HomeMy WebLinkAbout0763 ORDINANCE NO. 763 AN ORDINANCE OF THE CI~ COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, MAKING AN EXCEPTION TO CERTAIN PROVISIONS OF ORDINANCE NO. 439 OF SAID CITY OF ARCADIA, ADOPTED JUNE 28, 1940. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1.. Petition of JOSEPH SAYLIN, having been filed in the office of the Planning Commission of the City of Arcadia, pursuant to the provisions of Ordinance No. 439 of said City, adopted June 28, 1940, asking that an exception be made affecting the property described in said petition, arid setting forth the specific reasons , therefore and the circumstances in connection therewith and recom- mendation having been made by the Planning Commission to this Council, and a full investigation and consideration of the facts having been made by this Council pertinent to this Petition; this Council deter- mines that there are exceptional or extraordinary circumstances or conditions applicable to the property involved and to the intended uses thereof that do not generally apply to the property or classes or uses in the same zo ne or district in which said property is located, and will not be inconsistent with the general purposes of Ordinance No. 439, and that said property should be excepted from the provisions of the zone created by said Ordinance No. 439 affecting said property, but only so far as hereinafter set forth; and the requirements of said Ordinance No. 439 pertaining to the consent of adjacent property owners having been complied with; This Council, therefore, excepts from the provisions of the respective zone of Ordinance No. 439 of the City of Arcadia, the property hereinafter described, but only so far as such exception is necessary to permit the following described property, to wit: Lot 29, Tract No. 6341, in the City of Arcadia, County of Los Angeles, State of California, as shown on map recorded in Book 10.i, Page 21 of Maps, in the office of the County Recorder o:f said County, to be used and occupied for the -1- INOEl(E!) aul /6-3 following purposes, to wit: The conducting and maintaining of a professional and business office building on said property. This exception is granted upon the following conditions: (a) That no building permit be granted for the construction or erection of any building upon said property unless the plans and specifications be first submitted to the Building Inspector of the City of Arcadia, and that said plans and specifications and said building shall in all particulars comply with the ~uilding Ordinance, sani"t;ary regulations and the regulations governing the construction of a building in Fire Zone No.1 of the City of Arcadia. (b) That Baid property shall not at any time be used for any purpose or purposes not specified in this Ordinance. (c) That in case any of the provisions of this Ordinance are violated, the property above described shall re~ert to Zone R-l as defined in Ordinance No. 439, and the rights and privileges herein granted shall te.rminate and cease in the event that any such violation is not terminated within thirty days, or such further time as the City Council may decide that the owner of said property, in the ex~ ercise of due diligence, requires to correct such violation, after the owner of said property has: been given written notice by the City Council of such violation. SECTION 2: The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. I HBREBY CEHTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 3rd day of May, 1949, by the affirmative vote of at least three Councilmen, to wlt: ~2- Oft<1.
