uniform Plumbing Code is hereby amended to road as follows: IISECTION 202. APPOINTMENT OF A BOARD OF PLUMBER EXAMINER~. liThe Board of plumber Examiners shall be appointed by and. under the jurisdiction of the City Council, and shall consist of three members, one of whom shall be a licensed Master Plumber, one shall be a certified Journeyman Plumber, and one a licensed architect. The members of said Board shall be appointed for, and shall serve for, three years, provided that any member or members of s aid Board may be sooner removed at the pleasure of the City Council. The Plumbing Official shall act a s Secretary to said Board". SECTION 7: Section 209 of said Uniform Plumbing Code is hereby amended to read as follows: -2- 0--1-cl 7 ,;.~ lIi:mcTION 209. RENEWAL OF CERTIFICATES. "l~very Plumber I s Certificate of Competency shall be issued for the unexpired portion of the calendar year, shall bear the date of issuance, and shall remain in force and effect from said dalte to Decem- ber 31 of th(l year of issuance, unless sooner cancelled or revoked. Each such Certificate may be renewed from year to year upon payment of a renewal fee which shall be the same as the fees set forth in Section 205 of this Code, without any further examination unless the previous Certificate has been cancelled or revoked. Each such re- newal shall be applied for and shall be made within 30 days from the date of expiration of the Certificate, and any Certificate which is not so renewed shall becone null and void". SECTION 8: Section 213 of said Uniform Plumbing Code is hereby amended to read as follows: "S~CTION 213. LICENSE Fl!.'E. "Bl9fore any Master Plumber I s Certificate shall be issued c.r renewed, prol)f shall be made to the Board of Plumber Examiners that the applicant has secured and paid for any business license or licenses required by '~he City of Arcadia under any Ordinance of said City". SECTION 9: Section 214 of said Uniform Plumbing Code is hereby amended to r'9ad as follows: IIS:E:CTION 124. BOND. "Every person, firm or corporation (a) before carrying on or engaging in the business of plumbing, or (b) laboring at the trade of plumbing, or (c) performing plumbing work that is not under the imme- diate supervision of a licensed Master Plumber, shall, before procuring a permit for the performance of such work, deposit with the Plumbing Official a cash deposit of $100.00 or a surety bond of $500.00. Said cash deposit or bond shall befor the benefit of the City of Arcadia, to assure full and faithful compliance with all of the provisions of this Ordinance or any amendments thE!' eto. "Said bond shall be held for the duration of the plumbing license of the depositor thereof, and, if deposited by someone othe1' -3- OACI 71.;z. than a licensl3d plumber, shall be held until the final approval by the Plumbing Offil~ial of the plumbing work performed. Upon the expiratic-n or termination of such license, or final approval of the work, such cash deposit or so much thereof as still remains unappropriated shall be re- paid to the dl~pos i tor thereof. "In the event thSlt any plumbing work performed by the de- positor of any cash deposit or bond does not fully comply with the pro- visions of thts Ordinance, and if upon five days' notice the said depositor fails or neglects to remedy such defective work or non-com- pliance, the said Plumbing Official may have such defective work cor- rected and out of such cash deposit pay the amount required to remedy such defective work, or in case of a bond, proceed to enforce the p ro- visions thereof. In the event that a portion of said cash d eposi t i 8 use. to correct defective work, no permit to do plumbing work shall be iSllued to the depositor thereof until said cash bond is restored to the ori-- ginal amount of $100.00". SECTION 10: Section 303 of said Uniform Plumbing Code is hereby amended by adding thereto a new paragraph to be known as paragraph lI(d)", to I'ead as follows: "SECTION 303. TO WHOM PERMITS MAY BE ISSUED. "(d) Before issuing any permit under this Section 30:3, thl3 Plumbing Official shall require an affidavit from the person who pro-. poses to do the work, which affidavit shall set forth all pertinent facts which by this Section are required to exist before a permit here- under is issued". SECTION 11: The Schedule of Fees under Section 305 of said Uniform Plumbing Code is hereby amended to read ~s follows:: "SECTION 