ORDINANCE NO. 770
AN ORDIN~~CE OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
C1l.LIFORNIA, REQUIRING THE CAPPING OF WELLS.
THE CITY GOUNCIL OF THE CITY OF ARCADIA, DOES ORDAIN
AS FOLLOWS:
SECTION I., As used in this Ordinance, "person" means any indi-
vidual, firm, copartnership, joint adventure, association, social club"
fraternal organization, corporation, estate, trust, business trust,
receiver, syndicate, or any other group or combination acting as a unit,
and the plural as well as the singular number.
SECTION 2.. "Shall" is mandatory. "May" is permissive.
SECTION 3.. If any portion of this ordinance or the application there-
of to any person or circumstance is held invalid, the remainder of the
ordinance and t;he application of such provision to other persons or
circumstances shall not be effected thereby.
SECTION 4. Every person who digs, drills, excavates, constructs,
owns or controls any abandoned water well, or abandoned oil well, and
every person owning or having possession of any premises on which any
such abandoned well exists, shall cap or otherwise close the mouth of
or entrance to such well in such a manner as to prevent persons from
falling therein, and in such a manner that such capping or covering cannot
be removed by accident or inadvertence, or such persons shall fill such
a well.
SECTION 5. Whenever any person fails or refuses to perform any act
required by this Ordinance ~he City may itself cap, cover or fill such
well. It is not. necessary to follow the provisions of this section asa
condition precedent to any criminal prosecution.
SECTION 6. That any person, firm or corporation violating any of
the wovisions of this Ordinance shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be punishable by a fine not exceeding
Five Hundred ($E,OO.OO) Dollars, or by imprisonment in the City Jail of
said City of Arcadia, or in the County Jail of s aid County of Los Angeles,
state of California, at the discretion of the Committing Ml!.gistrate, fo:r
a period not exceeding six (6) months, or by both such fine and

imprisonment; and each such person, firm or corporation shall be
deemed guilty of a separate offense for each day during any portion of
which the violation of or failure, neglect or refusal~o comply with
any of t he provisions of this Ordinance is committed, continued or
permitted.
SECTION 6. 'I'he City Clerk shall csr tify to the adoption of this
Ordinance and prior to the expiration of fifteen (15) days from the
passage thereof. shall cause the same to be published once in the
Arcadia Tn bune and Arcadia News, a newspaper of general circulation,
published and circulated in the City of Arcadia, and thirty (30) days
from and after the final passage thereof said Ordinance shall take
effect and be in force.
I HEREBY CERTIFY that the foregoing Ordinance was adopted at
a regular meeti.ng of the City Council of the City of Arcadia, held on
the 7th day of June, 1949, by the affirmative vote of at least three
Councilmen. towit:
