HomeMy WebLinkAbout0767 ORDINANCE NO. 767 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, A1ffiNDING SECTIONS 2 and 4 OF ORDINANCE NO. 710 OF THE CITY OF ARCADIA, ADOPTED AND APPROVED JUNE 2, 1948, .pROVIDING FOR THE CREATION OF A DISASTER COUNCIL. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION ~. That Section 2 of Ordinance No. 710 of the City of Arcadia, entitled "An Ordinance of the City Council of the City of Arcadia, relating to disasters, providing for the creation of a disaster council, prescribing the powers and duties of the members' thereof, and providing penalties for violations of such ordinance", adopted June 2, 1948, be and the same is hereby amended to read as follows: "SECTION 2. DISASTER COUNCIL. MEMBERSHIP. The Arcadia Disaster Council is hereby created and shall consist of the following: A. The Mayor, who shall be chairman and Commander. B. The Vic(~-Commander, appointed by the Mayor, with the advice and consent of tile City Council, who, in the absence of, or at the direction of, the Commander, shall act on his behalf on matters within the purview of this Ordinance. C. The Chi(~fs of Divisions as hereinafter provided. D. Such other representatives of civic, business, labor, veterans, professional, or other organizations as may be appointed by the Mayor with the advice and consent of the City Council. SECTION 2. That Section 4 of said Ordinance No. 710 be and the same is hereby amended to read as follows: "'SECTION 4. COMMANDER. POWERS AND DUTIES. There is hereby created the office of COlmnander. Such officer shall be appointed with the advice and consent of the City Counci~. The Commandl~r is hereby empowered: A. To proclaim the existence or threatened existence of a disaster' and the terminatIon thereof: B. To request the Governor to proclaim a state of extreme emergency in the area in and around the City of Arcadia when in the opinion of the Commander the re'30urces of the community are inadequate to cope with the -1- \l'-O~Ad 7t::7 disaster: C. To govern and direct the effort of the Arcadia Disaster Corps in the accomplishment of the purposes of this Ordinance: D. To direct coordination and cooperation between the chiefs of divisions and resolve questions of authority and responsibility that may arise between ~hem: E. To represent the Disaster Corps in all dealings with public or private agencies pertaining to disaster preparedness. It shall also be the duty of the Commander, and he is hereby em- powered, during a disaster or when a disaster is imminent: A. To make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such dis- aster: B. To obtain vital supplies, equipment and such other properties found lacking and needed for the protection of the life and property of the people, and bind the City for the fair value thereof, and, if required immedj~ately, to commandeer the same for public use: C. To require emergency services of any City Officer or employee: D. To requisition necessary personnel or material of any city department or agency: E. To execute all of his ordinary powers as Mayor, all of the special powers conferred upon him by this Ordinance, and all power~ conferred upon him. by any other lawful authority. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration o'f fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. I HEREBY CERTIFY that the foregoing Ordinance IVas adopted at a -2- ad 7t:';7 regular meeting of the City Council of the City of Arcadia, held on the 7th day of June, 1949, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen, Boucher, Klomp, Libby, Nugent and Russell NOES: NODE!