305. SCHEDULE OF FEES. "KIND OF FIXTURE TRAP SIZE Water closets Clinic Sinks 4" 3" UNITS 6 6 " ~st~\..t\)1~~ SECTION 13: The first paragraph of Section 707 of 'I- \\0. tl'l-\)' PIFmbing Code is hereby amended to read as follows: "SECTION 707. CLEANOUTS. said Uniform aErl:.,\~lO '7!'f OR\). \.0. "Every horizontal soil or waste-pipe or pipings shall be provided with a cleanout at its upper terminal, and every such run of piping, wh:lch is more than fifty (50) feet in length, shall be provided with a cleanout for each fifty (50) feet, or fraction thereof, -5- OAe" ~(,;L.. in the length of such piping, and a cleanout shall be installed directly at the upper end of everyone-quarter (t) of ninety degree (900) elbow or bend in any soil or waste piping, provided, however, that a cleanou'~ shall not be required on any such concealed or completely enclosed pipl~ or piping which is above the first floor of the building. "The property owner shall be responsible, and the City shall not be responsible, for the maintenance, repair or replacement of housl~ laterals back of the point of connection thereof with the main trunk silwer. "All cleanouts which would be ordinarily located within five feet of exterior walls shall be carried to and shall be located outsidEl of the exterior wall. All structures shall have installed a cleanout "T", which shall be located on the house sewer at a point not less than 4 feet and not more than 6 feet from the exterior wall". SECTION 14: A new Section is hereby added to s aid Uniform Plumbing Code to be known as "section 803", which shall read as follows:. "SECTION 803. CONNECTION VUTH MAIN SEVr.ER. "Whenever it is found necessary to connect a lateral sewer tel a main sewer line, such connection shall be made only by the person in charge of City :3ewers. A fee of $2.00 shall be charged for the labor of making such connection, the necessary materials to be furnished and excavation done by the plumber constructing such lateral. It shall be unlawful for an:r person other than a City employee in charge of sewers to make such connection." SBCTION 15: The second paragraph of Section 1210 of said Uniform Plumbing Code iB hereby amended to read as follows: "SECTION 1210. PROHIBITED FIXTURER. "Pan and valve plunger, offset washout, long hopper, or other type of water closet h3ving invisible trap seals or unventilated spaces or surfaces not thoroughly washed at each flush, shall not be installed. No dry or chemical closet shall be installed in any building used for human habitation, provided, however, that in the mountainous area in the northerly section of the City of Arcadia, where at present there are no existing sewers. chemical closets may be permitted, with the -6- ()~ 7/;6- approval of the Health Department of the City of Arcadia, in the dis- cretion of the Plumbing Official". SECTION 16: Section 1309 of said Uniform Plumbing Code is hereby amended to read as follows: "SECTION 1309. MAIN SHUTOFF VALVE. "A readily accessible main, fullway gate valve, controlling all outlets, shall be installed on the discharge side of the water metElr, and a similar valve, readily accessible, shall be installed on the out.. side of the exterior wall at the point where the water piping enters the structure. All valves used as main shutoff valves on a cold water supply pipe shallbe gate valves or full-opening cocks or stops." SECTION 17: Ordinance No. 126, adopted and approved September 19~ 1923; Ordinance No. 185, adopted and approved November 3, 1926; Ordinance No. 365, adopted and approved October 26, 1947; Ordinance No. 379, adopted and approved June 21, 1938; Ordinance No. 459, adopteld and approved April 22, 1941; Ordinance No. 483, adopted and approved May 19, ~942, and all other ordinances or parts of ordinances in confli,ct herewith are hereby repealed, provided that any such repeal shall not affect or prevent the prosecution and punishment 0 f any person for any act heretofore done or committed in violation of any ordinance which is repealed hereby. SECTION 18: The City Clerk shall certify to the adoption of this Ordinance and i1;s approval by the Mayor of said City, and shall cause the same to be pUblished once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, within fifteen (15) days after the date of its passage. and sa!. d Ordinance shall becoDEl effective and in full force and Ilffect thirty (30) days from and after the date of its final passage.
